AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES: OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That Ordinance No. 3011 be amended so that the following described uses in the hereinafter des- cribed areas be altered, changed and amended as follows to wit: Z-66-51 A portion of Tract i-A of the S. K. Smith Survey, Abst. No. 1417, in the City of Fort Worth, Tarrant County, Texas, the same being a 0.7636 acre tract of land, described by metes and bounds as follows: A portion of the S. K. Smith Survey, Abst. No. 417 and embracing a part of the 66.8 acre tract conveyed to F. W. Teichmann by the deed recorded in Volume 1637, Page 565 of the Tarrant County Deed Records. Beginning at a car axle at the Southeast corner of said Teichmann tract in the south line of said Smith Survey at its intersection with the west line of the right-of-way for Oakhurst Scenic Drive as said west line is defined in the agreement recorded in Vol. 1765, Page 396 of said Deed Records and being, by deed call, 473 feet west of the southeast corner of said Smith Survey. Thence west along, the south line of said tract and said Survey, 238.8 feet to an iron in a line for the east line of the right-of-way of the north-south freeway and being 175 feet easterly at right angles from its centerline and from said iron a highway right-of-way monument bears S7-44E 7/10 feet. Thence N7-44W, along said right-of-way line 207.8 feet to an iron in the south line of the right-of-way for east North Side Drive, also known as East 12th Street. Thence easterly along said right-of- way line, along a curve to the left with a radius of 1328.11 feet, a distance of 211.6 feet to an iron 1n said west line of Oakhurst Scenic Drive. Thence along said west line of Oakhurst Scenic Drive: S25-14E, 30.8 feet, to an iron; and S30-57E 113.3 feet to the place of beginning and containing 33,265 square feet (0.7363 of an acre). (1213 Oakhurst Scenic Drive at East Northside Drive) FROM "B" TO "F-R" Z-66-56 Tracts 3A, 3B, 36-I, 4, 7, 8, 9, 9A, and 10 (City Tax Records), David Odum Survey, Abst. No. 1184, further described as follows: Tract 9 (City Tax Records) of the David Odum Survey, Abstract No. 1184 embracing a northwest portion of the 420 acres tract conveyed to B. F. Ellington by the deed recorded in Volume W, Page 44 of the Tarrant Deed Records. Beginning at a galvanized iron for the northwest corner of said Ellington tract in the north line of said Odum Survey, being in the intersection of County Road No. 3048, known as Old Denton Road, with County Road No. 4001, and from which an iron at the northwest corner of fences stands 27.2 feet east and 25 feet south. THENCE south 89°52' east; along the north line of said tract and said survey line, 2411.8 feet to the iron at the northerly northwest corner of the tract for highway right-of-way conveyed to the State of Texas by the deed recorded in Volume 3839, Page 413 of said deed records. THENCE along the northwesterly line of said highway right-of-way as said line is marked by iron rods in place: South 0*03' east 631.5 feet to an iron rod at the beginning of a curve to the right with a radius of 2725.79 feet; and then along said curve to the right a distance of 900.4 feet to an iron rod; and south 18°541 west 309.8 feet to an iron rod at thebeginning of acurve to the right and with a radius of 1305.4 feet; and then along said curve to the right a distance of 1096feet to an iron rod; and then south 67°061 west 213.5 feet to an Iron rod at the beginning of a curve to the right with a radius of 1770.86 feet; and then along said curve to the right a distance of 712.2 feet to an iron rod; and then north 89*511 west, at 528.8 feet pass the iron rod at the westerly northwest corner of said right-of-way tract in the east line of said Old Denton Road and continuing in all 555.8 feet to a point in the west line of said Ellington tract in said road. THENCE north 0007' east, along said tract line in said road, 2814.7 feet to the PLACE OF BEGINNING and containing 138.119 acres and of which 2.628 acres are within the roads along the west and north sides leaving a net area of 135.491 acres. Tract 9-A (City Tax Records) of the David Odum Survey, Abstract No. 1184, embracing a southwest portion of the 42- acres tract conveyed to B. F. Ellington by the deed recorded in Volume W, Page 44, of the Tarrant County Deed Records. BEGINNING at the southwest corner of said Ellington tract in the middle of County Road No. 3048 and known as Old Denton Road and from which an iron rod in the south line of said tract and at the southwest side of corner post of fence bears north 89038' east 25.5 feet. THENCE along the west line of said tract and in said road north 0005, west 2581.4 feet and north 0°07' east 1083 fleet to a point for the northwest corner of the tract being described andfrom which the iron rod in the east line of said road for the westerly southwest corner of the tract for highway right-of-way conveyed to the State of Texas by the deed recorded in Volume 3839, Page 413, of said deed records, bears north 89005' east 27.7 feet. THENCE north 89005' east 27.7 feet to said