AN ORDINANCE VACATING, ABANDONING AND CLOSING
THAT CERTAIN SANITARY SEWER EASEMENT IN THE J.
HOWARD SURVEY LYING IN THAT CERTAIN LOT, TRACT
OR PARCEL OF LAND IN THE J. HOWARD SURVEY,
ABSTRACT 693, TARRANT COUNTY, TEXAS, AND BEING
A SANITARY SEWER EASEMENT ACROSS A PART OF THAT
CERTAIN TRACT CONVEYED TO CASSCO LAND COMPANY,
INC. UNDER "TRACT ONE" IN THE DEED RECORDED IN
VOLUME 5783, PAGE 618, DEED RECORDS, TARRANT
COUNTY, TEXAS, AND BEING AN EASEMENT OF UNSPE-
CIFIED WIDTH WHICH IS NO LONGER NEEDED OR NEC-
ESSARY FOR THE OPERATION OF SANITARY SEWER MAIN
NO. M-246 BECAUSE OF THE RELOCATION OF SAID
SANITARY SEWER LINE TO ANOTHER EASEMENT, ACCORD-
ING TO CITY OF FORT WORTH PROJECT NO. 106-13000-723
DATED FEBRUARY 1977, THE CENTER LINE OF WHICH BEING
MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
FOLLOWS: BEGINNING AT A POINT IN THE SOUTH LINE
OF PROPOSED LOT 7, BLOCK 9, OVERTON SOUTH ADDITION,
AT THE CENTER OF ABANDONED SANITARY SEWER M-246,
SAID POINT BEING APPROXIMATELY 60' FROM THE SOUTH-
EAST CORNER OF SAID LOT 7; THENCE NORTHEASTERLY
WITH THE CENTER OF SAID PIPE APPROXIMATELY 100'
TO A MANHOLE AT AN ANGLE IN SAID LINE; THENCE
NORTHWESTERLY WITH SAID LINE APPROXIMATELY 250'
TO A POINT IN THE NORTH LINE OF SAID LOT 7 AND
THE SOUTH RIGHT-OF-WAY LINE OF INTERSTATE HIGH-
WAY LOOP 820; PROVIDING FOR THE REVERSION OF THE
FEE IN SAID LAND; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING THAT THIS OR-
DINANCE SHALL BECOME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the Sanitary Sewer Easement in the J. Howard Survey
lying in that certain lot, tract or parcel of land in the J.
Howard Survey, Abstract 693, Tarrant County, Texas, and being
a sanitary sewer easement across a part of that certain tract
conveyed to Cassco Land Company, Inc, under "Tract One" in
the deed recorded in Volume 5783, Page 618, Deed Records, Tarrant
County, Texas, and being an easement of unspecified width which
is no longer needed or necessary for the operation of sanitary
sewer main no. M-246 because of the relocation of said sanitary
sewer line to another easement, according to City of Fort worth
Project No. 106-13000-723 dated February 1977, the centerline of
which being more particularly described by metes and bounds as
follows: Beginning at a point in the South Line of Proposed
Lot 7, Block 9, Overton South Addition, at the center of aban-
doned sanitary sewer M-246, said point being approximately 601
from the Southeast corner of said Lot 7; Thence Northeasterly
with the center of said pipe approximately 100' to a manhole
at an angle in said line; Thence Northwesterly with said line
approximately 250 feet to a point in the North Line of said Lot
7 and the South right-of-way line of interstate Highway Loop
820, be and the same is hereby vacated, abandoned and permanently
closed as an easement for a sanitary sewer.
SECTION 2.
That the fee to the land in the above described sanitary
sewer easement is hereby released and will revert to the adjacent
owners as provided by law, SAVE AND EXCEPT that easements are
reserved therein for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Cassco Land Company, Inc. , owner of all abutting property, has requested
that the City vacate a Sanitary sewer easement as shown on the attached
map.
Reviewing City Departments and private utility companies have no objections
to this request provided an acceptable alternate easement is provided.
Such a plat has been submitted to City Staff.
Recommendation
It is recommended that an Ordinance be adopted vacating the subject easement
as requested.
