G�fA�1- ��w , AMENDMENT NO.2 `� �STATE OF TEXAS § CITY SECRETARY CONTRACT NO C) \l� &C Needed) �� COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Dannenbaum Engineering Corporation (Engineer) made and entered into City Secretary Contract No. 28006 (the Contract) which was authorized by the City Council by M&C C-19172 on July 30t', 2002; and subsequently revised by one previous Amendment No. 1 for $111,800.50 on January 20,2004(M&C C- 19936); and WHEREAS,the Contract involves engineering services for the following project: Engineering Contract for Sanitary Sewer Main 257 and 325 (Middle and Upper Village Creek)Parallel Relief Alignment and Design WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 26, 2007, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total$329,406.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$1,163,106.28. 3. No. 365.0 Dear Mr. Sahu: This letter is to provide information regarding the change in scope on the Water Department work on the above referenced project revised per David Cooper's comments. In the original contract, the City authorized and approved budget for the design of a portion of Main 257. That budget will be applied to the design of Main 325 along with the amount of this supplemental agreement. Since portions of the budget have already been approved, the following paperwork is different than usual. The City has requested that Dannenbaum Engineering add the detailed design of Main 325 to the original contract and deduct the design of a portion of Main 257, which was included in the original project budget. Also, changes in the alignment which deviated from the approved alignment study were made after portions of the field survey were completed. Those changes will require additional field survey. In order to prepare this supplemental budget, I prepared and attached three(3) items. They are: 1) The proposed Supplemental Agreement No.2 Attachment"B"; 2) The Exhibit B-3A from the original contract with the Part 2 (Outfall Design) items included; and 3) An Exhibit B-3A for the complete Main 325 design as if this were a new project. In order to arrive at the amounts for the proposed Supplemental Agreement No. 2, 1 simply took the difference between the complete Main 325 design amounts and the amounts authorized under the original agreement for the design of a portion of Main 257. Compensation A. The ENGINEER shall be compensated total lump sum.fees as summarized in Exhibit `B-3' and as follows_ Payment of the total lump sum fees shall be considered full compensation for the services described in Attachment`A' and Exhibit`GA-2"for labor materials,supplies and equipment necessary to complete the project. Method of Payment Partial payment shall be made to the Engineer monthly upon City's approval of an invoice from the Engineer outlining the estimated current percent complete of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Until satisfactory completion of Exhibit A-2, Part B, Section 1,hereunder, a sum not to exceed 30 percent of the respective total lump sum fee for each scope of services. Until satisfactory completion of Exhibit A-2, Part B, Section 2j, hereunder, a sum not to exceed 70 percent of the respective total lump sum fee for each scope of services, less previous payments. Authorize the City Manager to execute Amendment No. 2 to City Secretary Contract No. 28006 with Dannenbaum Engineering Corporation for Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment and Design; 2. Authorize the transfer of $329,406, for the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the Amount of$329,406 from available funds. DISCUSSION: On July 30, 2002, (M&C C-19172) the City Council authorized the City Manager to execute an engineering agreement with Dannenbaum Engineering Corporation in the amount of$721,899.76, to prepare plans and specifications for Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. The City Council approved amendment No. 1 for $111,800.50, (M&C C-19936) on January 20, 2004, for additional engineering services for approximately 3,000 linear foot extension of Sanitary Sewer Main 257 alignment study and design of Sanitary sewer laterals 2389, 2484, 3694, Main 238 and Lateral 9920. This proposed amendment will allow Dannenbaum Engineering Corporation to provide additional engineering services for approximately 23,076 linear feet of 42-inch Sanitary Sewer Main 325, 47 manholes, five junction boxes, concrete pavement repairs and other pertinent items. This amendment also includes special services for geotechnical studies, easement documents preparations, plans for Storm Water Pollution Prevention, Traffic Control Plans, Engineering Feasibility Report and coordination with railroad companies, TX DOT and local utilities companies. Dannenbaum will also provide limited assistance during construction services and prepare As-Built drawings. Dannenbaum Engineering Corporation proposes to provide these additional services for a lump sum fee of $329,406. This fee includes credits for the design of Sanitary Sewer Main 257 included in the original contract. The Water Department decided to remove this portion of design work from the contract.
