HomeMy WebLinkAboutOrdinance 7597 ORDINANCE NO. -7 5 J Z AN ORDINANCE RELEASING TERRITORY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF FORT WORTH, TEXAS; CONSENTING TO THE ANNEXATION OF SAID TERRITORY BY THE CITY OF EVERMAN, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN DIRECT CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PRO- VIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the City of Fort Worth hereby relinquishes to the City of Everman all extraterritorial jurisdictional rights over the hereinafter described territory, under the provisions of the Texas Municipal Annexation Act (Article 970a, Revised Civil Statutes of Texas, as amended) , said territory being: A portion of Block 32 and a portion of Block 33 of the Shelby County School Land Survey, Abstract No. 1375, situated in Tarrant County, Texas about 10 miles Southeasterly from the Tarrant County Courthouse, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the East line of Block 32 of the Shelby County School Land Survey, Abstract No. 1375, which point is also the Northeast corner of the City of Everman sanitary sewer plant site. THENCE South, along and with the East line of said Block 32, and continuing along and with the East line of Block 33 of said Survey to a point for corner 275 feet South from the Northeast Corner of said Block 33. THENCE West, along and with a line 275 feet South from and parallel to the North line of said Block 33, to a point for corner in the Everman Cemetery tract. THENCE South, along and with the Everman Cemetery tract, to a point for its Southeast Corner. THENCE West, along and with the South line of the Everman Cemetery tract, to a point for its Southwest Corner. THENCE North, along and with the West line of the Everman Cemetery tract, to a point for corner 250 feet South from the North line of Block 33, Shelby County School Land Survey. THENCE West, along and with a line 250 feet South from and parallel to the North line of said Block 33, to a point for corner in the West line of said Block 33 in the Centerline of Rendon Road (County Road No. 1015) , being also in the Fort Worth and Everman Common City limit line. THENCE, along and with the Fort Worth and Everman Common City limit line: North to a point for corner in the South right-of-way line of Enon Avenue East, and East along and with the South right-of-way line of Enon Avenue East, 1,600 feet, more or less, and North 417.8 feet, and West 130 feet, and North to the Northeast Corner of the City of Everman Well No. 5 Site. THENCE East to the Place of Beginning and containing 70 acres of land, more or less. SECTION 2. That the City of Fort Worth hereby consents to the annexation of the hereinabove described territory by the City of Everman. SECTION 3. That this ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative. -2- SECTION 4. THAT it is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. THAT this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: S. G.
