AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1964) , AS AMENDED, BY ADDING THERETO NEW SECTIONS DESIGNATED AS SEC. 26-130 AND SEC. 26-131, PROHIBITING UNAU- THORIZED PARKING ON PRIVATE PROPERTY AND PROVIDING AN EXCEPTION THERETO; PROVIDING A SEVERABILITY CLAUSE; PRESCRIBING A FINE FOR THE VIOLATION THEREOF NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) ; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 26 of the Code of the City of Fort Worth, Texas (1964) , as amended, is hereby amended by adding thereto Secs. 26-130 and 26-131, which sections shall be and read as follows: "Sec. 26-130. Unauthorized Parking on Private Property Prohibited. It shall be unlawful for any person to park or stand a vehicle, whether occupied or unoccupied, except temporarily for the pur- pose of and while actually loading or unload- ing such vehicle, in any private driveway or on any private parking lot or other private property without the express or implied con- sent of the owner or person in lawful pos- session thereof. In the event the identity of the driver of such vehicle is unknown, the owner or person in whose name such vehicle is registered shall be prima :Facie deemed to be in violation hereof. "Sec. 26-131. Same -- Exception. No citation issued under the provisions of Sec. 26-130 shall be valid unless such citation includes a statement to the effect that at the time same was issued, a clearly visible sign was located on the private property involved, informing the public that such private driveway, parking lot or other private property is re- served for the use of authorized persons or vehicles only, and further that such sign stated the persons or vehicles authorized." SECTION 2. It is hereby declared to be the intention of the City Council that the paragraphs, sentences, clauses and phrases of these new sections of Chapter 26 of the Code of the City of Fort Worth (1964) , as hereby amended, are severable, and if any phrase, clause, sentence, paragraph or section of such Code shall be declared unconstitutional by a valid judgment or decree of a court of competent jurisdiction, such unconsti- tutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of such Code since the same would have been enacted by the City Council without the incorporation therein of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3. Any person who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine not to exceed Two Hun- dred Dollars ($200.00) , and each violation shall constitute a separate offense. SECTION 4. This ordinance shall be in full force and effect from and after the date of its passage and publication as provided by law, and it is so ordained.
