ORDINANCE NO.
AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE.
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
SHAMROCK AVENUE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of.streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
lA - SHAMROCK AVENUE From University Drive to a point ,105'
West of the East Property Line of Lot 1,
Block 12, and to a point 71' East of the
East Property Line of Lot 7, Block 6.
Bailey's Industrial Addition (Station
'15+39.9), known and designated as Unit
No. 1A, Project No. 104-24000-185: a
six-inch thick reinforced concrete pave-
went on a six-inch thick lime stabilized
subgrade with seven-inch high superim-
posed concrete curb, so that the finished
street will consist of one forty foot
wide roadway, and by constructing six-
inch thick concrete driveways where
specified.
1B - SHAMROCK AVENUE From a point 1.05' West of the East Pro-
perty Line of Lot 1, Block 12, and a
point- 71' East of the East Property Line
of Lot 7, Block 6, Bailey's Industrial

ject No. 104-24000-185: a six-inch thick
reinforced concrete pavement on a si -inch
thick lime stabilized subgrade with seven-
inch high superimposed concrete curb; so
that the finished street will consist of
one forty foot wide roadway.
5 - WIIMRLY STREET From Cullen Street to Shamrock Avenue,
known and designated as Unit No. 5, Pro-
ject No. 104-2W00-185: a six-inch thick
reinforced concrete pavement on a six-inch
thick lime stabilized subgrade with seven-
inch high superimposed concrete curb, so
that the finished street will consist of

structing six-inch thick concrete drive-
ways where specified.
6 - TILLAR STET From Wimberly Street to Foch Street,
known and designated as Unit No. 6, Project
No. lo4-24000-185: a silo-inch thick rein-
forced concrete pavement on a six-inch
thick lime stabilized subgrade with seven-
inch high superimposed concrete curb, so
that the finished street will consist of
one forty foot wide roadway, and by con-
structing six-inch thick concrete drive-
ways where specified.
7 - TILLAR STREET From Vacek Street to Rupert Street, known
and designated as Unit No. 7, Project No.

together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor- contract therefore has been made and
entered into with J. L. BERTRAM CONSNR bTION & ENGI " "' , INC.
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
1A - SHAMROCK AVENUE From University Drive to a point 105'
West of the East Property Line of Lot 1,
Block 12, and to a point 71' East of the
East Property Line of Lot 7, Block 6,

A hearing be given and held by and before the City Council of the City
oi Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets , avenues and public places , as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 15th day of June , 1970 , at 9:30 A.M.
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance: with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places , as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. in those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per-
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con••
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

A Neighborhand Meeting was conducted by the Engineering Division at 439 P0, on
May 4 , 1970, at Crestwood Elementary School , 3600 White Settlement Raid : Nine (9)
priperty nwners, representing six (6) parcel of property, were present ,
The meeting was opened by Mr. Odell Schmidt, Aasrssmfnt Paying Supervisor, who
explained the procedures concerning the proposed improvements and awner participa-
tion in the costs�
Mr: Joseph Coffman, 2848 Cullen Street, co-owner of Lots 1, 2 and 3, Blcck 6,
Bailey Industrial Addition, stated that he and Mr, and Mrs , Ceorge Smith, h0
partners, werc against the paving because they dR not feel it would benefit them
in any way, He explained their property fronted un Cullen Street , which in already
paved, and the proposed improvements in this project wouid be along the sido and
rear of their property. He also asked, in the evert thim project was piNved by
Councit, if it would be possible to get accees an 08mrock Avenue (the roar of the
property) - Mr, Schmidt advised him that this would be given consideration later
if the project was passed and they were 1011 intcreYL& in access to the rear of

Mr, L. Dt Qapsaddle, representing Fort Worth Associated Properties, Inc, , 200 North
Foch Street, nwner of Lots I-R, 2-R and 3-R., Block 11 , 3ailey Industrial Additiwn�
stated that her wishcd to go on record as being unaltcrahly opponad to the riving,
He stated that he felt it would not benefit the prnperty and also that the prices
being charged for the pavement were too high, he also qnvationod the rvyvR5 of
the poll card survey conducted two (2) years ago and stated that he did rat feel
it represented the consensus of opinion of the propetty nwnrrs is this area at,
this time , He particularly objected to the fact th4t the "No opinion" group it
the poll card survey results were added to the "Yes" anwwkrs . which gave a majtruy
of the footage in favor of the proposed improvements Mr, Clapsaddle then stated
he was going to contact the other property owners in this area about this mAtter,
and try to get them to appear together at Benefit Heating Itentatively scheduled
for Vne 15, 1970) to voice their objections to these improvements to the CounciL
Mr, Schmidt stated that this was the primary object of the Benefit Hearing and
that enyone wishing to speak for or against the imptovamtncs would be welcomE to
attend
Mr, Dale Sells, Manager of Texas Sash and Door Company, 201 North Rupert, Lots 10 - 13,
Block 18, stated that his company was against the paving because the proposed improvements
on Tillar Street - between Vacek and Rupert Street - were on the side of the lot and they
didn't feel the cost of paving Tillar, Street weld be reasonable for the benefits they
might gain.
Mr. George Grimes, 300 North University, owner of Lot 1, Block A, Bailey Industrial
Addition, and Mr. Dave Rubin, 3704 Autumn Dirve, co-owner of Lets 7 and 8, and West
30 feet of hot 9, Block 1.9, Bailey Industrial Addition, both stated they were in
favor of the paving on Shamrock Avenue, Mr. Grimes said he felt it would benefit
the area in general and him particularly since it would remove the dust hazard
created by the heavy trucks which are constantly entering or leaving this area°
After several general questions, pertaining to construction methods and work to be

Paving on the project was originally initiated'by a poll card survey in May,
1968. Upon review of the survey at that time, which indicated favorable
response on all streets except Rupert from Shamrock to Cullen, it was recommend-
ed that preparation of preliminary plans be continued. It was further recommend-
ed that Rupert be paved on the basis that it is the primary eastern entrance
into the area from White Settlement Road and also because the portion of Rupert
from Shamrock to Cullen is the only part not paved. However, since tnat time
some of the property on Rupert Street has been sold and the present owners are
in favor of having it paved, as outlined in Community Facilities Contract No.
6023.
