MARES, CLAUDIA A. MARTINEZ, ROBERT NEEL MCDONALD) SHARON NEWMAN- STANFIELD, JO ANN REYES, JAMES D. RODGERS, AND NANCY E. STRICKLAND AS MUNICIPAL JUDGES FOR A TWO -YEAR TERM COMMENCING APRIL 1, 2012 AND ENDING MARCH 31, 2014 OR UNTIL A SUCCESSOR IS QUALIFIED AND APPOINTED IN ACCORDANCE WITH STATE LAW; DESIGNATION OF CHIEF JUDGE AND DEPUTY CHIEF JUDGE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Stephanie J. Beamer, Andrew T. Bradshaw, Simon C. Gonzalez, Benita Falls Harper, Ninfa L. Mares, Claudia A. Martinez, Robert Neel McDonald, Sharon Newman - Stanfield, Jo Ann Reyes, James D. Rodgers, and Nancy E. Strickland as Municipal Judges for a two -year term commencing April 1, 2012 and ending March 31, 2014, or until a successor is qualified and appointed in accordance with state law. SECTION 2. That Ninfa L. Mares be designated as Chief Judge and that James D. Rodgers be designated as Deputy Chief Judge. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth. Texas (1986). as amended. except Micre pro% isions of this ordinance are in direct conflict with the provisions of such ordinances and Code, in which event such conflicting provisions of such ordinances and Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect upon adoption. Adopt the attached ordinance appointing Stephanie J. Beamer, Andrew T. Bradshaw, Simon C. Gonzalez, Benita Falls Harper, Ninfa L. Mares, Claudia A. Martinez, Robert Neel McDonald, Sharon Newman - Stanfield, Jo Ann Reyes, James D. Rodgers and Nancy E. Strickland as Municipal Judges for a two year term commencing April 1, 2012 and ending March 31, 2014 or until a successor is qualified and appointed, in accordance with state law. 2. Designate Ninfa L. Mares as Chief Judge and James D. Rodgers as Deputy Chief Judge. DISCUSSION: Chapter 30, Section 30.00006(b) of the Government Code under the Uniform Municipal Court Act requires the governing body of a municipality to appoint its Municipal Judges by ordinance. Adoption of the attached ordinance would reappoint the current sitting Municipal Judges Stephanie J. Beamer, Andrew T. Bradshaw, Simon C. Gonzalez, Benita Falls Harper, Ninfa L. Mares, Claudia A. Martinez, Robert Neel McDonald, Sharon Newman - Stanfield, Jo Ann Reyes, James D. Rodgers and Nancy E. Strickland, pursuant to Section 30.00006(b) of the Government Code, and designate the Chief Judge and Deputy Chief Judge, pursuant to Section 30.00007 of the Government Code. On March 5, 2012, the Ad Hoc Municipal Court Advisory Committee voted to recommend to the City Council the reappointment of Ninfa L. Mares as Chief Judge and to recommend the appointment of James D. Rodgers as Deputy Chief Judge for a two year term commencing April 1, 2012 and ending March 31, 2014. The Committee further voted to recommend to the City Council that the salary for the Deputy Chief Judge James D. Rodgers be set at a rate of $48.94 per hour. Thereafter, on March 19, 2012 and April 17, 2012, the Ad Hoc Municipal Court Advisory Committee voted to recommend to the City Council the above listed persons for reappointment as Municipal Judges for a two year term commencing April 1, 2012 and ending March 31, 2014.
