AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 8, WEST-
GATE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, FROM UNIVERSITY DRIVE WEST TO BAILEY AVENUE, BE
ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVER-
SION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID
LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That the alley in Block 8, Westgate Addition to the City of
Fort Worth, Tarrant County, Texas, from University Drive west to
Bailey Avenue, be and the same is hereby vacated, closed and perma-
nently abandoned as an alley or public thoroughfare of any kind
or character whatever.
SECTION 2.
That the interest of the City of Fort Worth in the fee to
the land in said alley is hereby released and shall revert to the
adjacent owner of the fee as provided by law, save and except that
the full width of the alley is retained as an easement and that
vehicles and duly authorized employees of the City of Fort Worth
shall at all times have the right to ingress and egress in,
through, upon and across said easement.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage.

Mr. A. P. Simons, owner of Block 8, Westgate Addition, has requested aban-
donment of the alley from University Drive west to Bailey Avenue, as shown
on attached map. This request is made to permit development of a private
access road to parking areas at the rear of an apartment project now under
construction at the location.
Private utility companies , the Water, Traffic Engineering and Planning De-
partments have reviewed the request and do not object to the abandonment,
subject to retaining the full width of the alley as an easement.
The Public Works Department objects to the proposed abandonment because it
is anticipated that the alley will be constricted with a substandard grade
of 'pavement. Although maintenance would be the responsibility of the owner,
problems could arise if the public assumes the alley to be a dedicated roadway.
Private alleys in downtown areas have been difficult to keep clean, repaired,
and free of illegal parkers.
The owner has stated that City waste disposal trucks will not need to use
the alley, because the apartment will employ a private firm to handle the
waste disposal.
The City Plan Commission has reviewed the request of Mr. Simons and recom-
mends adoption of the ordinance that has been prepared abandoning the alley
as requested, subject to retaining the full width of the alley as an ease-
ment. It is requested that the City Council determine whether the alley
should be closed as requested, or be retained as a public roadway.
