ORDINANCE NO. 6 1 9 6
AN ORDINANCE AMENDING CHAPTER 16 OF THE FORT WORTH
CITY CODE (1964) AS HERETOFORE AMENDED, WHICH CHAP-
TER REGULATES THE COLLECTION OF HOUSEHOLD GARBAGE
AND REFUSE AND THE PAYMENT OF FEES THEREFOR, BY RE-
DUCING CERTAIN FEES AND INCREASING OTHERS; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; RE-
PEALING ALL ORDINANCES AND PROVISIONS OF THE FORT
WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A .PENALTY; AND PRO-
VIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS :
SECTION 1.
That Section 16-8 of the Fort Worth City Code (1964)
as heretofore amended is hereby amended, and, after having
been so amended, same shall hereafter be and read as follows:
"Sec. 16-8. Same -- Placing for collection.
The waste disposal superintendent shall
have the authority to designate the location
of such containers, taking into consideration,
among other things, the customer's option,
convenience to collection crews, convenience
to the customer, hazardous conditions such as
electrical wiring, danger of the collector be-
ing bitten by household pets, etc."
SECTION 2.
That Section 16-10 of the Fort Worth City Code (1964)
as heretofore amended is hereby amended, and, after having
been so amended, same shall hereafter be and read as follows:
"Sec. 16-10. Charges for refuse removal
service -- Compulsory for
single-family residences and
duplexes; optional for group
housing.
Use of City garbage and refuse collection
and brush removal service and payment of the
fees set out below for such service shall be
mandatory for single-family residences, each
unit of duplex apartment buildings, garage
apartments and mobile homes or trailer- occu-
pied as dwelling units. The monthly fees for
household garbage and refuse collection-and
brush removal service shall be as follows:

The use of City garbage and refuse col-
lection and brush removal shall be optional
for residential buildings or complexes which
include three or more dwelling units.
Curb/alley line service. Each customer
shall place household garbage and refuse at
a point adjacent to his alley, but if there
is no alley adjacent to his premises, he shall
place such refuse at a point adjacent to the
front curb thereof.
Collector carry-out service. The City
collectors will remove household garbage and
refuse from a point adjacent to the customer's
dwelling place.
The individual customer may choose either
of the above options."
SECTION 3.
That this ordinance shall repeal every prior ordinance
and provision of the Fort Worth City Code in conflict here-

with, but only insofar as the portion of such prior ordi-
nance or provision shall be in conflict, and as to all
other ordinances or provisions of the Fort Worth City Code
not in direct conflict herewith, this ordinance shall be
and is hereby made cumulative.
SECTION 4.
That if any section, part of a section or provision
of any section of this ordinance shall be held to be void,
ineffective or unconstitutional by a court of competent
jurisdiction, the holding of such section, part of a sec-
tion or provision of any section to be void, ineffective or
unconstitutional for any cause whatsoever shall in no way
affect the validity of the remaining sections and provisions
of this ordinance, which shall remain in full force and ef-
fect. The City Council would not have passed any sections,
parts of sections or provisions of any section of this ordi-
nance that were unconstitutional, void or ineffective if it
had known that they were unconstitutional, void or ineffective
at the time of adopting this ordinance.
SECTION 5.
That the violation of any provision of this ordinance
or of the Fort Worth City Code relating to the disposal of
garbage and the payment of fees therefor shall be deemed an
offense and punishable by a fine not exceeding Two Hundred
Dollars ($200.00) , and each violation thereof and each day
there is a failure to comply with the terms of this ordinance

shall be and is hereby deemed to be a distinct and separate
offense and punishable as such.
SECTION 6.
That this ordinance shall be in full force and effect
from and after its passage and publication as required by
law.

On October 31, 1969, a Residential Refuse Collection proposal was submitted
to the City Council for review. Attached is a proposed amendment to the
City Code reflecting those changes recommended in the proposal.
The attached ordinance defines the proposed customer options and reflects
the new rate structure as recommended in the proposal.
Recommendation
It is recommended that the Residential Refuse Collection Proposal and the
attached ordinance be adopted by the City Council to become effective on
January 2, 19 70.
