TION OF SAME IN THE MINUTE B00$ OF THE' CITY COUNCIL OF FELT WORTH,
TEXAS, AND BY FnING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AND V-37NOTIVE DATE.
WIX1"V S the City of Fort Worth, Texas, has heretofore entered into a contract
with R.W, GWIITS, INC. for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public places
in said City, to-wit:
SAMUELS AVENUE: From Poihdexter Street to E.N. 12th Street,
known and designated as Unit No.l, a 2 inch
Hot—Mix Asphaltic Concrete Surface on an
S inch Cement Stabilized Gravel Base on a
40 foot roadway.
WHSUS, by sundry proceedings heretofore uLesed by the City Council of the
City of Port Worth, Texas, including Ordinance No. 5U61 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting on each
of the above described portions of streets, avenues and public places and against the real
and true owners thereof; and,
WHMET.4S, the City Council of the City of Port Worth, Texas, has, upon re—
view, found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 9061 , and
'a' MAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described, and
have been inspected and found to be in complete accordance with the contract therefor;
NOW, TH IMLFORE,
BE IT ORDAI?734D BY TIE CITY COUNCIL OF TH23 CITY OF FORT WORTH,
T?%AS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with re—
ference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro—
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The numbers
of the certificates, with the property descriptions to be shown on the respective certifi—
cates, together with the names of the owners of said property, the principal amount of the
assessment, the respective credits, if any which are hereby authorized, granted and allowed
against the principal amount of some one or more of the assessments heretofore levied, and the
principal amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort North, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

Deviation from Bid Price:
Two conditions were encountered during the street construction which
resulted in the increased cost of the project. Neither of these
conditions could have been foreeeem until such time as actual construc-
tion was in progress.
1. During the excavation for the street, seepage was
encountered which would be detrimental to the sub-
grade. In order to elimi.nete this -undesirable
condition, it was necessary to construct a sub-
drain. + $453.00
2. At the intersection of Northeast loth and Samuels
Avenue poor sub-grade material was encountered,
and to improve the quality of:the material it was
necessary to lime stabilize the sub-grade in thf1
immediate area. + 325.33

3. Variations between estimated and measured quanti-
ties account' for the remaining difference between
bid price and final contract cost. - 219.05
Total Deviation from Bid Price 559.28
Compliance With Specifications:
Attached is a tabulation of paving test cores showing compliance with
specifications within acceptable construction tolerances. Tests made
during construction of the sub-base, base, and pavement also show that
the material used was in compliance with specifications.
