AN ORDINANCE PROVIDING THAT NOTICE BE GIVEN TO THE gJALTFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, THAT THE CITY COUNCIL WILL, AFTER THE EXPIRATION OF TWENTY (20) DAYS FROM THE FIRST DATE THAT THIS NOTICE IS PUBLISHED IN SOME NEWSPAPER PUBLISHED IN SAID CITY, ADOPT AN ORDINANCE, IN COMPLIANCE WITH THE PROVI- SIONS OF ARTICLES 1166, 1170 AND 1171 OF VERNON'S CIVIL STATUTES OF THE STATE AND OTHER APPLICABLE LAWS, ORDERING A SPECIAL HOME- RULE ELECTION IN SAID CITY FOR THE PURPOSE OF SUBMITTING A CER- TAIN PROPOSED AMENDMENT TO THE CHARTER OF SAID CITY PROVIDING FOR THE ESTABLISHMENT AND OPERATION OF A PARK AND RECREATION BOARD CONSISTING OF NINE (9) MEMBERS, TO BE KNOWN AS THE "PARK AND RECREATION BOARD OF THE CITY OF FORT WORTH," IN LIEU OF THE PRESENT PARK BOARD AND RECREATION BOARD HERETOFORE PRO- VIDED FOR IN CHAPTERS XVIII AND XIX, RESPECTIVELY, OF THE CHARTER OF SAID CITY WHICH CHAPTERS SHALL BE REPEALED, SAVE AND EXCEPT SECTIONS 4 THEREOF; PROVIDING THAT THE JURISDIC- TION, POWERS AND DUTIES HERETOFORE CONFERRED OR IMPOSED UPON SAID BOARDS BY THE PROVISIONS OF SECTIONS 4 OF SAID CHAPTERS SHALL BE VESTED IN AND ASSUMED AND PERFORMED BY THE PARK AND RECREATION BOARD AUTHORIZED TO BE ESTABLISHED; AND PROVIDING THAT THE CITY COUNCIL, WHEN LEVYING THE TAXES FOR EACH FISCAL YEAR, SHALL LEVY AN ANNUAL AD VALOREM TAX OF NOT LESS THAN ELEVEN CENTS (Ili) ON EACH ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VALUE OF ALL REAL AND PERSONAL PROPERTY IN THE CITY NOT EXEMPT FROM TAXATION BY THE CONSTITUTION AND LAWS OF THE STATE FOR THE USE AND BENEFIT OF THE PARK AND RECREATION BOARD; AND PROVIDING FOR THE SUBMISSION OF SUCH OTHER AND ADDITIONAL AMENDMENTS AS MAY BE DEEMED APPROPRIATE AND NECESSARY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in accordance with the provisions of Articles 1166, 1170 and U71 of Vernon's Civil Statutes of Texas and other applicable laws, the following notice be given to the qualified voters of the City of Fort Worth, Texas: TO THE LEGALLY QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEKAS, AND TO ALL OTHER PERSONS WHOM THESE PRESENTS MAY CONCERN: Notice is hereby given that after the expiration of twenty (20) days from the first date that this notice is published in some newspaper of said City, it is the inten- tion of the City Council to pass an ordinance containing a certain proposed amendment to the Charter of the City of Fort Worth, Texas, which amendment is to be submitted at a special home-rule election in accordance with the provisions of Articles 1166, 1170 and 1171 of Vernon's Civil Statutes of Texas and other applicable laws. SECTION 2. That at such special home-rule election there shall be submitted the said proposed amendment to be contained in the ordinance for adoption or rejection by the qualified voters in said City. SECTION 3. That the proposed amendment which will be considered by the said City Council to be incorporated in said ordinance submitting the same is described as follows: Shall the Charter of the City of Fort Worth be amended by adding to Chapter XXVIII thereof a new section to read as follows: Section 42. Within thirty (30) days after the adoption of this amendment, the City Council of the City of Fort Worth shall provide by ordinance for the establishment and opera- tion of a park and recreation board consisting of nine (9) members, to be known as the "Park and Recreation Board of the City of Fort Worth," in lieu of the present Park Board and Recreation Board heretofore provided for in Chapters XVIII and XIX, respectively, of the Charter of said City, which chap- ters are hereby repealed, save and except Sections 4 thereof. The ,jurisdiction, powers and duties heretofore conferred or im- posed upon said Boards by the provisions of Sections 4 of said chapters shall be vested in and assumed and performed by the Park and Recreation Board hereby authorized to be established. The City Council, when levying the taxes for each fiscal year, shall levy an annual ad valorem tax of not less than eleven cents (14) on each one hundred dollars ($100.00) of assessed value of all real and personal property in the City not exempt from taxation by the Constitution and laws of the State for the use and benefit of the Park and Recreation Board. In addition thereto, said Park and Recreation Board shall be allowed all the receipts and revenues arising from the operation of the various park and recreation grounds and facilities with- in the ,jurisdiction of the Park and Recreation Board and what- ever further amount, if any, the City Council may, in its dis- cretion, set apart in the annual budget for the use and benefit of the Park and Recreation Board. All debts and liabilities heretofore created by the previous Park Board and the previous Recreation Board operat- ing under the provisions of Chapters XVIII and XIX of the Charter shall be assumed by the Park and Recreation Board here- in authorized to be established by ordinance, and the funds accruing to said Park and Recreation Board from the sources hereinbefore specified, or so much thereof as may be necessary, shall be used in the payment and discharge of the said debts and liabilities.? SECTION 4. That such other and additional proposed amendments will be considered and submitted as to the City Council may be deemed appropriate. SECTION 5. That the City Secretary is directed to publish this notice for ten (10) days in a newspaper published in the City of Fort Worth, in accordance frith the provisions of Article 1171 of Vernon's Civil Statutes of Texas, the Charter of the City of Fort Worth and all other applicable laws.
