HomeMy WebLinkAbout2004/09/07-Minutes-City Council-Executive Session SPECIAL CITY COUNCIL MEETING FORT WORTH, TEXAS SEPTEMBER 7, 2004 Date & Time On the 7t" day of September, A.D., 2004, the City Council of the City of Fort Worth, Texas, met in special session, at 3:20 p.m., with the following members and officers present: Attendance Mayor Mike Moncrief; Mayor Pro tempore Ralph McCloud; Council Members Jim Lane, Chuck Silcox, Becky Haskin, Donavan Wheatfall, Clyde Picht, John Stevenson and Wendy Davis; Interim City Manager Charles Boswell; Deputy City Attorney Marsha Wise and City Secretary Marty Hendrix. With more than a quorum present, the following business was transacted: Executive Session It was the consensus of the City Council that the City Council meet in closed session at 4:35 p.m. to: 1. Seek the advice of its attorneys concerning the following pending or contemplated litigation or other matters that are exempt from public disclosure under Article X, Section 9 of the Texas State Bar Rules, and as authorized by Section 551.071 of the Texas Government Code: a) David A. Miller, Jay H. Mathew, and Robert D. Matkin, Jr., v. City of Fort Worth, Civil Action No. 4:04-CV-622-Y; b) Jack Secrest v. Wal-Mart Stores, Inc. and Yataska Jefferson, Cause Number 153- 200623-03; c) City of Fort Worth v. Courtney ("Lottie") Dukes, et al., Cause 236-206507-04; d) Legal issues concerning variance and special exception procedures for the Board of Adjustment under Section 4-4 of the City Code; e) Legal issues concerning regulation of sexually oriented businesses; f) Legal issues concerning Waste Management of Texas, Inc. property at the 3700 block of Linkcrest Drive; g) Legal issues concerning any item listed on today's City Council meeting agendas; and CITY COUNCIL SPECIAL MEETING FORT WORTH, TEXAS SEPTEMBER 7, 2004 PAGE 2of2 2. Deliberate the purchase, exchange, lease or value of real property in accordance with Section 551.072 of the Texas Government Code. Deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third party; and 3. Deliberate economic development negotiations as authorized by Section 551.087 of the Texas Government Code; and 4. Deliberate the deployment, or specific occasions for implementation, of security personnel or devices, in accordance with Section 551.076 of the Texas Government Code. Recessed Mayor Moncrief recessed the special meeting of the Fort Worth City Council at 5:40 p.m. Reconvened It was the consensus of the City Council that the City Council reconvene in closed session at 5:50 p.m. to continue discussion on legal issues concerning variance procedures under Section 4-4 of the City Code.
