AN ORDINANCE PERMITTING S. K. KUYKENDALL ET UX, GENEVIM CITY SECRETARY
� �BUILDING FOR A MAXIMUM DISTANCE IOF 0:5 FEET AS IT IS NOW
EXISTING FT. WORTH, TEX.
LOCATED IN JOYCE DRIVE BEING A PART OF BLACK 3, HIGHLAND
HOMES ADDITION TO THE CITY OF FORT WORTH, TARRANT COMM,
TEXAS, AND DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BE-
GINNING AT THE SOUTHEAST CORNER OF SAID BLOCK 3; THENCE
NORTH 193.5 FEET TO A POINT IN THE SOUTH LINE OF THE WID-
ENED U. S. HIGHWAY #80; THENCE NORTH 82 DEGREES 41 MINUTES
WEST ALONG THE SOUTH LINE OF SAID HIGHWAY 75 FEET; THENCE
SOUTH 193.5 FEET TO A POINT IN THE NORTH LINE OF CHAPEL
AVENUE, SAID POINT ALSO BEING IN THE SOUTH LINE OF BLACK 3;
THENCE SOUTH 82 DEGREES 41 MINUTES EAST ALONG THE SOUTH
LINE OF SAID BLACK 3 A DISTANCE OF 75 FEET TO THE PLACE OF
BEGINNING; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE IMMEDIATELY.
WHEREAS, S. K. Kuykendall et ux, Genevieve Kuykendall, are the
owners of part of Block 3, Highland Homes Addition to the City of Fort
Worth, Tarrant County, Texas, and described by metes and bounds as fol-
lows:
BEGINNING at the southeast corner of said Block 3;
THENCE north 193.5 feet to a point in the south line of
the widened U. S. Highway W;
THENCE north 82 degrees 41 minutes west along the south
line of said highway 75 feet;
THENCE south 193.5 feet to a point in the north line of
Chapel Avenue, said point also being in the south line
of Block 3;
THENCE south 82 degrees 41 minutes east along the south
line of said Block 3 a distance of 75 feet to the place
of beginning;
along the east line of which a property encroachment exists in Joyce Drive;
NOW, FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That S. K. Kuykendall et ux, Genevieve Kuykendall, the owners of said
land above described and the improvements situated thereon, and their
heirs and assigns, be permitted to leave the existing building for a maxi-
mum distance of 0..5 feet as said building now exists in Joyce Drive along '
the east line of said Block 3; and that said improvements pn said above
described real property be allowed to stand during the life of said build-
ing as the same is now constructed, provided, however, that in the event
such building be demolished or major alterations and repairs be made to

said building in the future, said building shall be reconstructed or
-repaired so as not to encroach upon Joyce Drive and so as to be in com-
pliance with the then existing ordinances, rules and regulations of the
City of Fort Worth, Texas. It is not the intention of the City Council
to adversely affect or diminish the rights of the public in and to the
property encroached upon by the existing building in the event the City
Council may determine to widen Joyce Drive.
SECTION 2.
That this ordinance shall take effect and be in full force and effect
from and after the date of its passage, and it is so ordained.

Members of the City Council Re: Encroachment on Joyce
City of Fort Worth Drive, Block 3, Highland
Homes Addition
Mrs. McKnight and Gentlemen:
The owner of the existing one-story brick motel building at the southwest
corner of Weatherford Highway (U. S. Highway 80) and Joyce Drive has
requested that the City authorize an existing .5 foot encroachment of the
building into the right-of-way of Joyce Drive for the remaining life of
the building. The Public Works Department has investigated this request
and found that the building encroachment does not conflict with the present
improvgments on Joyce Drive, but that a concrete block wall has been built
11 .7 feet into Joyce Drive and a concrete apron around a swimming pool
has been constructed 1.7 feet into Joyce Drive. The wall and concrete
apron can be ordered removed from the right-of-way at any time the City
so desires.
It is recommended that an ordinance be adopted granting a .5 foot encroach
meet of the existing one-story brick motel building located on part of
Block 3, Highland Homes Addition, for the remaining life of the building,
with the provision that it is not the intention of the City Council to
adversely affect or diminish the rights of the public in and to the pro-
perty encroached upon by the existing building in the event it is decided
to widen Joyce Drive in the future. Granting the .5 foot encroachment of
the building does not alter the fact that the owner of the_mo±e1 can—ba
required to remove the concrete block wall and the concrete apron encroach-
ments at any time.