iron rod for the westerly southwest corner of said tract for highway right-of-way. THENCE along the southwesterly line of said highway right-of-way as said line is marked by iron rods in place: North 89005' east 894.8 feet to an iron rod at the beginning of a curve to the right with a radius of 1332.4 feet; and then along said curve to the right a distance of 1720.8 feet to an iron rod; and then south 16057, east 187.5 feet to an iron rod at the beginning of a curve to the right with a radius cf 1412.4 feet; and then along said curve to the right a distance of 389 feet to an Iron rod; and then south 10091 east 1129.6 feet to an iron rod at the beginning of a curve to the right with a radius of 11,320.16 feet; and then along said curve to the right a distance of 282.3 feet to an Iron rod; and then south 0*17' west 745.3 feet to the iron rod for the southerly southwest corner of said highway right-of-way tract in the south line of said Ellington tract. THENCE south 890381 west, along said south line of the Ellington tract, 2353.8 feet to the PLACE OF BEGINNING and containing 187.098 acres of which 2.239 acres are embraced within the road along the west side of this tract and leaving a net area of 184.859 acres. Odum Survey, 1060.7 varas from Its northwest corner; THENCE east 2346.8 feet to a post, the most northerly northeast corner of the tract conveyed to Amon G. Carter, Jr., and Ruth Carter Johnson by a deed recorded in Volume 2385, Page 31 of the deed records of Tarrant County, Texas; THENCE south 0*09' east 179.7 feet to an iron rod, a reentrant corner of said tract; THENCE north 89*471 east 1257.5 feet to an iron rod, a northeast corner of said Carter- Johnson Tract and a reentrant corner of the 231 acres tract conveyed to D. T. Simons by a deed recorded in Volume 267, Page 246 of the deed records of Tarrant County, Texas; THENCE north 89038' east 998.9 feet to an iron rod, the south-southeast corner of a tract conveyed to Bert K. Smith by a deed recorded in Volume 966, Page 244, of the deed records of Tarrant County, Texas; THENCE north 0*51' west 716.3 feet to the corner post of a fence, the reentrant corner of said Smith tract; THENCE south 89*561 east 1999.63 feet to the east-southeast corner of said Smith tract In the east line of the D. T. Simons 231 acres tract, in County Road No. 3048, whence an iron rod bears north 89*561 west 27 feet; THENCE south 0*07' west, along the east line of said Simons tract, in said road, 1893.4 feet to the southeast corner of said tract and the northeast corner of the 2nd Tract conveyed to George W. Grant by a deed recorded in Volume 1480, Page 575, of the deed records of Tarrant County, Texas, and from said corner an iron rod bears north 890341 west 28 feet; THENCE south 0*051 east, continuing in said road, 4184.2 feet to the southeast corner of the 100 acres tract conveyed to H. Strohl by a deed recorded in Volume F, Page 63, of the deed records of Tarrant County, Texas, and being in the north line of the Wm. Baker Survey, Abstract No. 145, and in the intersection of said County Road No. 3048 witt County Road No. 3098 (D. Odum Road), and from said corner an iron rod bears north 12*59' west 163 feet, and an Iron rod bears north 83°54t west 191.3 feet. THENCE north 89*35' west, in said County Road No. 3048, a distance of 1358 feet to an iron rod for the northwest corner of said Baker Survey and the northeast corner of the John Bursey Survey, Abstract No. 122; THENCE north 88*341 west, along the north line of said Bursey Survey, 1623.8 feet to an iron rod, the southeast corner of the 11.9 acres tract conveyed to the Texas Electric Service Company by a deed recorded in Volume 1930, Page 302, of the deed records of Tarrant County, Texas, and being the southwest corner of the Ist Tract conveyed to George W. Grant; THENCE along the northeast line of said Texas Electric Service Company tract, north 36*26' west 506.1 feet, and north 37*191 west 2781.5 feet to an iron rod, the northeast corner of said tract and the southeast corner of a tract conveyed to Texas Electric Service Company by a deed recorded in Volume 1944, Page 396, of the deed records of Tarrant County, Texas; THENCE north 37*18' west, along the northeast line of said Texas Electric Service Company tract, 2684.7 feet to an iron rod, the north corner of said Texas Electric Service Company tract in the west line of the D. Odum Survey; THENCE north O°01' east, along the west line of the Odum Survey, 726.9 feet to the PLACE OF BEGINNING, and containing 649.956 acres. (1-35W (West side) to 1-820 (North side) FROM UNZONED TO "K" SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfar of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent over- crowding of land; to avoid undue concentration of population; to facilitate the adequate provisio of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing with reasonable consideration, among other things, of th character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are In direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be Invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense SECTION b.
