ORDINANCE NO. � AN ORDINANCE DISCONTINUING TERRITORY FROM WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH; RELINQUISHING TERRITORY FROM THE EXTRA- TERRITORIAL JURISDICTION OF FORT WORTH; CONSENTING TO THE ANNEXATION OF SAID TERRITORY BY THE CITY OF EVERMAN, TEXAS; PROVIDING FOR SEVER- ABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I That the hereinafter described territory within the corporate limits of the City of Fort Worth be and the same is hereby discontinued as a part of the City of Fort Worth; said territory being described by metes and bounds as follows: Being a portion of Block 9 of the Shelby County School Land. Survey situated about 9 miles southerly from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point for corner in the common city limit line of the City of Fort Worth, Texas, and the City of Everman, Texas; said point also being in the north line of Block 9 of the Shelby County School Land Survey in Tarrant County, Texas; said point also being 3199.8 feet North 89 Degrees-47 Minutes East from the Southwest corner of Block 5 of the Shelby County School Land Survey; said point also being in the proposed northerly right of way line of a proposed public street known as Mallick Parkway; THENCE South 77 Degrees-03 Minutes East along the proposed northerly right of way line of Mallick Parkway a distance of 553.1 feet to a point for beginning of a curve to the left with a radius of 2838.79 feet; THENCE, continuing along the said proposed northerly right of way line of Mallick Parkway, Southeasterly along said curve to the left a distance of 632.5 feet to a point for the beginning of a curve to the left with a radius of 1595.34 feet; THENCE, continuing along said proposed northerly right of way line of Mallick Parkway, Northeasterly along said curve to the left a distance of 593 feet to a point for the end of said curve and the beginning of a curve to the right with a radius of 1833.09 feet; THENCE, continuing along the said proposed northerly right of way line of Mallick Parkway, and along said curve to the right a distance of 324.5 feet to a point where said curve intersects the north line of said Block 9, Shelby County School Land Survey, said point of intersection also being in the common city limit line of the City of Fort Worth and the City of Everman; THENCE South 89 Degrees-47 Minutes West along the north line of. said Block 9, Shelby County School Land Survey and the common city limit line of Fort Worth and Everman a distance of 2057.4 feet to the place of beginning and containing approximately 5.8 acres of land. SECTION II That the City of Fort Worth hereby relinquishes all extraterritorial juris- dictional authority over the hereinabove described territory pursuant to the provisions of the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session 1963, compiled as Article 970a, Revised Civil Statutes of Texas; and consent is hereby given to the City of Everman, Texas to annex the hereinabove described territory. SECTION III That this ordinance shall and does hereby amend every prior ordinance in direct conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and the same is hereby made cumulative. SECTION IV That if any section, subsection or provision of this ordinance shall be held invalid or unconstitutional by a court of competent jurisdiction, the portion so held to be invalid or unconstitutional shall not affect any other part of this ordinance, which shall remain in full force and effect. SECTION V That this ordinance shall become effective and shall be in full force and effect from and after its passage and it is so ordained. Mayor and Council Commune afton MCMAHAN 11 DATE REFERENCE SUBJECT: proposed Re-alignment of For - pA LINE NUMBER wt Kts Worth - Everman City Limits - 9/9/68 PZ-295 Mallick Parkway -2— MORPHIS BUC CMA'l GRAHAM RE The Fort Worth City Plan Commission, in connection with its review of a pre- HARPY OWEI r liminary subdivision plat of Everman Park South Addition, submitted by Mr. George Mallick, recommended that the common boundary of Fort Worth and Everman R.�B. HIGHT wERe established as the north right-of-way line of the Mallick Parkway; part of a future major thoroughfare which extends east from Oak Grove Road to Race Street. History of Mallick Parkway Mallick Parkway was surfaced by the developer and since Mallick Parkway has not been dedicated to the public it is considered a private street. The existing pavement does not follow the proper alignment for a major thoroughfare at its intersection with Race Street. The Planning Department and the Public Works Department have determined the proper location for the north line of the pro- posed thoroughfare, providing a good intersection with Race Street. The developer has reviewed the proposed alignment and expressed no objection. The proposed city boundary follows the revised alignment. In the opinion of the Plan Commission, it is important that the thoroughfare be under one municipal control, (Fort Worth) , both as to construction and policing. The recommended boundary realignment requires discontinuance of areas from both Fort Worth and Everman, and subsequent annexation by each city of the area dis- continued by the other. As illustrated on the attached map, the proposed common boundary line of the two cities coincides with the northerly right-of-way line of Mallick Parkway. In order to complete the proper adjustment, Fort Worth must release and Everman must annex approximately 5.8 acres and Everman must release and Fort Worth must annex approximately 21.4 acres. Cost of Improving Mallick Parkway The City of Everman is agreeable to receiving less area, as they presently are unable to participate with the developer in the construction of the major thoroughfare and necessary drainage improvements. The cost of developing the major thoroughfare to Fort Worth standards is estimated to be $200,000 for the developer and $50,000 for the City. Recommendations It is recommended that: 1) The Council approve the proposal for re-alignment of the common Fort Worth- Everman city limit line, to be the north line of Mallick Parkway as re-aligned, and BATE REFERENCE SUBJECT: Proposed Re-alignment of Fort PAGE NUMBER Worth - Everman City Limits - 9/9/68 PZ-295 Mallick Parkway 2 °f 2 2) Pass an ordinance discontinuing the territory as shown on the attached map, and 3) Authorize the staff to proceed with the additional steps necessary to complete the boundary adjustment with Everman.
