WHEREAS, the City of Fort Worth (City) and Slater
Engineering,ket Engineer) made and entered into City Secretary
Contract No. 35581, (the Contract) which was authorized by the
City Council by M&C C-22173 on the 12th day of June 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Berkshire-Hallmark Drainage Improvements, Project No. 00480
WHEREAS, it has become necessary to execute Amendment No. 1
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in M&C C-24686,adopted
by the City Council on the 25th day of January 2011 and further
amplified in a proposal letter dated July 30, 2010 , copies of
which are attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by
Engineer total 262,746. 60 .
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $684,551 . 60.

AMENDMENT NO. 1
SCOPE OF SERVICES
I. ALIGNMENT STUDY FOR A WESTERN ROUTE
Slater Engineering Inc. was requested to study the alternative routes available for
conveying the storm water westward eliminating the difficult eastern route and
interactions with TxDOT.
II. SUBSURFACE UTILITY DATA— AVAVA DR. & WEDGWOOD AREA
A City requirement (see description at end of this attachment)
It is anticipated that three (3) utilities will be located.
III. TRAFFIC CONTROL PLANS
A City requirement (see description at end of this attachment)
It is anticipated that eleven (11) supplemental traffic control drawings will be developed.
IV. REPRODUCTION SERVICES
Additional reproduction associated with storm drain extensions and Alava Dr.
V. SLATER ENGINEERING SURVEY
Slater Engineering will provide survey services of storm drain extensions
and Alava Drive.
VI. WEDGWOOD AREA EXTENSION
The original limits of the storm drain system were set by the Farrington and Associate
plans of 1974, file Number S-22 9923. The current design criteria provides for a greater
runoff for both the 5 year and the 100 year effectively extending the limits up-stream.

VII. ALAVA DRIVE STORM DRAIN
1. Alava Drive is a new project location being added to existing contract. New Storm
Drain design is required.
2. Water Department has requested that the water line on Alava Dr, from Alava Ct. to
Felisa be replaced.
It is anticipated that eighteen (19) additional plan and standard sheets will be required.
VIII. ADDITIONAL SERVICES
1. ATTEND ADDITIONAL MEETINGS WITH CITY STAFF
Attend additional review meetings with City staff, 2 per project.
2. EXPAND SWPPP PLANS
SWPPP plans are presently included in cost of projects but they will need to be
Extended and re-arranged into the proper project.
3. SWPPP REPORT
A separate SWPPP report will be required for projects over one acre.
4. PROVIDE ADDITIONAL SPECIFICATION DOCUMENTS FOR REVIEW
Each project will require its own documents for review.
5. BID PHASE SERVICES

7. ATTEND CONSTRUCTABILITY ON SITE WALK THROUGH
A new City requirement
"Prior to the 60 percent review meeting with the CITY, the ENGINEER shall schedule
and attend a project site visit with the CITY Project Manager and Construction
personnel to walk the project. The ENGINEER shall summarize the CITY's
comments from the field visit and submit this information to the CITY in writing."

Slater Engineering made the conversion to conform to city standard, this
conversion will conform with the additional work under this amendment.
9. PREPARE SIX RIGHT-OF-ENTRY (6 ROE anticipated)
10. CONVERT WATER PLANS FROM 40 SCALE TO 20 SCALE
A Water Department request.
11. IDENTIFY WATER METER SERVICES
A new requirement by the Water Department.
12. SUBSURFACE UTILITY ENGINEERING
Slater Engineering will coordinate and apply data to the construction plans.
IX. ADJUST CONTRACT FEE
1. Record drawings did not show that a new storm drain system had been placed in
Wonder Court at the time this design contact was executed. A City engineer confirmed
that he did the design of a new system and the storm drain system was constructed thus
not requiring a new design.
2. The Water Department has requested that the water design process on Wonder Ct. be
terminated since the storm drain system will no longer be replaced.
3. The Water Department has requested that the water design process on Wedgmont Circle
be terminated since the condition of the water line does not warrant its replacement.
4. The Water Department has requested that the sanitary sewer line along Whitman Ave. be
deleted from the contract since its condition does not warrant the replacement.
5. The original fee for providing 50 sets of plans and specifications will be deleted from
the contract since the plans and specifications will be uploaded onto the City's Buzzsaw
system and specifications sold at the office of Slater Engineering.

