HomeMy WebLinkAboutOrdinance 7996 ORDINANCE AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICT AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS", PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be and is hereby amended so that permitted uses in the hereinafter described area be altered, changed, and amended as follows: Z-79-86 Part of the I. Flores Survey, Abstract No. 507, situated about 10 miles south 10 degrees west from the courthouse in Tarrant County, Texas and embracing a portion of the 204-5/10 acres tract described in the deed to A. Keil.er Doss recorded in volume 2017, page 212 of the Tarrant County Deed Records. Commence at the northwest corner of said 204-5/10 acres tract in the north line of said Flores Survey and the south line of the E. Littlepage Survey, Abstract No. 971, and said northwest: tract corner being the northwest corner of the tract described in the deed to the City of Fort Worth recorded in Volume 6555, page 446 of the said Deed Records and then run south 89 degrees-34 minutes-15 seconds east, along the north line of said 204-5/10 acres tract and said City tract, 99-22/100 feet to a galvanized spike for the northeast corner of said City tract, then south no degrees-19 minutes-35 seconds west, along the northerly east line of said City tract, 33-15/100 feet to a 3/41' iron rod for its northerly southeast corner, then north 89 degrees-40 minutes-25 seconds west, along the northerly south line of said City tract, 95-02/100 feet to a galvanized spike, then south no degrees-22 minutes-16 seconds west, along the southerly east line of said City tract, 90-0211100 feet to a 3/4" iron rod for its southeast corner, then north 89 degrees-37 minutes-44 seconds west, along the south line of said City tract, 5-05/100 feel, to a 3/4" iron rod for its southwest corner in the west line of said 204-5/10 acres tract for the east line of County Road No. 1035, and then south no degrees-45 minutes west, along the said west line of 204-5/10 acres tract and said east line of county road, 376-76/100 feet to the southerly line of the existing line of City Limits of the City of Fort Worth as described in City of Fort Worth City Council Ordinance No. 7706 and being the northwest and beginning corner of the tract: line being described. Thence south no degrees-45 minutes west, continuing along the said west line of 204-5/10 acres tract and the east line of said continued -2- Road, 799-93/100 feet to a 7/8" iron rod for the southerly northwest corner of the cract described in the deed to Transconti Investment Corporation recorded in volume 6184, page 735 of said Deed Records. Thence south 89 degrees-34 1/2 minutes east, along the southerly north line of said Transconti tract, 501-5/10 feet to a 7/8" iron rod for a reentrant corner of said tract. Thence north no degrees-45 minutes east, along a westerly line of said Transconti tract, 799-89/100 feet to the said existing line of City Limits. Thence north 89 degrees-34 minutes-15 seconds west, along the said existing City Limit Line, 501-5/10 feet to the place of beginning and containing 9-211/1000 acres. That the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. SECTION 3. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations or Ordinance No. 3011 or of any amendments thereto of said City of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, the court shall have all of the powers which existed prior to the effective date of this ordinance. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or section of this ordinance, since the same would have been enacted by the City Council without ,he incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. continued ohCTION 6. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.00), nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 7. That this ordinance shall. become effective and be in full force and effect from and after the date of its passage and publications, as required by law, and i.t is so ordained.
