HomeMy WebLinkAboutContract 53015 CSC No.53015 October 21,2019 MEMORANDUM OF AGREEMENT City of Fort Worth Grant Period 2019-2020 United Way of Tarrant County(UWTC) and the City of Fort Worth (Grantee) enter into this Memorandum of Agreement for the community investment period beginning July 1, 2019 through June 30, 2020. Both the Grantee and UWTC are committed to improving the quality of life within the region. Both agree that by joining together as partners in a voluntary, community-wide effort, resources can be mobilized to deliver efficient and effective human service programs related to current community needs as outlined by the UWTC 2019 Community Assessment. The following provisions must be reviewed and agreed to by the Grantee Chief Executive Officer in order to maintain the relationship with UWTC. 1. Legal Requirements: A. Refuse to engage in or tolerate any form of discrimination or harassment. B. Comply with all requirements of any applicable federal, state and local laws, ordinances and regulations in connection with its performance of services and obligations under this agreement. C. Conduct annual single audit and provide copy to UWTC. 2. To achieve the objectives, both parties agree to: A. Recognize the need for full accountability to the donors contributing to UWTC. B. Continuously conduct a public relations effort to promote understanding of community issues and support for UWTC funded programs and initiatives. C. Comply with relevant policies and procedures adopted by the UWTC Board of Directors. 3. UWTC agrees to: A. Pay Grantee up to$135,637 through the investment period to be used for programming as detailed in the VITA MOU. B. Make payments on a monthly basis during the investment period excepting that if the Grantee does not comply with any issued contingencies and/or all of the requirements outlined in the Community Investment Policies and Procedures Manual located on the UWTC's website. Noncompliance may affect future funding. C. Direct resources to ensure the effective delivery of needed services to maximize impact in the community. 4. Operate the program(s)and maintain financial record keeping in accordance with sound business practice for the specified term, which includes using the funds for the purpose outlined in the accompanying MOU. B. Develop full accountability for its operations and comply with all reports and requests for information, including client, budgetary, operational and program information in a timely manner. C. Submit program and/or beneficiary reports according to the schedule agreed upon with VITA Coordinator Pennie Clayton. D. Comply with any request for programmatic and operational site visits by grantor. E. Acknowledge UWTC's capability to adjust the Grantee's total annual investment at any time if UWTC cannot maintain the initial investment amount due to unexpected or significant decreases in UWTC's revenues or reserves. Grantee will be notified at least 30 days in advance of the adjustment to the annual investment. F. Must clearly identify itself to community, clients and stakeholders as a recipient of UWTC funding on the organization property, offices, stationery, publications, social media and all other communications, and through positive cooperation during the annual campaign. G. Keep UWTC well-informed and seek permission for any major change, Including expansion of a funded program, substitution or deletion in a funded program or the services it provides,including, but not limited to, program service changes, location changes, level of services, hours of operations, and client accessibility. Failing to comply will result in changes both immediate and otherwise to funding. Capital changes should be reported at the earliest convenience. UWTC reserves the right to withhold program funding as outlined above. This Memorandum of Agreement is entered into for the 2019-20 investment cycle. Under this MOU, UWTC and CFW agree to work collaboratively from July 1, 2019 through June 30, 2020 to ensure free tax services are offered to T arrant County tow wage earners and to follow all of the rules and requirements of the second year of the IRS Grant 19VITA0239 awarded October 1, 2018. United Way agrees to: • Provide financial support to CFW's 8 VITA sites for 2019-2020. • Provide guidance/technical support and monitoring of compliance with Quality Site Requirements for CFW VITA staff. • Provide required oversight of the VITA program and ensure VITA grant requirements are met, including adherence to Quality Site Requirements. • Meet with the Interim Director Neighborhood Services as needed. • Take the lead in the recruitment and training of all volunteers. • Provide background checks for all volunteers. • Market the VITA program throughout Tarrant County. • Share results of the VITA program with the Tarrant County community. • Coordinate with the IRS and CFW to ensure a seamless effective VITA system. • Ensure that all of the IRS VITA requirements are met and monitor compliance of all IRS grant requirements. • Review quarterly financial reports for all VITA funding including the IRS grant funds. UNITED WAY OF TARRANT COUNTY LIVE UNITED 1500 N.Main St.,Suite 200,Fort Worth,TX 76164 City of Fort Worth agrees to: • Operate 8 VITA sites in accordance with the IRS and UWTC. • Operate 1 mobile VITA unit to provide additional Tarrant County access to service. • Prepare and file a total of at least 4,152 tax returns at their 8 VITA sites (9, including mobile). • Assist in recruiting volunteers and participants for the VITA partnership. • Make Site Coordinator training mandatory. • Give designated UWTC staff administrative access in TaxSlayer software to all sites. • Forward TaxSlayer reports in PDF format to UWTC on Friday of each week. • Continue timely submission of quarterly reports. • Communicate violations to Quality Site Requirements to UWTC and the IRS within 24 hours of being made aware. • Ensure that all outreach and marketing materials are co-branded by CFW with UWTC logo. • Participate in all VITA partnership meetings and meetings of UWTC volunteers as needed. • Supply necessary IRS VITA grant information in a timely manner. • Permit UWTC to audit staff timecards of staff used as match funding to meet the IRS grant requirements if necessary. • Adhere to all IRS grant requirements for the operation of the 8 VITA sites and mobile site. • Send Quality Site Requirement written guidelines for oversight to UWTC and the IRS and update both entities regarding any changes as they occur(within two weeks of the change). Duration of Agreement This MOU may be modified, altered, revised, extended or renewed by mutual written consent of both parties, by the issuance of a written amendment, signed and dated by both parties. This MOU will be executed upon signature of both parties and will apply for the period of July 1, 2019 to June 30, 2020. DISCUSSION: The United Way of Tarrant County has funds available for agencies to implement the Asset Development and Income Support Initiative for Fiscal Year 2019-2020. The outcome of this initiative is to positively impact the financial stability of Tarrant County working families. One method to accomplish this is by assisting unduplicated low-income families through the Volunteer Income Tax Assistance (VITA) program. In 2001, VITA became a community based program that provides tax return preparation, outreach products and financial education. The goal is to deliver a program and teach people how to invest their refunds in an advantageous manner to assist them with becoming self-sufficient. During the 2018-2019 Fiscal Year, the Neighborhood Services Department administered the program through the Community Action Partners at 8 sites throughout Tarrant County. If the funds are awarded, the Neighborhood Services Department will administer the program in 2019-2020. As of April 15, 2019, 4,661 tax returns were completed for an overall refund amount of$8,491,067 of which $2,404,429 was Earned Income Credit dollars from 1,223 clients. The number of clients choosing to purchase savings bonds was 14 and 10 clients decided to split their refund by placing a portion in a savings account. The impact to Tarrant County's economy is $9,889,367 in refunds and money saved. The goal for Fiscal Year 2019-2020 is to assist up to 4,000 unduplicated low-income workers file their tax returns through a VITA site and to file for approximately $3.0 million in Earned Income Tax Credits (EITC). EITC can supplement the income for families while they work to advance their earnings. A 10 percent match is required for this grant and will be provided by allcacating a portion of assigned Staff time valued in the amount up to$25,000.00 that is billed to and paid out of previously appropriated general fund money. The total amount of this grant, when factoring in the in-kind match, is up to $275,000.00. The grant does not allow for indirect costs to be charged. As a result, all funding will be applied to direct services to operate the program. This program serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recorrimendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Operating Other Fund. This is an advance grant.
