AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011 ; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1- -A. That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-69-183 All platted lots, Blocks 1 thru 8, Western Trails Addition (Sandra Dr., Jennie Dr., Indio St., Fargo St. & Westcreek Dr.) Unzoned to "A" One-Family Z-69-186 Being a tract of land of approximately 20 acres out of the Hayes Covington Survey; BEGINNING at a point in the west right-of-way line of North Normandale at the northeast corner of Lot 6, Block 77, Section 7, Western Hills Addition; THENCE north and east approximately 1700 feet along a curve in the south right- of-way line in the proposed North Normandale Street to a point at the east right-of-way line in a north-south flowing drainage easement; THENCE southeasterly approximately 1400 feet along the east right-of-way line of said drainage easement to a point in the north right-of-way line of the Gulf Oil line easement; THENCE northeasterly approximately 460 feet along the north right-of-way line in said Gulf Oil Line easement to a point at the southwest corner of Lot 11, Block 80, Section 7, Western Hills Addition; THENCE north approximately 150 feet along the west lot line of said Lot 11 and continuing approximately 1000 feet in a north and easterly direction along the rear lot lines of Lots 1 through 4, Block 78, and Lots 1 thru 6, Block 77, Section 7, Western Hills Addition to the Point of Beginning. That Ordinance No. 3011 be amended so that the text shall be altered, changed and amended as follows to wit: M-68-9 THAT Item B, 3, Rear Yard, of SECTION 6 - "C" APARTMENT DISTRICT, which now reads: REAR YARD: Same as District "A"; be and the same is hereby amended, changed and modified so that it shall hereafter read as follows: REAR YARD: Same as District "C-R" THAT Item B, 3 Rear Yard of SECTION 7 - "D" APARTMENT DISTRICT, which now reads: REAR YARD: Same as District "A%be and the same is hereby amended, changed and modified so that it shall hereafter read as follows: PEAR YARD: Same as District "C-R" THAT Item A, 5, C, of SECTION 18 - MODIFICATIONS TO DISTRICT REGULATIONS; now reads: C) In Districts "A", "B", "C-R"' and I'D" an accessory building may occupy not more than forty percent (40%) of the rear yard and shall be one (1) story and shall not exceed eighteen (18) feet in height, and in Districts "A" and "B" the combined floor area of all accessory build- ings on a lot shall not exceed fifty percent (50%) of the ground floor area of the principal structure, exclusive of breezeways, porches and attached garages, providing, however, that this regulation shall not be so interpreted as to reduce the permitted combined area of all accessory buildings on one lot to less than six hundred (600) square feet. In the case of reversed frontage, no accessory building shall be erected closer than five (5) feet to the line of abutting lot to the rear. Detached accessory buildings located in the rear yard, or required rear yard of a corner lot shall be five (5) feet from the street line in Districts "A", "B", "'C-R", "C" and "'D". be and the same is hereby repealed and deleted. - 3 - ADD: M-68-9 Item A, 6, a), of SECTION 18 of Zoning Ordinance 3011 be and the same is hereby amended so that it shall hereafter read as follows: 6. a) R. Every part of a required yard shall be open from its lowest point to the sky unobstructed, except that 1) Ordinary sills, belt courses, cornices, buttresses and ornamental features may project not more than six (6) inches into a required yard, and 2) Eaves may project not more than thirty-six (36) inches into a required yard. - 4 - SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance ,with the comprehensive plan for the purpose of promoting health, safety, morals and the general %delfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. The adopted and published ordinance did not contain a reference to one existing paragraph which was to have been deleted. Two additional references relating to required rear yards in "C" and "D" Districts are necessary to extend the twenty-five (25) foot rear yard option through from the "C-R" District. The above references were inadvertently omitted from the ordinance although they were intended to be included by both the Zoning Commission and the City Council. Recommendation It is recommended that the City Council include the above proposed text changes in the regular zoning district ordinance to be considered at the Council meeting on November 17, 1969.
