HomeMy WebLinkAboutOrdinance 7498 ORDINANCE NO. / g AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY 12' IN WIDTH AND 156' IN LENGTH FROM THE WEST LINE OF FORMER BROOKSHIRE STREET CLOSED BY ORDINANCE NO. 567 EAST TO KERRIGAN STREET; AND VACATING, ABANDONING AND CLOSING A PORTION OF KERRIGAN STREET IN THE 400 AND 1600 BLOCKS A WIDTH OF 40' AND A LENGTH OF 125' FROM EAST 4TH STREET NORTHERLY ABUTTING LOT 10, BLOCK 1, MASON'S ADDITION, AND LOTS 1 AND 2, BLOCK A, ROCK ISLAND ADDITION, AND CONTINUING EASTERLY A WIDTH OF 35' AND A LENGTH OF 105' ADJACENT TO LOT 1, BLOCK A, ROCK ISLAND ADDITION, AND LOTS 1-4, BLOCK 5, CUNNINGHAM AND WOODALL'S ADDITION EASTERLY TO HIGHWAY I-35 NORTH; AND VACATING, ABANDONING AND CLOSING EAST 3RD STREET IN THE 1600 BLOCK A WIDTH OF 60' AND A LENGTH OF 200' FROM THE WEST LINE OF LOT 11, BLOCK 4, CUNNINGHAM AND WOODALL'S ADDITION, EAST TO HIGHWAY I-35 NORTH ABUTTING LOTS 11-14, BLOCK 4 AND LOTS 1-4, BLOCK 5, CUNNINGHAM AND WOODALL'S ADDITION; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL BE- COME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley 12' in width and 156' in length from the West line of former Brookshire Street closed by Ordinance No. 567 east to Kerrigan Street and that portion of Kerrigan Street in the 400 and 1600 Blocks a width of 40' and a length 125' from East 4th Street northerly abutting Lot 10, Block 1, Mason's Addition, and Lots 1 and 2, Block A, Rock Island Add- ition and continuing easterly a width of 35' and a length of 105' adjacent to Lot 1, Block A, Rock Island Addition, and Lots 1-4, Block 5, Cunningham and Woodall's Addition easterly to Highway I-35 north; and that portion of East 3rd Street in the 1600 Block a width of 60' and a length of 200' from the west line of Lot 11, Block 4, Cunningham and Woodall's Addition, east to Highway I-35 north abutting Lots 11-14, Block 4 and Lots 1-4, Block 5, Cunningham and Woodall's Addition be and the same are hereby vacated, abandoned and permanently closed as an alley and as streets or public thoroughfares of any kind or character whatever. SECTION 2. That the fee to the land in the hereinabove described alley and those portions of Kerrigan Street in the 400 and 1600 Blocks and East 3rd Street in the 1600 Block are hereby released and will revert to the adjacent owners as provided by law, SAVE and EXCEPT that easements are reserved for any and all existing utilities including sanitary sewer, water, gas, electric and telephone facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. I-35 north; and to vacate E. 3rd Street 4:n the 1600 block a width of 60 feet and a length of 200 feet from the went line of Lot 11, Block 4, Cunningham and Woodall's Addition, east to Hwy. I-35 North abutting Lots 11-14, Block 4 and Lots 1-4, Block 5, Cunningham and Woodall's Addition, as shown on the attached map. Subject portion of East Third Street is open and gravelled, whereas Kerrigan Street and the adjoining east/west alley are neither open nor improved. Subject public rights-of-way adjoin the parking area of the Ralston Purina Company and are used for parking. Subject public rights-of-way contain water, sanitary sewer, gas, telephone and electric facilities. The agencies responsible for these public facilities request easements of sufficient size be provided for their respective facilities. The Public Works Department also requests that sufficient right-of-way be retained for necessary improvements to East Fourth Street. The City Plan Commission has reviewed this request and recommends its approval subject to the following conditions: 1. The vacated rights-of-way are replatted with abutting properties; to include drainage and utility easements as required. 2. Kerrigan Street is physically closed at Fourth. Curb and gutter will be constructed;at the time East 4th Street is widened. 3. Third Street is physically closed at Gilvin Street. A gate will be provided at this location for access to the parking facility. A satisfactory replat has been submitted to City staff and other conditions have been complied with as required. The replat also dedicates sufficient right-of-way on East Fourth Street to accommodate plans for street improvements. Recommendation It is recommended that an ordinance be adopted vacating the subject rights-of- way as .requested.