SUBSURFACE UTILITY DATA
Provide Subsurface Utility Engineering (SUE) to Quality Level B. The SUE shall be
Perform in accordance with Cl/ASCE 38-02. It is anticipated that 5 utilities will
be located along project route.
Engineer shall provide SUE plan sheet deliverable sealed by a licensed
professional engineer REGISTERED IN THE State of Texas.
Quality Level D
• Conduct appropriate investigations (e.g., owner records, County/CITY records, personal
interviews, visual inspections, etc.), to help identify utility owners that may have facilities within
the project limits or that may be affected by the project.
• Collect applicable records (e.g., utility owner base maps, "as built"or record drawings, permit
records, field notes, geographic information system data, oral histories, etc.) on the existence
and approximate location of existing involved utilities.
• Review records for: evidence or indication of additional available records; duplicate or
conflicting information; need for clarification.
• Develop SUE plan sheets and transfer information on all involved utilities to appropriate design
plan sheets, electronic files, and/or other documents as required. Exercise professional
judgment to resolve conflicting information. For information depicted, indicate: utility type and
ownership; date of depiction; quality level(s); end points of any utility data; line status (e.g.,
active, abandoned, out of service); line size and condition; number of jointly buried cables; and
encasement.
Quality Level C (includes tasks as described for Quality Level D)
• Identify surface features,from project topographic data and from field observations, that are
surface appurtenances of subsurface utilities.
• Include survey and correlation of aerial or ground-mounted utility facilities in Quality Level C
tasks.
• Survey surface features of subsurface utility facilities or systems.
• The survey shall also include (in addition to subsurface utility features visible at the ground
surface):determination of invert elevations of any manholes and vaults; sketches showing
interior dimensions and line connections of such manholes and vaults; any surface markings
denoting subsurface utilities, furnished by utility owners for design purposes.
• Exercise professional judgment to correlate data from different sources, and to resolve
conflicting information.
• Update (or prepare) plan sheets, electronic files, and/or other documents to reflect the
integration of Quality Level D and Quality Level C information.
• Recommend follow-up investigations (e.g., additional surveys, consultation with utility owners,
etc.) as may be needed to further resolve discrepancies.
• Provide Quality Level C to identify overhead utilities on the project and provide the overhead
utility information on the SUE plan sheets.

Level B(includes tasks as described for Quality Level C)
• Select and apply appropriate surface geophysical method(s) to search for and detect
subsurface utilities within the project limits, and/or to trace a particular utility line or system.
• Based on an interpretation of data, mark the indications of utilities on the ground surface for
subsequent survey. Utilize paint or other method acceptable for marking of lines.
• Unless otherwise directed, mark centerline of single-conduit lines, and outside edges of multi-
conduit systems.
• Resolve differences between designated utilities and utility records and surveyed
appurtenances.
• Recommend additional measures to resolve differences if they still exist. Recommendations
may include additional or different surface geophysical methods, exploratory excavation, or
upgrade to Quality Level A data.
• As an alternative to the physical marking of lines, the ENGINEER may, with CITY's approval,
utilize other means of data collection, storage, retrieval, and reduction, that enables the
correlation of surface geophysical data to the project's survey control.
TRAFFIC CONTROL PLAN
• Develop a traffic control plan utilizing standard traffic reroute configurations posted as
"Typicals" on the CITY's Buzzsaw website. The typicals need not be sealed individually, if
included in the sealed contract documents.
• Develop supplemental traffic control drawings as needed for review and approval by the Traffic
Division of the Transportation and Public Works Department. These drawings shall be sealed
by a professional engineer registered in the State of Texas.

