HomeMy WebLinkAboutOrdinance 1798 A y ORDINANCE NO AN ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL DIRECT AD VALORAM TAX ON ALL PROPERTY, REAL, PERSONAL AND MIXED, SITUATED WITHIN THE TERRITORIAL LIMITS OF THE CITY OF FORT WORTH, TPXA.S, AND ALL PERSONAL PROPERTY OWNED IN SAID CITY OF FORT WORTH, TEXAS, ON THE FIRST DAY OF JANUARY, A. D. 1934, EXCEPT SUCH PROPERTY AS MAY BE MMITT FROM TAXATION BY THE CONSTITUTION AND LAWS OF THE STATE OF MAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. There is hereby levied and shall be collected, as provided by law, an annual, direct, special, ad valorem tax for the year 1934 for the support and maintenance of a free Public Library in the City of Fort Worth of three cents (30) on every $100.00 valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth on the first day of January, A. D. 1934, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas. SECTION II. There is also hereby levied and there shall be collected, as provid- ed by law, an annual, direct, special, ad valorem tax for the year 1934, for the use and benefit of the Park Fund of the City of Fort Worth of nine cents (") on every $100.00 valuation on all property, real, personal and mixed, sit- uated in and all personal property owned in the City of Fort Worth, Texas, on the first day of January, A. D. 1934, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas, which levy, in the aggregate sum of nine cents (90) as aforesaid, shall be and is hereby apportioned: For park operation, maintenance and upkeep .08462 dollars; For the benefit of notes dated 12/1/24 issued to the West Texas Construction Company for the improvement of Forest Park, as recited in Ordinance Nos. 1036 and 1055, .00282 dollars. The original amount of these notes was $52,000.00 and of which there is now outstanding and unpaid $13,000.00; For the benefit of notes issued to W. J. Bailey, dated 2/24/32, for the purchase of certain lands for park purposes, levy .00054 dollars. The original amount of these notes was $6,207.00 and of which there is now outstanding and unpaid $4,956.60. For the benefit of notes, dated 5/5/32, issued to W. J. Bailey for the purchase of certain lands for park purposes, levy .00167 dollars. The original amount of these notes was $19,074.00 and of which there is now outstanding and unpaid $15,259.20. For the benefit of notes, dated 2/24/32, issued to Greenwood Cemetery Association for the purchase of certain lands for park pur- poses, levy .00022 dollars. The original amount of these notes was $2,480.00 and of which there is now outstanding and unpaid $1,984.00; and For the benefit of notes, dated 5/5/32, issued to Greenwood Cemetery Association for the purchase of certain lands for park pur- poses, levy .00013 dollars. The original amount of these notes was $1,500.00 and of which there is now outstanding and unpaid $1,200.00, SECTION III. There is also hereby levied and there shall be collected, as provid- ed by law, an annual, direct, special, ad valorem tax for the year 1934, for the use and benefit of the Recreation Fund of the City of Fort Worth, of two cents (2�) on every $100.00 valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, on the first day of January, A. D. 1934 liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas, which levy, in the aggregate sum of two cents (2qf) sa aforesaid, shall be and is hereby apportioned: For Recreation operation maintenance and upkeep .01587 dollars; For the use and benefit of Recreation Funding Warrants, dated May 15, 1923, as recited in Ordinance No. 923, .00293 dollars. The original amount of which was $59,900.00, of which amount 016,000.00 of this aeries of notes are outstanding and unpaid; and For the use and benefit of a note issued to the Park Department of the City of Fort Worth, dated 7/24/28, for Z. Boaz Golf Course, levy .00120 dollars. The original amount of which was $15,000.00, of which amount $12,000.00 of this note is outstanding and unpaid. SECTION IV. That there is also hereby levied and there shall be oolleoted, as provided by law, an annual, direct, special, ad valorem tax for the year 1934, for the interest and sinking fund upon the existing bonded indebtedness of the said City of Fort Worth, of .6598 dollars on every 4100.00 valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth on the first day of January, A. SECTION V. That there is also hereby levied and there shall be collected, as provided by law, an annual, direct, special, ad valorem tax for the year 1934, for general and all such other purposes (besides those hereinbefore enumerated), as are authorized by law and by the Charter of said City of Fort Worth, of .8902 dollars on every $100.00 valuation on all property, real, personal and mixed, situated in and all personal property owned in said City of Fort Worth on the first day of January, A. D. 1934, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas. SECTION VI. That these special tax levies, which are hereinbefore made, to provide for the payment of interest and to create a sinking fund or to dis- charge and pay principal and interest on any obligations due or owing by the City of Fort Worth, are not to be taken as in addition to levies for the same purpose in the respective ordinances authorizing and creating such obliga- tions, but the levies hereinbefore made are made pursuant to and for the pur- pose of carrying out and complying with the provisions of said prior ordinances, and ad valorem taxes herein are levied upon all taxable property, real, person- al and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, as assessed, valued and described in the assessment tax rolls and the tax books of the City of Fort Worth, for the year 1934, and any supple- mental assessments thereof, as the same have been or shall be presented to the City Council of the City of Fort Worth by the Assessor and Collector of Taxes of said City of Fort Worth. SECTION VII. That the taxes herein levied and authorized and required to be collected shall be and become due and payable in two equal installments. The first installment, which amount shall be fifty (50%) per cent of the total sum of the taxes due and payable for the current year, shall be due and payable on the first day of October, A. D. 1934, and the second installments, which amount shall be the remaining fifty (50%) per cent of the total sum due and payable in taxes for the current year, shall become due and payable on the first day of April, A. D. 1935. SECTION VIII. The first installment of taxes required to be paid by virtue of this ordinance for the current year shall become delinquent on the first day of December, A. D. 1934, and the second installment of taxes required to be paid by virtue of this ordinance for the current year shall become delinquent on the first day of Tune, A. D. 1935. SECTION IX. Should any taxpayer permit his taxes to become delinquent, that is to say, should fail or refuse to pay the first installment, said install- ment being fifty (50%) per cent of the total amount of taxes due for the cur- rent year, before the first day of December, A. D. 1934, as above specified, then and in that event, the second installment shall also immediately become due and delinquent and a penalty shall attach to the payment of such taxes at the rate of one UP per cent per month, or fraction thereof, for each month thereafter; and should any taxpayer pay the first installment of his taxes as hereinabove provided, but should permit the second installment of his taxes to become delinquent, that is to say, should fail or refuse to pay said second installment before the first day of Tune, A. D. 1935, as above specified, then the penalty shall attach to the payment of the second installment at the rate of one (1%) per cent per month, or fraction thereof, on each month thereafter. SECTION X. That said penalty of one (1%) per cent per month shall be added to said taxes in the event the payment thereof should become delinquent as above set forth and said penalty shall attach on the first day of each month there- after until the taxes shall have been paid, which penalty shall be and become a part of said taxes and be payable as such, and provided further that in the event of the publication of the delinquent tax lists, or if suit is brought to recover such taxes and penalties and the delinquent taxpayer shall be subje*t to the payment of said taxes, penalties and costs, and the same shall be and become a lien upon the property of such taxpayers, as prescribed by the Charter of the City of Fort Worth and the laws of the State of Texas, the said taxes with penalties and costs shall be and become and they are hereby made a paramauut lien to all other liens whatsoever on the property on which said taxes are levied. SECTION XI. Should any part, portion, section or part of a section of this ordin- ance be declared invalid or inoperative or void for any reason by a court of compe- tent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provision shall be, remain and continue to be in full force and effect. SECTION XII. That this ordinance shall take effect and be in full force and effect from and after the date of its passage as provided by law.
