AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
ELIZABETHTOWN CEMETERY ROAD, SITUATED IN THE T.J. BATES
SURVEY ABSTRACT NUMBER 206 AND THE A. HENDERSON
SURVEY ABSTRACT NUMBER 596, OF CITY OF FORT WORTH,
DENTON COUNTY, TEXAS; AS RECORDED IN DOCUMENT NUMBER
1998-117441 AND DOCUMENT NUMBER 2016-119802 OF THE REAL
PROPERTY RECORDS OF DENTON COUNTY, TEXAS; CONTAINING
APPROXIMATELY 43,838 SQUARE FEET OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Elizabethtown Cemetery Road, situated in the T.J. Bates Survey,
Abstract Number 206 and the A. Henderson Survey, Abstract Number 596 of City of Fort Worth,
Denton County, Texas in the City of Fort Worth, Denton County, Texas as recorded in
Document Number 1998-117441 and Document Number 2016-119802 of the Real Property
Records of Denton County, Texas, and containing approximately 43,838 square feet or 1.006
acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached
hereto and incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.

All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RIGHT-OF-WAY VACATION
ELIZABETHTOWN CEMETERY ROAD
BEING a portion of a road known as Elizabethtown Cemetery Road(a paved,traveled road of
undetermined width)situated in the T.J.Bates Survey,Abstract Number 206,the A. Henderson
Survey,Abstract Number 596,City of Fort Worth,Denton County Texas, and being a portion of
those tracts of land described by deed to AIL Investment,L.P.,recorded in Instrument Numbers
1998-117441 and 2016-119802,both of Real Property Records,Denton County,Texas,being
more particularly described as follows:
COMMENCING at a 5/8 inch iron rod with plastic cap stamped"Peloton" found at the
northeast comer of Eagle Parkway(a variable width right-of-way),recorded in Instrument
Number 2016-58,being the southeast corner of North Beach street(a 130 foot right-of-way),
recorded in Instrument Number 2016-57,both of said County Records;
THENCE N 01 008'40"W, 701.31,with the east right-of-way line of said North Beach Street to
a 5/8 inch iron rod with plastic cap stamped"Peloton"found;
THENCE N 88051'21"E, 741.03 feet,departing said east right-of-way line to the POINT OF
BEGINNING,being the beginning of a curve to the left;
THENCE with said curve to the left, an arc distance of 67.62 feet,through a central angle of
54014'13",having a radius of 71.43 feet,the long chord which bears N 35059'51"E,65.12 feet;
THENCE N 08052'44"E, 24.76 feet;
THENCE N 00002'56"E, 793.09 feet;
THENCE N 88055'32"E, 50.01 feet, from which a RR Spike found at the northeast corner of the
aforementioned AIL Investment tract,recorded in Instrument Number 2016-119802,bears
N 30°18'13"E, 1963.43 feet;
THENCE S 00002'56"W, 797.93 feet;
THENCE S 08052'44"W,28.62 feet,to the beginning of a curve to the right;
THENCE with said curve to the right, an arc distance of 46.57 feet, through a central angle of
21°5825",having a radius of 121.43 feet,the long chord which bears S 19°51'57"W,46.28 feet;
THENCE S 8805 F21"W, 71.96 feet to the Point of Beginning and containing 43,838 square
feet or 1.006 acres of land more or less.

SUBJECT
Adopt Ordinance Vacating a Portion of Elizabeth Town Cemetery Road,to be Replatted with the Adjoining Property for a Proposed Industrial
Development in the Alliance Airport Industrial Growth Center(COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of Elizabeth Town Cemetery Road,a presumed prescriptive right-of-way,to be replatted with
the adjoining property for a proposed industrial development in the Alliance Airport Industrial Growth Center;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Peloton Land Solutions,Inc.,on behalf of AIL Investment,LP,has requested vacation of this portion of a presusmed prescriptive right-of-way to be
replatted with the adjoining property for an industrial development in the Alliance Airport Industrial Growth Center.The City Plan Commission
recommended approval of this request at its meeting on April 24,2019.An acceptable final plat(FP-19-032)has been received in accordance
with the Subdivision Ordinance.
Elizabethtown Cemetray Road is a presumed prescriptive right-of-way. The City of Fort Worth(City)does not own any fee interest in the right-of-
way or own any property adjacent to the right-of--way and did not expend any City funds to purchase the right-of-way easement. In accordance with
the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,(M&C G-15624),Staff
recommends waiving the fair market value or any portion thereof of purchase price of this right-of-way easement for the street.
This project is located in COUNCIL DISTRICT 7.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
