AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A CLEAN CITY COMMISSION FOR THE PURPOSE OF ASSISTING THE CITY COUNCIL IN ESTABLISHING A CITY-WIDE POLICY FOR REFUSE MANAGEMENT; PRO- VIDING FOR A MEMBERSHIP OF TWENTY-FIVE FROM SPECIFIC CONSTITUENCIES OF THE CITY; DESCRIB- ING THE DUTIES OF SUCH COMMISSION; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a Clean City Commission is hereby created for the pur- pose of assisting the City Council in establishing a city-wide policy for decreasing the amount of loose refuse in the City. SECTION 2. That the Clean City Commission provided for herein shall be comprised of twenty-five (25) members to be nominated by the City Manager and approved by the City Council and shall be residents of the City. The board shall consist of representatives from: Number of Members Place Number Business & Industry Representatives 10 1-10 Labor Representatives 2 11,12 Community Organizations 6 13-18 Education 3 19,20,21 Members at Large 3 22,23,24 Director of Public Works 1 25 TOTAL 25 Members of the Commission originally appointed to fill odd- numbered places 1 through 23 shall be appointed for a term of one (1) year. Members of the Commission originally appointed to fill even-numbered places 2 through 24 shall be appointed for a term of two (2) years. Thereafter, the term of each Commission member shall be two (2) years. No Commission member shall serve two (2) successive terms; provided,.ihowever, that a Commission member appointedito complete the term of another Commission member shall, at the completion of such term, be eligible for appointment for another full term; and provided further, that place 25 shall always be filled by the Director of Public Works who shall serve as a non-voting ex-officio member of the Commission. SECTION 3. That the Executive Director of the Clean City Commission shall be the non-voting secretary of the Clean City Commission. He shall be custodian of all minutes and records of the board and perform such other duties as the Commission may deem necessary and consistent with both the responsibilities of the Commission and his responsi- bilities to the City of Fort Worth through the City Manager and the Director of Public Works. He shall be hired by the City Manager and shall be given office space at or near the Department of Public Works. The Executive Director shall work under the supervision and control of the Director. of Public Works for the purpose of implementing the provisions of this ordinance. SECTION 4. That seven (7) members of the Commission shall constitute a quorum for the conduct of business. The members of the Commission shall regularly attend meetings and public hearings of the Commission and shall serve without compensation except for reimbursement for authorized expenses attendant to the performance of their duties. The Commission shall held an organizational meeting in May .of each even numbered year and shall elect a Chairman and Vice-Chairman from among its members before proceeding to any other matters of business. The Commission shall meet regularly and shall designate the time and place of its meetings. The Commission shall adopt its own rules of procedure and keep a record of its proceedings in accordance with the provisions of this ordinance and the Charter of the City of Fort Worth. Newly appointed members shall be installed at the first regular meeting after their appointment. -2- Each month a report shall be submitted to the City Council showing the cumulative attendance of each member with notation of . mu-nhers who have been absent from three (3) c,)r-,,;ecutive meetings. Determinr, and recommend L.o the City Council management and Priori-lcit�s on a City-wide basis; 4. Recommend enforcement and additional pro(jram alternative.-,'; 5. Monitor Citv perfoim--ince rrcm data collected and examined under the keen America Beautiful, Inc. , Clean Community Syf.t(-.i-n gutcdlelinos and make an annual report, to the City Council; and 6. Carry out such other tasks as the City Council may designate. To accomplish these responsibilities the Commission shall establish sub-committees including, but not limited to, the areas of Business and Industry, Communications, Community Organizations, Municipal Operations, and Schools. Each sub-committee will be chaired by a Clean City Commission member with an unspecified number of community volunteers chosen by the Commission as working sub-committee staff. SECTION 6. That office space, suppl.Jes, telephone, postage and secretarial support for the 7xecutive Direct-or shall be Punished L by the City within the budgetary appropriation proc:�ss. Additional funds, for -3- Commission activities involving travel or training for the Executive Director shall also be supplied by the City within Council imposed budgetary orestraints. The Executive Director's salary shall be paid by the City. Such salary and any other expenses, whether specifically enumerated in the preceding paragraph or not, may be paid from donations when, as and if same are received by the City from the general public, business, industry, foundations and other sources for the purposes embraced by the scope of the Commission's purpose and responsibilities administered in accordance with standard City policy and practice as governed by statute, charter and ordinance. SECTION 7. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional or illegal by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or illegality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without incorpora- tion in this Ordinance of any such unconstitutional or illegal phrase, clause, sentence, paragraph or section. SECTION S. That this Ordinance shall be in full force and effect from and after the date of its passage, and it is so ordained. Mayor , and Council Communication BAILIFF SMITH DATE REFERENCE SUBJECT: Ordinance Establishing Fort PAGE NUMBER Worth Clean City Commission PRIORS 3/27/79 G-4112 I of 2 BAGKGROVND: The City Council and City staff have worked together to develop a program for the purpose of developing and maintaining an environment which will contribute to the emotional, physical, and economic well-being of Fort Worth citizens over an extended period of time by reducing the amount of loose refuse present in the City. After reviewing several alternatives, a presentation of the "Keep America Beautiful" Clean Community System was made to the City Council, subsequently endorsed and a project team formed from business, civic and government community representatives to implement the Clean Community System for Fort Worth. It is the recommendation of this project team and the City staff that a Fort Worth Clean City Commission as described in I.R. No. 3262 be established. The Fort Worth Clean City Commission would consist of twenty-five (25) members, as specified in the attached ordinance. The functions of the Commission would be to implement the Clean Community System in Fort Worth. The sole staff non-volun- teer employee for the Clean City Commission would be an executive director who would be retained on a contractual basis to facilitate the community training and information program and report to the Public Works Director. FINANGING: Financing for the Executive Director and the Clean Community System implemen- tation will, over the term of the project, come from community sources. The initial funding for start-up prior to receipt of voluntary donations or other successful funding alternatives would be provided by the City of Fort Worth. The scope of funding for the Executive Coordinator position for a start-up period of approximately ninety (90) days is estimated as follows: Personal Services $3600 Supplies and Travel (KAB orientation workshop) $1200 Auto allowance and printing expense $ 800 Misc. and contingency items $ 400 INITIAL IMPLEMENTATION TOTAL $6000 Funds to finance this start-up proposal are anticipated to be available from accumulating reserves within the Public Works Department FY 78-79 operating budget. ~ DATE312 7/79 G-4I I2 ��REFERENCE SUBJECT: Ordinance Establishing Fort PAGE NUMBER Worth Clean City Commission 2 2 --T-- Rec-ommeR da t i oR It is recommended that the City Council adopt the attached ordinance estab— lishing the Fort Worth Clean City Commission and the commission staff position of Executive Director.
