AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 0.485 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES, PRO- VIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held in the City Council Chamber in the City Hall of Fort Worth,Texas, on the 27th day of October, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 15th day of October, 1969, which date was not more than twenty (20) and not less than ten (10) days prior to the date of the opening of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 198.222 square miles on the 1st day of January 1969; and WHEREAS, the hereinafter described territory lies within the ex- clusive extraterritorial jurisdiction of the City of Port Worth, Texas; and WHEREAS, the hereinafter described territory contains approximately 0.485 square miles of land; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I THAT the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points con- tiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEING a tract of land about 16 miles northeast from the Courthouse of Tarrant County, Texas; generally located west of Greater Southwest International Airport: bounded on the east by American Airlines and FAA properties, on the west by the City of Euless, on the north by State Highway No. 183, and on the south by Hurst Pipeline Road; and lying in and including all or part of the A. J. Huitt Survey (Abstract No. 709) and the W. G. Matthews Survey (Abstract No. 1052) and being more fully described by metes and bounds as follows: BEGINNING at a point for corner in the heretofore fixed and established present city limit line of the City of Fort Worth, such point for corner being in the west line of Tract 1 of the A. J. Huitt Survey (Abstract No. 709) fifty (50) feet south of both the northwest corner of Tract 1 of the A. J. Huitt Survey (Abstract No. 709) and the south right-of-way line of State High- way No. 183; THENCE, south along and with the heretofore fixed and established present city of Fort Worth city limit line, said line being the west line of Tract 1 of the A. J. Huitt Survey (Abstract No. 709), a distance of 2591.1 feet; THENCE, along and with the heretofore fixed and established present City of Fort Worth city limit line as described in Fort Worth Ordinance No. 4941, adopted on second and final reading on July 15, 1963, as follows: ". . . THENCE, east along the south line of the A. J. Huitt Survey and the north line of the W. G. Mathews Survey a distance of 1306.1 feet, to its intersection with the west line of the V. J. Hutton Survey; "THENCE, south along the west line of the V. J. Hutton Survey and the west line of the Greater Southwest International Air- port tract to a point in the north right-of-way line of the Hurst Pipeline Road (County Road No. 3005); "THENCE, west along the north right-of-way line of Hurst Pipeline Road (County Road No. 3005), to a point 100 feet east from the present city limit lines of the cities of Fort Worth and Euless; "THENCE, north along a line, parallel to and 100 feet east from the present city limit lines of the cities of Fort Worth and Euless, to its intersection with a line 50 feet south from and parallel to the south line of Block 10, Oak Crest Estates; "THENCE, south 88 degrees -05 minutes east along said line, to its intersection with the east line of Lot 13-R, Block 10, Oak Crest Estates; "THENCE, northeast along the southeast line of Lot 13-R, Block 10, Oak Crest Estates to its intersection with the south right- of-way line of Koen Lane; "THENCE, northwesterly along the southerly right-of-way line of Koen Lane to its intersection with the northwesterly line of Lot 17-R, Block 9, Oak Crest Estates produced southwesterly; "THENCE, northeasterly to and along the northwesterly line of Lot 17-R, Block 9, Oak Crest Estates to its intersection with the southerly line of Lot 4-R, Block 9, Oak Crest Estates; -2- "THENCE westerly along the southerly line of Lot 4-R, Block 9, Oak Crest Estates to its southwest corner; "THENCE north along the west line of Lot 4-R, Block 9, Oak Crest Estates and along the west line of said lot produced north to its intersection with the north right-of-way line of Atkerson Lane; "THENCE west along the north right-of-way line of Atkerson Lane to the southwest corner of Lot 20R, Block 8, Oak Crest Estates; "THENCE north along the west line of Lot 20-R, Block 8, Oak Crest Estates, to its northwest corner; "THENCE west along the north line of Lot 19-R, Block 8, Oak Crest Estates, to the southeast corner of Lot 8-R, Block 8, Oak Crest Estates; "THENCE north along the east line of Lot 8-R, Block 8, Oak Crest Estates and along said line produced north to its intersection with the northerly right-of-way line of Huitt Lane; "THENCE easterly along the northerly right-of-way line of Huitt Lane to the southwest corner of Lot 19, Block 7, Oak Crest Estates; "THENCE northwesterly along the southwesterly line of Lot 19, Block 7, Oak Crest Estates, to the northwest corner of said lot; "THENCE northeasterly along the northwesterly line