HomeMy WebLinkAboutOrdinance 3795 ORDINANCE N0. 3/�- AN ORDINANCE AMENDING SECTION 9-A OF ORDINANCE NO. 3011, BEING AN AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, PHESCR.IB- ING A SAVINGS CLAUSE; PROVIDING A PENALTY FOR THE VIOLATION OF ANY SECTION OF THIS ORDINANCE OF NOT LESS THAN FIVE DOLLARS ($5.00) NOR MORE THAN TWO HUNDRED DOLLARS ($20,00); PROVIDING EACH DAY THE VIOLATION CONTINUES SHALL BE A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 9-A of Ordinance No. 3011 be and the same is hereby amended. SECTION 2. That SECTION 9-A, RF-R" RESTRICTED COMMERCIAL DISTRICT, USE REGULATIONS, Paragraph 1, be amended, and after being amended, it shall read as follows: 1-r. Any uses permitted in the eEs Commercial District, except that the sale of alcoholic beverages is excluded. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordi- nance is for any reason held to be unconstitutional, void or invalid, the validity of the remaining portions of this ordinance shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion hereafter or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality or invalidity of any section, subsection, sentence, clause, phrase, portion, provision or regulation of this ordinance. SECTION 4. Arq person, firm, or corporation who violates, disobeys, omits, neg- lects or refuses to comply with this ordinance, or who resists the enforcement of any of the provisions thereof, shall be fined not less than Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00) for such offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. The zoning regulations and districts, as herein established, have been made in accordance with a comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic and other dan— gers; to provide adequate light and air; to prevent the overcrowding of land; and avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements. They have been made with reasonable consideration, ammg other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land through the community.