BID PHASE SERVICES.
ENGINEER will support the bid phase of the project as follows.
• The ENGINEER shall upload all plans and contract documents onto Buzzsaw for access to
potential bidders.
• Contract documents shall be uploaded in a .xls file.
• Unit Price Proposal documents are to be created utilizing CFW Bidtools only and combined in a
specified spreadsheet workbook, Bid Proposal Worksheet Template, and will be populated and
configured so that all pages are complete and the Summary Worksheet(s) in the workbook
detail and automatically summarize the totals from the inserted Unit Price Proposal document
worksheets.
• Plan Sets are to be uploaded to Buzzsaw in two formats, .pdf and .dwf files. The .pdf will
consist of one file of the entire plan set. The .dwf will consist of individual files, one for each
plan sheet, and will be numbered and named in a manner similar to that of the plan set index.
• The ENGINEER shall sell contract documents and maintain a plan holders list on Buzzsaw
from documents sold and from Contractor's uploaded Plan Holder Registrations in Buzzsaw.
• The ENGINEER will develop and implement procedures for receiving and answering bidders'
questions and requests for additional information. The procedures shall include a log of all
significant bidders questions and requests and the response thereto. The log shall be housed
and maintained in the project's Buzzsaw folder titled Request for Information. The ENGINEER
will provide technical interpretation of the contract bid documents and will prepare proposed
responses to all bidders questions and requests, in the form of addenda. The ENGINEER shall
upload all approved addenda onto Buzzsaw and mail addenda to all plan holders.
• Attend the pre-bid conference in support of the CITY.
• Attend the bid opening in support of the CITY.
• Tabulate and review all bids received for the construction project, assist the CITY in evaluating
bids, and recommend award of the contract. A copy of the Bid Tabulation is to be uploaded
into the project's Bid Responses folder on Buzzsaw.
• Assist the CITY with assembling and awarding contracts for construction, materials, equipment,
and services.
• Incorporate all addenda into the contract documents and issue conformed sets. Provide 10 sets
of full size drawings, 10 sets of half size drawings and 20 sets of Specifications.

CONSTRUCTION PHASE SERVICES.
ENGINEER will support the construction phase of the project as follows.
• The ENGINEER shall attend the preconstruction conference.
• After the pre-construction conference, the ENGINEER shall provide project exhibits and attend
public meeting to help explain the proposed project to residents. The CITY shall select a
suitable location and mail the invitation letters to the affected customers.
• The ENGINEER shall visit the project site at requested intervals as construction proceeds to
observe and report on progress. It is assumed the one site visit per month.
• The ENGINEER shall review shop drawings, samples and other submittals submitted by the
contractor for general conformance with the design concepts and general compliance with the
requirements of the contract for construction. Such review shall not relieve the Contractor from
its responsibility for performance in accordance with the contract for construction, nor is such
review a guarantee that the work covered by the shop drawings, samples and submittals is free
of errors, inconsistencies or omissions. The ENGINEER shall log and track all shop drawings,
samples and other submittals.
• As requested by the CITY, the ENGINEER shall provide necessary interpretations and
clarifications of contract documents, review change orders, and make recommendations as to
the acceptability of the work.
• The ENGINEER shall attend the "Final" project walk through and assist with preparation of final
punch list.

