C7 AN ORDINANCE PROVIDING THAT BRIARWOOD LANE BE- TWEEN THE EAST RIGHT-OF-WAY LINE OF QUEEN STREET AND THE WEST LINE OF LOT 6, WELBORN VIEW ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED, AND PROVIDING FOR THE CLOSING AND VACATING OF THE EASEMENT RE- SERVED FOR STREET IN LOT 36 OF SAID ADDITION; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Briarwood Lane between the east right-of-way line of Queen Street and the west line of Lot 6, Welborn View Ad- dition to the City of Fort worth, Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently va- cated as a street or public thoroughfare of any kind or char- acter whatever; and that the easement reserved for street in Lot 36 of said Addition, extending east 200 feet from the west line of said Lot 36 and the south line thereof being 25 feet south of and parallel to the north line of said Lot 36, be and the same is hereby extinguished, vacated, closed and permanently abandoned as a street easement. SECTION 2. That the interest of the City of Fort worth in the fee to the land above described is hereby released and shall re- vert to the adjacent owners of the fee as provided by law, save and except that easements are reserved for drainage and any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Diehl, 1541 Queen Street, with consent of all abutting LARn, property owners, has requested that the City vacate Briarwood Lane in the 4900 block a width of 25 to 50 feet and a length of approximately .�� 552 feet (including a 25 ft. x 200 ft. easement for street) from l' Queen Street east to the east line of Lot 1, Block 8, Hollowbrook -f' Addition, and also abutting. Lot 3, Block 7, Hollowbrook Addition, and Lot 36, Welborn View Addition, .as shown on the attached map. The subject rights-of-way, acquired by dedication, are not open. The Public Works Department states a drainage easement must be retained for proposed channel improvements as shown on the Welborn View Paving Plans. The Water Department states that collinear 15 ft. easements must be retained for two existing sewer lines. The reviewing City departments and private utility companies have no objections to this requested vacation provided that easements are retained for required drainage and existing utilities and the vacated rights-of-way are replatted with adjoining property. The City has received a satisf act6ry replat. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public rights-of-way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject rights- of-way as recommended by the City Plan Commission.
