AN ORDINANCE PROVIDING THAT CLOVIS ROAD FROM THE SOUTH LINE OF GUADALUPE ROAD SOUTH, A DIS- TANCE OF 139 FEET TO THE NORTH RIGHT OF WAY LINE OF A 50 FOOT DRAINAGE RIGHT OF WAY, AND GUADALUPE ROAD FROM A POINT 225 FEET WEST OF THE WEST RIGHT OF WAY LINE OF CLOVIS ROAD, WEST A DISTANCE OF 125 FEET TO THE EAST LINE OF A 50-FOOT DRAINAGE RIGHT OF WAY, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portions of streets be and the same are hereby closed, abandoned and permanently vacated as streets or public thoroughfares of any kind or character whatever: Clovis Road from the south line of Guadalupe Road south, a distance of 139 feet to the north right of way line of a 50-foot drainage right of way; and Guadalupe Road from a point 225 feet west of the west right of way line of Clovis Road, west a distance of 125 feet to the east line of a 50- foot drainage right of way. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said streets is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. E. Cloer, owner of all adjoining property, has requested the vacation of oW N public rights-of-way in Western Hills Addition, Section 4, as indicated on the attached map and as described below: 1) Clovis Road from the south line of Guadalupe Road south, a distance of 139 feet to the north right-of-way line of a 50 foot drainage right-of-way, and 2) Guadalupe Road from a point 225 feet west of the west right-of-way line of Clovis Road, west a distance of 125 feet to the east line of a 50 foot drainage right-of-way, with a cul-de-sac to be provided. It has been established that the above streets are not needed to serve the adjoining property and the abandonment will facilitate a better development of the adjoining property. City Departments and private utility companies have reviewed the request and have no objections to the vacations. The City Plan Commission has reviewed the request and recommends adoption of an ordinance that has been prepared vacating the public rights-of-way as re- quested, subject to the following conditions: 1) Show exact dimensions and bearings on plat, 2) Provide required drainage and utility easements, and 3) Require an agreement between the gas company and the developer relative to the retirement of the gas main in Guadalupe Road. The applicant has submitted a replat showing the exact dimensions and bearings and dedicating the necessary drainage and utility easements as requested by the Plan Commission. A letter has been received from Lone Star Gas Company confirm- ing an agreement between the gas company and the developer in regard to the re- tirement of the gas main in Guadalupe Road.
