ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EIGHTH AVENUE AND PORTIONS OF SUNDRY OTHER STREETS, AVE'NMS AND PUBLIC PLACES IN THE CITY OF FORT WaRTH, TEXAS; IZCLARING THE CONTRACT WITH GENERAL CCIISTRUCTICN CO. FOR THE CONSTRUCTION OF SAID IMPROV. 12NTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EREOUTION AND DELIVERY OF CERTIFICATE'S IN EVIDENCE OF SPECIAL• ASSESS— MENTS LEVIM AFTER GIVING EFFECT TO SUNDRY CREDITS HE]?EIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSM'1'EVS; DIRECTING THE CITY SECRTTARY TO ENGROSS AND EXROLL THIS OFDI`.?ANCE BY COPYING THE CAP— TION OF SAME IN THE MINUTE HOOK OF THE CITY COUNCIL OF FORT WCRTH, TEAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AND EFF.PCTIVE DATE. IfT MEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with GENERAL CONSTRUCTION CO. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to—wit: 1. Eighth Avenue: From �)reva Street to Pafford Street, kno::n and designates as Unit No. 1. 2. Page Street: From South b1ain Street to the pest line of the Te>cas and Ne%;i Orleans P,.i.. 2. C. kno,,rn and designated as Unit No. 2. 3. St. Louis Avenue: From Ber:ick Street to ShaLv Street, known and designated as Unit No. 4. 4. Stuart Drive: From Dickson Street to atler Street, knoi,m and designated as Unit No. 5. 5. Beverly Avenue; Fro,.-. I.Iulke; Street to , arion ;;tree,, knoLjn and designa-';.ed as Unit Pto. 7. 6. Mulkey Street: From Beverly Street to the lNest line of Lot 26 Dlock 10, Ryan Southeast Addition, knoti-m and designated as Unit No. 8. 7. Lolt Street: From Hemohil Street to the lest line of Travis Avenue, kno,,�n an6 designated as Unit No. 9. WHMUS, by sundry proceedings heretofore passed by the City Council of the City of Port Worth, Texas, including Ordinance No. 4710 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHM.�AS, the City Council of the City of Port Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4710 , and 'ArMAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEH.:FORE, RE IT ORIkI'T_",D BY TIE CITY COUNCIL OF TH3 CITY OF FORT WORTH, Tv.XAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: IIt. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as _part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort ;North, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. r PASSED.
