COUNTY OF TARRANT WHEREAS, The City of Fort Worth and RPGA Design Group, Inc. (Consultant) made and entered into City Secretary Contract No. 52259 (The Contract) which was authorized administratively, the 8th day of May, 2019, for Programming and Schematic Design of the Las Vegas Trail Community Center; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services for site survey. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide construction documents and administration services for the design. The cost of this additional service is $55,000.00 plus $0.00 in reimbursable expenses. The scope of services is described more fully in RPGA's Letter dated September 26, 2019, subject: "LVTRise Community Center— City of Fort Worth, 8201 Calmont Avenue / Fort Worth, Texas". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $132,738.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." This proposal reflects our anticipated Professional Services for completing the Construction Documents and Construction Administration Services for the renovation work approved in Phase I for the LVTRise Community Center located at 8201 Calmont Avenue in Fort Worth, Texas. We submit the following: I. General Project Description: RPGA will complete the Construction Documents and provide Construction Administration services as necessary to complete the work approved in the initial Schematic Design Phase of this project. We understand the budget for the proposed scope of work included in this proposal is as follows: Construction $ 454,577.00 Entry Canopy $ 150,000.00 Parks (site improvements) $ 291,020.00 Total Budget $ 895,597.00 RPGA will supervise and coordinate consultants' activities, review all consultants' documents and review all pertinent consultant documents with the Owner. Consultants hired independently by the Owner are excluded from RPGA's supervision and coordination. II. III. Compensation: A. Based on our understanding of the scope of services to be performed for the initial phase of this project, the fees are as stated below. If during the development of the project changes are made to the scope and/or construction budget of the project, the fees will be subject to revision. Fees as quoted are good for a period of(90) ninety days from the date of this proposal. Architectural/Engineering Fees for LVTRise Community Center The Owner agrees to pay the Architect for all professional services rendered under this agreement. The Architect's fee for Basic Services will be billed on an hourly basis not to exceed the fees listed below, plus allowable reimbursable expenses. The hourly billing rates for services of the Architect and the Architect's consultants are set forth below. The rates shall be adjusted in accordance with the Architect's and Architect's consultants' normal review practices. Hourly Rates for Unscheduled or Requested Services (these additional services will only be provided with an authorized amendment in writing from the Owner): No Charge will be incurred for minor revisions to the plans during the design process prior to construction document phase. Compensation for major variances to the agreed-upon plans and specifications, time involved in additional services, but not initial site visits, will be billed on an hourly basis as follows: Principals: $165.00 Project Manager: $110.00 Production Personnel: $85.00 Clerical $45.00 The above listed hourly rates are subject to change with notice. The Owner can negotiate a set fee at the time, if and when needed. C. Reimbursable fees will be billed to the Owner at one and one tenth (1.10) the expense incurred by RPGA. Reimbursable expenses will include, but not be limited to, the following: a) cost of reasonable incidental charges exclusive of markup for delivery charges; cost of reproduction, postage and handling of drawings, specifications and other documents; and renderings, models and mock-ups requested by the Owner and as required in the normal preparation of Schematic Design, Design Development and Construction Documents as required for reviewing and developing the Documents for the project. b) cost of TDLR accessibility variance application fees, project filing fees, plan review and inspection fees. c) all necessary costs of printing and/or courier services for the purpose of bidding the Construction Documents and Specifications will be the responsibility of the Owner. IV. Schedule: Based on our understanding of the scope of services we estimate the schedule to be as follows: Design Development 4 Weeks Construction Documents 4-6 Weeks Remaining Design Duration 8-10 Weeks This schedule anticipates a period of one week for review by the Owner for changes and clarifications at the completion of the Programming Phase. V. Changes: If major changes are made in the scope, approach or details of the Project at the Owner's request after construction documents are underway or finished, the cost of making changes will