of Lot 19, Block 7, Oak Crest Estates to the southeast corner of Lot 9, Block 7, Oak Crest Estates; "THENCE northwest along the northeast line of Lot 9, Block 7, Oak Crest Estates, to its intersection with the southerly right-of-way line of Slaughter Lane; "THENCE northeasterly along the southerly right-of-way line of Slaughter Lane, to its intersection with the southwesterly line of Lot 23, Block 5, Oak Crest Estates produced southeasterly; "THENCE northwesterly along the southwesterly line of Lot 23, Block 5, Oak Crest Estates produced southeasterly, to and along the southwesterly lines of Lots 23 and 22, Block 5, Oak Crest Estates, to the west corner of Lot 22, Block 5, Oak Crest Estates; "THENCE northeasterly along the northwesterly line of Lot 22, Block 5, Oak Crest Estates, to the southwest corner of Lot 3, Block 5, Oak Crest Estates; "THENCE north along the west line of Lot 3, Block 5, Oak Crest Estates, and along the west line of said lot produced north, to its intersection with the north right-of-way line of Martin Lane; "THENCE east along the north right-of-way line of Martin Lane, to the southwest corner of Lot 22-R, Block 4, Oak Crest Estates; "THENCE north along the west line of Lot 22-R, Block 4, Oak Crest Estates to its northwest corner; "THENCE west along the south line of Lot 5, Block 4, Oak Crest Estates, to its southwest corner; -3- "THENCE north along the west line of Lot 5, Block 4, Oak Crest Estates, and along said line produced north to and along the west line of Lot 5-R, Block 1 , Oak Crest Estates to the northwest corner of Lot 5-R, Block 1, Oak Crest Estates .. .;" THENCE, west along and with the north line of Lot 6-R, Block 1 , Oak Crest Estates to a point for corner fifty feet (50) east from the 1959 city limit lines of the City of Fort Worth and the City of Euless; THENCE, north along a line parallel to and fifty (50) feet east from the 1959 city limit lines of the City of Fort Worth and the City of Euless to a point for corner at its intersection with a line parallel to and fifty (50) feet south from the south right-of-way line of State Highway No. 183; THENCE, east along the line parallel to and fifty (50) feet south from the south right-of-way line of State Highway No. 183 to the place of beginning and containing approximately 0.485 square miles. SECTION II THAT the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION III THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in conflict herewith this ordinance shall be and is hereby made cumulative. SECTION IV THAT it is hereby declared tb be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such unconstitu- tionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. Nature of Existing Development Much of the undeveloped land in this area is used for low-intensity agricultural purposes. The prevailing current development is residential, including part of .one subdivision (Oak Crest Estates) and all of another, Huntington Place. Dwellings include some apartments on the north side of Alexander Street, in addition to 125 single-family residences. Water, Sanitary Sewer Service The Water Department has no objection to annexing the proposed area: It notes that part of the area is now served by Euless. All future utility planning has anticipated that this area would eventually be part of the City of Fort Worth. Waste Disposal, Fire and Police Services Public Works has no objection to annexing the proposed area, indicating that the area adjacent to the south is presently being served by Fort Worth; and that to serve the proposed area would require at least an additional three hours per service day. Public Safety favors the annexation. Fire protection would be extended from Station 27 at 1100 Wright Richardson Road. This area is already within the radius of an established police beat and protection is readily available. Need for Annexation This area is within Fort Worth's extra-territorial jurisdiction; its annexa- tion would fit within this calendar year's annexation limits. This area was earlier annexed and then disannexed, with the exception of a corridor on the west and north sides, in order to stay within the statutory annexa- tion limitations for calendar year 1963. The Preliminary Plan for the 1980 Urban Area (1964) proposed a residential character for this area. In order to prevent the undesirable future use of presently undeveloped land and to protect the existing residential improvements , well- reasoned zoning principles should be applied immediately which are possible only through annexation. Texas Electric Service Company intends to remove the street lights from this area unless the future electricity fee is assumed by the City. These lights are a significant improvement to the area and the citizens do not wish to lose them. Recommendation It is recommended that the City Council adopt a resolution setting October 27, 1969, at 9:30 a.m, as the time for public hearing on the contemplated annexation and authorizing and directing the City Secretary to publish the required notices.
