USE; OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, CITY SECRETARY
INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, FT. WORTH. TEX.
NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER
STURCTURF.S, THE, SIZE OF YARDS AND OTHER OPEN SPACES,
OFF-STREET PARKING, AND LOADING AND THE DENSITY OF
POPULATIONp AND FOR SAID PURPOSES TO DIVIDE THE
MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE,
AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE
USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID
DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS
CONTAINED IN SAID ORDINANCE NO, 3011; PRESCRIBING A
SAVINGS CLAUSE, PROVIDING A FINE. OF NOT LESS THAN
$5.00 NOR MORE THAN $200.00 FOR F,ACH OFFENSE, AND
THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST
SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN
EFFECTIVE DATE.,.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Ordinance No. 3011 be and is hereby amended by adding Section 8-A
which provides for a new district to be known as the 'IF-P" Planned Commercial
District immediately preceding the present Section 9 "E" Commercial District,
to read as follows:
SECTION 8-A "E--P" Planned commercial District
USE REGULATIONS: In The "E-P" Planned Commercial District, no building
or land shall be used and no buildings shall be hereafter erected, reconstructed,
altered or enlarged unless otherwise provided in this Ordinance except for one or
more of the following uses:
1. Any uses permitted in the "E-R" Restricted Commercial District;
except that dwellings are prohibited.
2. Banks,
3. Bird stores and pet shops.
4. Cigar or tobacco stores.
S. Confectionery stores.
6. Delicatessen shops.
7. Department Stores,
8. Drug stores.
9. Dry goods and notions stores.
10. Filling stations.
11. Florist or gift shops.
12. llardware, paint and wall paper stores.
13. Household furniture stores limited to the sale of new merchandise.
14. Jewelry stores.
15. Liquor or package stores.
16. Offices,
17. Piano stores, musical instruments and supplies,
18. Radio and television sales and servicing.
19. Restaurants, tea rooms, cafeterias or cafes.
20. Tailor, clothing or wearing apparel shops.
21. Variety stores.
HEIGHT AND ARFA REGULATIONS.
HEIGHT: The maximum permitted height in the "F-P" Planned Commercial District
shall be four (4) stories but not to exceed 45 feet.
YARDS: There shall be a yard of not less than 25 feet between any street or
alley or property line of adjacent property in separate ownership, and the main
wall of the building.
LOT AREA,, An "F-P" Planned Commercial District small have a minimum land aron
of not less than 120,000 square feet, which shall be under unified control,
OFF STREET PARKING: Paved parking and maneuvering areas for motor passenger
vehicles shall be furnished on the site in a ratio of not less than four souare
feet of parking and maneuvering area for each 1 souare foot of gross floor area.
APPROVAL OF PLANS: A permit for construction, reconstruction, additions to,
change of size or layout, or change of height of buildings on an "F-P" District,
under unified control, shall not be issued unless and until a complete site r+lan
showing that the layout shall conform to the above requirements has been subilitte-d
to the City Traffic Engineer, the City Plan Commission, recommended to the City
Zoning Commission, and further recommended by the City Zoning Commission to the
City Council.
In the event of failure to construct the installation in accordance with
plans submitted, within a period not to exceed three years from the date of final
approval by the City Council, the City Zoning Commission shall set a public hear-
ing, and after such public hearing may recommend to the City Council that the said
District "F.-P" be reclassified to a more restricted district to be specified by
the Zoning Commission.
SECTION 2.
The zoning regulations and districts, as herein established, have been made in
accordance with a comprehensive plan for the purpose of promoting health, safety,
morals and the general welfare of the community. They have been designed to lessen
congestion in the streets; to secure safety from fire, panic, flood and other dangers;
to provide adequate light and air; to prevent overcrowding of land; to avoid undue
concentration of population; to facilitate the adequate provision of transportation,
water, sewerage, parks and other public requirements. They have been made after a
full and complete public hearing with reasonable consideration, among other things,
of the character of the district and its peculiar suitability for the particular uses
and with a view of conserving the value of buildings and encouraging the most appro-
priate use of land throughout the community.
SECTION 3.
This ordinance shall be cumulative of all other ordinances of the City of
Fort Worth affecting zoning and shall not repeal any of the provisions of said
ordinance except in those instances where provisions of those ordinances are in
direct conflict with the provisions of this ordinance.
SECTION 4.
Should any section, clause or provision of this ordinance be declared by the
Court to be invalid, the same shall not affect the validity of the ordinance as a
whole or any part thereof, other than the part so declared to be invalid.
SECTION S.
Any person, firm or corporation who violates, disobeys, omits, neglects, or
refuses to comply with or who resists the enforcement of any of the provisions
of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00)
nor more than Two Hundred and No/100 ($200.00) for each offense. Each day that
a violation is permitted to exist shall constitute a separate offense.
SECTION 6.
This Ordinance will take effect and be in full force and effect from and
after its passage and publication as required by law.
