HomeMy WebLinkAboutOrdinance 6795 ORDINANCE NO. to AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 31, FOSTEPCO HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, FROM THE SOUTH LATE OF 36TH STREET TO THE NORTH LINE OF 35TH STREET„ BE ABANDONED, VACATED AND CLOSED; PROVIDING THA'C 36TH STREET IN THE 400 BLOCK, FROM THE WEST LINE OF NORTH GROVE STREET TO THE MOST EASTERLY RIGHT- OF-WAY LINE OF THE CHICAGO, ROCK ISLAND AND TEXAS RAILWAY COMPANY, WHICH EASTERLY LINE IS COLLINEAR WITH THE MOST WESTERLY LINE OF TRACT 5, WM. B. TUCKER SURVEY, PROJECTED SOUTHERLY ACROSS 36TH STREET, BE VACATED, ABANDONED AND CLOSED; PROVID- ING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 31, Fostepco Heights Addition to the City of Fort Worth, Tarrant County, Texas, from the south line of 36th Street to the north line of 35th Street, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That 36th Street in the 400 block, from the west line of North Grove Street to the most easterly right-of-way line of the Chicago, Rock Island and Texas Railway Company, which easterly line is collinear with the most westerly line of Tract 5, Wm. B. Tucker Survey, projected southerly across 36th Street, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except easements are reserved for sanitary sewer, electric and other existing utilities in said 400 block of 36th Street. SECTION 3. That the interest of the City of Fort Worth in the fee! to the land in said alley and street is hereby released and shall revert to the adjacent owner of the fee as pro- vided by law. SECTION 4. That all ordinances or parts of ordinances in conflict: herewith are hereby repealed. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Laughlin has requested that the City vacate the alley in Block 31, Fostepco Heights Addition from N. E. 36th Street south to N. E. 35th Street REED and N. E. 36th Street in the 400 block westward from North Grove Street to the Chicago-Rock Island-Texas R.R. , as shown on the attached map. Subject rights-of-way, acquired by dedication, are unimproved. There are N „n \ sanitary sewer and electric facilities located within 36th Street but no QXXA� existing utility facilities within the alley. The reviewing City depart- ments and private utility companies have no objections to this request provided the applicant replats and retains easements for existing and proposed utility facilities. A satisfactory replat including necessary easements has been submitted by the applicant. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public rights-of-way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject rights-of- way as recommended by the City Plan Commission.
