AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
EMERGENCY ACCESS EASEMENTS AND PUBLIC OPEN SPACE
EASEMENTS AT THE INTERSECTION OF NE 28T" STREET AND IH-
35W NORTH FREEWAY SITUATED IN BLOCK IR, UNITED SERVICES
CENTER ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 388 -140,
PAGE 35 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following portions of the emergency access easements and public open space
easements described below:
A. Being all of the 20 foot by 20 foot public open space easement situated in Lot
6, Block 1 -R United Service Center Addition, an addition to the City of Fort
Worth, according to the plat recorded in Volume 388 -140, Page 35, Plat
Records of Tarrant County, said 20 foot by 20 foot public open space
easement being more particularly described in attached description "A" and
containing 200 square feet of land, more or less;;
B. Being all of the 20 foot by 20 foot public open space easement situated in Lot
7, Block 1 -R, United Service Center Addition, an addition to the City of Fort
Worth, according to the plat recorded in Volume 388 -140, Page 35, Plat
Records of Tarrant County, said 20 foot by 20 foot public open space
easement being more particularly described in attached description "B" and
containing 200 square feet of land, more or less;
C. Being the 20 foot by 20 foot public access easements situated in Lot 7, Block
1 -R, United Service Center Addition, an addition to the City of Fort Worth
according to the plat recorded in Volume 388 -140, Page 35, Plat Records of
Tarrant County, Texas and a portion of the emergency access easement shown
on said United Service Center Addition, said 20 foot by 20 foot public access
easements and emergency access easement being more particularly described
in attached description " C" and containing 7.478 square teet of land, more or
less;

D. Being all of the 20 foot by 20 foot public access easement situated in Lot 8,
Block 1 -R, United Service Center Addition, an addition to the City of Fort
Worth according to the plat recorded in Volume 388 -140, Page 35, Plat
Records of Tarrant County, Texas, said 20 foot by 20 foot public open space
easement being more particularly described in attached description "D" and
containing 200 square feet of land, more or less;
E. Being all of the 20 foot by 20 foot public open space easement situated in Lot
3, Block 1 -R, United Service Center Addition, an addition to the City of Fort
Worth according to the plat recorded in Volume 388 -140, Page 35, Plat
Records of Tarrant County, Texas, said 20 foot by 20 foot public open space
easement being more particularly described in attached description "E" and
containing 200 square feet of land, more or less;
F. Being the 20 foot by 20 foot public open space easements situated in Lot 2 -R
and Lot 9, Block 1 -R, United Service Center Addition, an addition to the City
of Fort Worth according to the plat recorded in Volume 388 -140, Page 35,
Plate Records of Tarrant County, Texas and a portion of the emergency access
easement shown on said United Service Center Addition, said 20 foot by 20
foot public open space easements and said emergency access easement being
more particularly described in attached description "F" and containing 9,885
square feet of land, more or less;
G. Being a tract of land that is a portion of the emergency access easement shown
on the United Service Center Addition according to the plat recorded in
Volume 388 -140, Page 35, Plat Records of Tarrant County, Texas, said tract
of land being more particularly described in attached description "G" and
containing 11,293 square feet of land, more or less;
and as more specifically described in Exhibit "A" (with associated descriptions "A through G ")
attached hereto and incorporated herein, by reference be and the same are vacated and
extinguished.
SECTION 2.
That the fee to the lands in the above- described vacated alleys and streets are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities

located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

388 -140, Page 35, Plat Records of Torront County, Texas and a portion of the Emergency Access Easement

BEGINNING at a 5/8 inch iron rod found in the easterly line of the tract of land described in the deed to

BEING a tract of land that is a portion of the Emergency Access Easement shown on the United Service

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating three portions of an emergency access easement and eight 20
foot by 20 foot public open space easements within Block 1 R, United Services Center Addition, at the
intersection of NE 28th Street and IH -35W North Freeway; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M &C G-
15624).
DISCUSSION:
Dunaway Associates, Inc., on behalf of Barney Holland Oil Company, has requested the vacation of these
portions of an emergency access easement and these public open space easements to replat them with
the adjoining property for future development. The City Plan Commission recommended approval of this
request at its meeting on January 26, 2011. An acceptable replat (FS- 010 -139) has been received. Any
existing utilities will be relocated at the applicant's expense, or retained within a designated easement,
along with an appropriate plat note that no permanent structures may be constructed or placed thereon.
The City of Fort Worth (City) originally obtained the above mentioned right -of -way through the platting
process. The City does not own land under or adjacent to the above referenced alley. Since no City funds
have been expended to purchase property or easement rights, collection of the fair market value or any
portion thereof is recommended by Staff to be waived.
This land is located in COUNCIL DISTRICT 2.

The Financial Management Services Director certifies that this action will have no material effect on City
funds.
