AN ORDINANCE PROVIDING THAT A PORTION OF BURGESS STREET FROM MZADOWBROOK DRIVE, A DISTANCE OF 779.3 FEET SOUTH, AND THE EASE- MENT STRIP WITHIN THE MMADOWBROOK INDEPEN- DENT SCHOOL TRACT 20 FEET WIDE, EXTENDING FROM BURGESS STREET TO RAND ROAD ALONG THE SOUTH BOUNDARY OF SAID SITE IN THE CITY OF FORT WORTH, TEXAS, BE VACATED, ABANDONED AND CLOSED; AND EXCEPTING THE RIGHTS OF ALL PUBLIC UTILITIES HERETOFORE ACQUIRED IN SAID PORTION OF SAID STREET; AND PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; AND REPEALING ALL ORDINANCES IN CONFLICT HERE- NITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. WHEREAS, the Fort Worth Independent School District owns all.of the property abutting on that portion of Burgess Street from Meadowbrook Drive, a distance of 779#3 feet south, a portion of which is required for school buildings, playgrounds • and other public purposes, and likewise said school district has title to a 20 foot strip running east from Burgess Street to Rand Road within the limits of the Meadowbrook School site; that it will be necessary for children attending the said school to travel from one portion of the said school grounds to the other across said Burgess Street and in the vicinity of said 20 foot strip running easterly the whole length of said school ground; and, WHEREAS, in the deed from the grantor to said school district where public easements were reserved the grantee, the Fort Worth Independent School District reserved the right to abandon said street; and, WHEREAS, said easement rights have never been used in any manner by the public; and, AREAS, such street and passage way constitutes a menace to the public and the interest of the public safety re- quires the closing and vacating of such street and passage way, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That that portion of Burgess Street from Meadowbrook Drive, a distance of 779.3 feet south, and the 20 foot easement strip inside the school tract, extending from Burgess Street to Rand Road, be and the same are hereby closed, abandoned and per- manently vacated as streets or public thoroughfares of any kind or character whatever. SECTION II. That the rights of all public utilities for the purpose of constructing and maintaining service lines shall not be dis- B'L turbed, destroyed, revoked axe abrogated by any of the provisions of this ordinance, but said rig;its as above set out shall remain in full force and effect. SECTION III. That the fee to the land in said street and easement strip shall revert as provided by law and by the reservations of said deed to the Fort Worth Independent School District. SECTION IV. All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION V. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
