ORDINANCE NO. (CBqq AN ORDINANCE PROVIDING THAT TEN FEET OF RIGHT- OF-WAY ON THE EASTERLY AND WESTERLY SIDES OF WESTRIDGE AVENUE AND EXTENDING FROM THE 4500 THROUGH THE 5000 BLOCKS THEREOF, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVER- SION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described ten feet of right-of-way on the easterly and westerly sides of Westridge Avenue be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except that easements are reserved for any and all existing utilities: The easterly ten feet of right-of-way of Westridge Avenue, said ten feet being measured perpendicularly from and parallel to the easterly right-of-way line of said Westridge Avenue and abutting Lots 1, 78, 79, 69, 66, 67, 68, 49, 42 through 48, 31, and 30 in Block 51, Ridglea Addi- tion, and Lot B in Ridglea Park Addition. The westerly ten feet of right-of-way of Westridge Avenue, said ten feet being measured perpendicularly from and parallel to the westerly right-of-way line of said Westridge Avenue and abutting Lots 3, 4A, 4B, 5R, 6 and 7 in Block 52, Ridglea Addition. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said right-of-way is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Peterson, 4801 Westridge Avenue, on behalf of property owners in Blocks 51 and 52, Ridglea Addition, has requested that the City vacate 10 feet of right-of-way on each side of Westridge --�•, � Avenue as follows West Side of Street: From South line of Lot 7, Block 52, Ridglea Addition, north to a point 186 feet north of the south line of Lot 3, Block 52, Ridglea Addition. East Side of Street: From South line of Lot B, Ridglea Park north- ward to the north line of Lot 43, Block 51; and also, abutting Lots 49, 68, 67, 66, 69, 79, 78 and 1, Block 51, Ridglea Addition, as shown on the attached map. Subject right-of-way of Westridge Avenue acquired by dedication is 80 feet wide. The staff has determined that 60 foot right-of-way is sufficient; therefore, there is an extra 10 feet of right-of-way on each side. There are existing electric facilities located therein. The reviewing City departments and private utility companies have no objections to this request provided the vacated right-of-way is replatted with the adjoining property and retained as an easement for utilities. The City has received a satisfactory replat. The City Plan Commission has reviewed the request and recommends adoption of an ordinance vacating the public right-of-way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right- of-way as recommended by the City Plan Commission.