Record Drawings
• The ENGINEER shall prepare record drawings from information submitted by the inspector
and/or Contractor. The drawings shall be submitted as full size (22" x 34") mylar drawings.
• Record Drawings shall also be submitted as an Adobe Acrobat PDF format (version 6.0 or
higher) file and DWF format. There shall be one (1) PDF file and one (1) DWF file for the
TPW plan set and a separate PDF and DWF file for the Water plan set. Each PDF and DWF
file shall contain all associated sheets of the particular plan set. Singular PDF and DWF files
for each sheet of a plan set will not be accepted. PDF and DWF files shall conform to
naming conventions as follows:
I. TPW file name example — "W-1956_org47.pdf" where "W-1956" is the assigned file
number obtained from the CITY, "_org" designating the file is of an original plan set, "47"
shall be the total number of sheets in this file.
Example: W-0053_org3.pdf and K-0320_org5.pdf
II. Water and Sewer file name example — "X-35667_org36.pdf" where "X-35667" is the
assigned file number obtained from the CITY, "_org" designating the file is of an original
plan set, "36"shall be the total number of sheets in this file.
Example: X-12755_orgl8.pdf
Both PDF and DWF files shall be submitted on one (1) Compact Disk, which will become
property of and remain with the CITY. Floppy disks, zip disks, e-mail flash media will not be
accepted.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of$65,588.86 from the Water and Sewer
Operating Fund to the Water Capital Projects Fund in the amount
of$50,673.53 and the Sewer Capital Projects Fund in the amount
of$14,915.33;
2.Adopt the attached appropriation ordinance increasing estimated
receipts and appropriations in the Water Capital Projects Fund in
the amount of$50,673.53 and the Sewer Capital Projects Fund in
the amount of$14,915.33 from available funds; and
3. Authorize the City Manager to execute Amendment No. 1 with
Slater Engineering,Inc., in the amount of$262,746.60 to City
Secretary Contract No. 35581,thereby,revising the total contract
cost to$684,551.60.
DISCUSSION:
The Storm Water Management Program was established to reduce
flooding in Fort Worth,preserve streams,minimize water pollution
and to operate the storm water system in a more effective manner
to fully comply with state and federal regulatory requirements.
This will be accomplished by infrastructure reconstruction and
system maintenance, master planning,enhanced development
review, and increased public education and outreach.
On September 22,2009, (Ordinance No. 18838-09-2009)the City
Council approved the issuance and sale of$45,000,000.00 in
revenue bonds for Storm Water Capital Project Bond 2009 Fund,
to fund a two—year storm water capital project program.
A Request for Qualifications(RFQ)to provide drainage design
was issued by the City in January of 2006.Twenty—four design
consultants submitted statements of qualifications,including Slater
Engineering,Inc.
Slater Engineering,Inc.,was selected to provide design services
for drainage improvements for the Berkshire—Hallmark Drainage
Improvements and Wedgwood Storm Drain project(City Project
No.00480).
On June 12,2007, (M&C C-22173)the City Council authorized
the City Manager to execute an engineering agreement with Slater
Engineering, Inc., (City Secretary Contract No. 35581)in the
amount of$421,805.00 for the design of Berkshire—Hallmark
Drainage Improvements.
The need for additional design scope, including water and sewer,
has been identified. The original contract for the
Berkshire—Hallmark project was based on recommendations from
a drainage study completed in 2005. During design, the 2006
Stormwater Management Design Manual criteria was used and
resulted in a change in the conceptual alignment for the
Berkshire—Hallmark area and extension of the project limits for
both the Berkshire—Hallmark and Wedgwood areas. In addition,
the City now requires subsurface utility engineering and traffic
control plans on all projects,which were not included in the
original contract. Amendment No. 1 will provide the following:
alignment study for the Berkshire—Hallmark subdivision,
subsurface utility engineering,traffic control plans,additional
survey, additional reproduction,additional design services for the
Wedgwood subdivision,and additional design,bid phase,and
construction phase services for a storm drain and water line design
along Alava Drive. The Alava Drive portion of the project is new
and was not part of the original contract.
Slater Engineering, Inc.proposes to perform the design services for
a lump sum fee of$262,746.60. City staff considers the fee to be
fair and reasonable for the scope of services proposed. The
estimated construction cost of the total project is$8,620,000.00.
The project includes four project locations and it is anticipated will
be bid as four separate bid packages. The construction estimate for
each location is as follows: Berkshire—Hallmark($4,920,000.00),
Victorian Drive($50,000.00),Wedgwood($3,040,000.00), Alava
Drive ($610,000.00).
Slater Engineering, Inc., agrees to maintain its initial M/WBE
commitment of 21 percent that it made on the original agreement
and extend and maintain that same M/WBE commitment of 21
percent to all prior amendments up to and inclusive of this
Amendment No. 1. Therefore Slater Engineering, Inc.,remains in
compliance with the City's M/WBE Ordinance and attests to its
commitment by its signature on the Acceptance of Previous
M/WBE Commitment form executed by an authorized
representative of its company.
This project is located in COUNCIL DISTRICT 6,Mapsco 89Q,
89U and 103C.
FISCAL INFORMATION:
The Financial Management Services Director certifies that upon
approval of the above recommendations and the adoption of the
attached appropriation ordinance,funds will be available in the
current capital budgets,as appropriated,of the Storm Water
Capital Project Bond 2009 Fund,the Water Capital Projects Fund,
and the Sewer Capital Projects Fund and in the current operating
budget,as appropriated,of the Water and Sewer Fund.