be billed at the above hourly rates. Documents: All plans and drawings will be prepared and submitted by RPGA to the Owner for review and approval on 24" x 36" or 307 x 42" bond sheets, with all plotted lettering clearly legible when the sheets are reproduced and reduced to half size. (CSC# 52259), in the Not-To-Exceed Amount of$73,750.00, for Phase 1 of the Las Vegas Trail Community Center Design, for a Total Contract Value of$132,738.00 (COUNCIL DISTRICT 3) RECOMMENDATION: It is recommended that the City Council authorize execution of Amendment Two, to the professional services agreement with RPGA Design Group, Inc. (CSC#52259), in the not-to-exceed amount of $73,750.00, for Phase 1 of the Las Vegas Trail Community Center Design, for a Total Contract Value of$132,738.00. DISCUSSION: The purpose of this M&C is to authorize execution of Amendment Two, to the professional services agreement with RPGA Design Group, Inc. (CSC# 52259), in the not-to-exceed amount of$73,750.00, for Phase 1 of the Las Vegas Trail Community Center Design, for a total contract value of $132,738.00, and a total project cost of$1,842,400.00. The LVTRise project is a cooperative effort by private companies, human services organizations and government agencies dedicated to improving the lives of people living in the Las Vegas Trail area. LVTRise, Inc. is a non-profit corporation, taking the lead in implementing the project and providing programing. On March 8, 2019, City staff administratively executed an agreement with Bennet Benner Partners, Inc. to provide preliminary feasibility and conceptual design services in the amount of$16,800.00. On March 19, 2019, City Council authorized (M&C L-16192) acquisition of approximately 5.033 acres of land, at 8201 Calmont Avenue, Fort Worth, Texas 76017, in the total amount, including closing costs, of$248,500.00, from the YMCA of Metropolitan Fort Worth, for the new Calmont Park and the Las Vegas Trail Community Center. M&C L-16192 also adopted appropriation ordinances to increase Park Dedication Fees Fund by $500,000, for the new Calmont Park and the Las Vegas Trail Community Center and increased appropriations in the General Capital Fund from $650,000.00 to $692,400.00. This brought the total project budget to $1,842,400.00. M&C L-16192 also authorized an agreement with LTVRise, Inc. for the lease and management of the community center currently referred to as the Las Vegas Trail Community Center at Calmont Park. This agreement also outlined the splitting the cost of building renovations between LTVRise, Inc. and the City of Fort Worth. Request for Qualifications was advertised in the Fort Worth Star-Telegram on March 7, 2019 and March 14, 2019. The City of Fort Worth received 10 proposals from design teams on March 21, 2019. Howard &Associates Architects • Wright Group Architects-Planners, P.L.L.C. City staff representing Neighborhood Services Department, Property Management Department, Office of Business Diversity, and representatives of LTVRise, Inc. reviewed the 10 proposals and met on March 27, 2019 and evaluated the proposals. The selection process idenitfied RPGA Design Group, Inc. as the best qualified design firm for this project. The complete results of these evaluations are an attachment to this M&C. On May 8, 2019, Staff administratively executed a professional services agreement with RPGA Design Group, Inc. for the schematic design of Phase 1 of the Las Vegas Trail Community Center and later executed an Amendment One, for site survey work, to the contract for a total of$53,338.00. On August 6, 2019, City Council authorized (M&C 19-0013) acceptance of$650,000.00 from LVTRise, Inc. and adopted appropriation ordinances to increase the General Capital Fund by $650,000.00. RPGA Design Group, Inc., working with LVTRise, Inc., its partners, and various City staff and departments have produced schematic site plans, floor plans, elevations, and a construction budget, that best meets the needs of the community. Based on the competitive selection process and work produced to date, staff recommends the City Council authorize execution of an amendment to the existing agreement with RPGA Design Group, Inc., in the not-to-exceed amount of$73,750.00, for Phase 1 of the Las Vegas Trail Community Center Design, for a total contract value of$132,738.00. Because the contract with this amendment will exceed $100,000.00 Mayor and City Council approval is required. The overall budget for the project is as follows: Las Vegas Trail Community Center Project Budget TOTALS Land Cost $251,380,00 Design Costs $143,888.00 Construction Cost $11367,132.00 Admin, ITS, Security, Survey, FFE, Contingency, etc. $80,000.00 PROJECT TOTAL $1,842,400.00 In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." The construction for this project is anticipated to start in the fourth quarter of 2019 and construction is anticipated to be complete in the second quarter of 2021.
