HomeMy WebLinkAboutOrdinance 7899 ORDINANCE NO._f7 _q AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL EMERGENCY ACCESS AND UTILITY EASEMENTS CONTAINED WITHIN LOT 2-R, BLOCK 5, WOODHAVEN COUNTRY CLUB ESTATES (SILVER MAPLE COURT, BORDEAUX DRIVE, TIMBER CREST CIRCLE AND TIMBER CREST COURT) ; PROVIDING FOR A REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all emergency access and utility easements contained within Lot 2-R, Block 5, Woodhaven Country Club Estates (Silver Maple Court, Bordeaux Drive, Timber Crest Circle and Timber Crest Court) as recorded in Volume 388-119, Page 92, Plat Records Tarrant County, Texas, be and the same are hereby vacated, abandoned and permanently closed as utility easements. SECTION 2. That the fee to the land in said utility easements is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. The subject emergency access and utility easements were dedicated for a previously approved unified residential project which did not materialize and the easements were never utilized. No utilities are contained within these easements. A new unified residential site plan has been submitted and approved by the Plan Commission; the necessary replat dedicating alternate easements has been submit- ted to staff. Reviewing City departments and private utility companies have no objection to the abandonment of these easements and find the submitted replat acceptable. The City Plan Commission has reviewed this request and recommends that subject emergency access and utility easements be abandoned as requested. Recommendation It is recommended that an ordinance be adopted vacating subject emergency access and utility easements, as recommended.
