HomeMy WebLinkAboutResolution 3952-12-2010 A Resolution NO. 3952-12-2010 A Resolution Increasing the Amount to be Paid to Jackson Walker, L.L.P., To Assist the City in Certain Employment Tax, Labor and Employment Law Issues, and Tax Issues Related to the Employees Retirement Fund WHEREAS, there are various legal matters concerning employment tax, labor and employment law, and tax issues related to the Employees Retirement Fund; and WHEREAS, because of the extraordinary importance of those legal issues, the law firm of Jackson Walker, L.L.P. has been hired as outside counsel to provide legal assistance to the City for a fee not to exceed $5,000.00; and WHEREAS, the cost of legal services provided by James Griffin of the law firm of Jackson Walker has exceeded $3,000.00, and it is estimated that an additional amount of approximately $10,000 beyond the authorized cost of $5,000.00 will be needed due to the ongoing nature of the issues involving employment tax, labor and employment law, and tax issues involving the Employees Retirement Fund. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the compensation authorized to be paid to Jackson Walker L.L.P., for legal services be increased from $5,000.00 to an amount not to exceed $15,000.00. L. P., to assist the City in certain employment tax, labor and employment law issues, and tax issues related the Employees Retirement Fund, to an amount not to exceed $15,000.00. DISCUSSION: There are legal issues concerning employment tax, labor and employment law, and tax issues related to the Employees Retirement Fund to which staff needs direction from an attorney with expertise in these areas. On March 2, 2010, City Council approved a resolution authorizing the City Manager to retain James Griffin of the law firm of Jackson Walker, L.L.P., as outside counsel to provide legal assistance to the City on the above named issues. The resolution authorized an amount not to exceed $5,000.00, to be paid to Jackson Walker, L.L.P., for the legal services provided by Mr. Griffin. Because of the ongoing nature of the issues involving employment law and the Employees Retirement Fund, and the fact that to date the legal fees billed by Mr. Griffin exceed $3,000.00, it is recommended that City Council increase the maximum amount to be paid to Jackson Walker, L.L.P., to an amount not to exceed $15,000.00.
