AN ORDINANCE CLOSING AND VACATING A DEDICATED SANITARY SEWER EASEMENT ACROSS LOT 3, BLOCK 9, OVERTON PARK WEST ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described dedicated sanitary sewer easement be and the same is hereby extinguished, vacated, closed and permanently abandoned as an easement for sanitary sewer facilities: An easement as recorded in Vol. 3270, page 372, Deed Records of Tarrant County, Texas, which on November 5, 1958, was executed in favor of the City of Fort Worth, Texas, for a strip of land sufficiently wide to construct and maintain an 8 inch sanitary sewer, with the usual appurtenances and necessary connections thereto, across Lot 3, Block 9, Overton Park West Addition, as said plat is recorded in Vol. 388-12, page 62, Plat Records of Tarrant County, Texas, the center line of said sanitary sewer easement being described as follows: Beginning at a point in the east property line of Lot 3, Block 9, Overton Park West Addition, said point being 3 feet south of the northeast corner of said lot; thence north 87 degrees 58 minutes west, along a line 3 feet south of and parallel to the north property line of said Lot 3, to a point in the east line of a 10 foot utility easement, said point being 3 feet south and 5 feet south 87 degrees 58 minutes east of the northwest corner of said Lot 3. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby re- leased and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in con- flict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. City of Fort Worth, Texas .Mayor and Council Communication DATE REFERENCE SUBJECT: Abandonment of Sanitary Sewer PAGE NUMBER PZ-121 Easement - Block 9, Overton Park Addi- i °r 12/14/64 tion 1 Cassco Land Company, Inc., developer of Overton Park Addition, has requested that the City abandon a sanitary sewer easement across the center of Lot 4-R, Block 9, Overton Park Addition, because the sewer line has been relocated and the easement no longer is needed, as shown on the attached plat. The easement was granted to the City on November 5, 1958; however, a recent replat of the property left the easement across the center of Lot 4-R, dis- couraging immediate development of the lot. The developer has dedicated a new easement and, at his expense, has relocated the sanitary sewer line. The Water Department has been contacted and agrees to abandoning the easement which no longer is needed. No other departments or utility companies were contacted because the original dedication was for sanitary sewer purposes only. On October 14, 1964, the City Plan Commission reviewed the request and recom- mended adoption of an ordinance abandoning the easement as requested.
