AN ORDINANCE VACATING, ABANDONING AND CLOSING COUNTRY DAY LANE FROM BRYAN - HENDERSON ROAD NORTHWARD TO BELLAIRE DRIVE SOUTH;PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of Country Day Lane from Bryan-Henderson Road northward to Bellaire Drive South, being the 3800 through the 4200 blocks of Country Day Lane, including both the east/west portion from Bryan-Henderson Road to the southeast corner of Lot A, Country Day Park, as recorded in Volume 388-32, Page 32, Plat Records of Tarrant County, Texas, and the north/south portion from the southeast corner of said Lot A, Country Day Park, extending to the south line of Bellaire Drive South, as included on a plat approved by the City of Fort Worth Plan Commission on June 26, 1964, but not recorded in the Plat Records of Tarrant County, Texas, be and the same is hereby vacated, abandoned and permanently closed for street right-of-way purposes. SECTION 2. That the fee to the land in the above described right-of-way is hereby released and shall revert to the adjacent owners as pro- vided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. This latter portion had 7r been included on a plat approved by the City Plan Commission on June 26, 1964, but never recorded in Plat Records, Tarrant County, Texas, as shown on the attached map. The subject street confains electrical, telephone and water facilities. The utility entities responsible for these utilities request that appropriate ease- ments be retained unless other arrangements are made. Country Day Lane from Bryan-Henderson Road to the east and north for a short distance is improved with pavement. The remainder is unimproved. Reviewing City departments and private utility companies have offered no objec- tions to this vacation request provided the vacated right-of-way is replatted with abutting property; appropriate easements are dedicated for the existing utility facilities; a driveway approach or appropriate signing is installed at t'-e south point of the prcpcsed vacation; and all street lights, street name and traffic control signs are removed and returned to the City. Satisfactory arrangements in compliance with the aforementioned requirements have been made and a satisfactory replat has been submitted to City staff. The City Plan Commission has reviewed this request and recommends that the subject right-of-way be vacated. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the Plan Commission.
