AN ORDINANCE VACATING, ABANDONING AND CLOSING
A PORTION OF BUFORD AVENUE IN THE 1000 BLOCK
A WIDTH OF 50' FROM THE SOUTH LINE OF LOT 8,
BLOCK 3, ZIHLMAN'S ADDITION TO THE CITY OF FORT
WORTH, AND TRACT 3, MONTGOMERY SURVEY NORTHERLY
140' TO THE SOUTH LINE OF LOT 5, BLOCK 3, ZIHLMAN'S
ADDITION TO THE CITY OF FORT WORTH, AND TO VACATE,
ABANDON AND CLOSE A PORTION OF BUFORD AVENUE IN
THE 3600 BLOCK A WIDTH OF 40' AND A LENGTH OF 210'
FROM THE EAST LINE OF TRACT 3, MONTGOMERY SURVEY,
WEST TO HASKELL AVENUE AT THE WEST LINE OF TRACT 1,
MONTGOMERY SURVEY; PROVIDING FOR THE REVERSION OF
THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDIN-
ANCE SHALL BECOME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Buford Avenue in the 1000 Block a width
of 50' from the south line of Lot 8, Block 3, Zihlman's Addition
to the City of Fort Worth, and Tract 3, Montgomery Survey north-
erly 140' to the south line of Lot 5, Block 3, Zihlman's Addition
to the City of Fort Worth, and to vacate, abandon and close a
portion of Buford Avenue in the 3600 Block a width of 40' and a
length of 210' from the east line of Tract 3, Montgomery Survey
west to Haskell Avenue at the west line of Tract 1, Montgomery
Survey be and the same is hereby vacated, abandoned and per-
manently closed as a right-of-way for street purposes.
SECTION 2.
That the fee to the land in the above described street
right-of-way is hereby released and will revert to the ad-
jacent owners as provided by law, SAVE AND EXCEPT that ease-
ments are reserved therein for any and all existing utilities
including existing sanitary sewer, electric, gas and telephone
facilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Fort Worth Osteopathic Hospital, owner of all abutting property, has requested
that the City vacate Buford Avenue in the 1000 block a width of 50 feet from
the south line of Lot 83, Block 3, Zihlman's Addition, and Tract 3, Montgomery
Survey northward 140 feet to the south line of Lot 5, Block 3, Zihlman's
Addition, and to vacate Buford Avenue in the 3600 block a width of 40 feet and
a length of 210 feet from the east line of Tract 3, Montgomery Survey, west
to Haskell Avenue at the, west line of Tract 1, Montgomery Survey.
Subject street right-of-way, acquired by dedication, is open and improved and
contains sanitary sewer, electric, gas and telephone facilities.
The City Plan Commission, after reviewing this request, concurs with the
reviewing City departments and private utility companies and recommends approval
provided that:
1. The vacated right-of-way is replatted with abutting property;
2. Utility easements are dedicated when required or satisfactory relocation
arrangements are made.
It is noted that the remaining portion of Buford Street, extending south to
Bertrose Avenue, is included in a more recent vacation request (V-77-2) by
this same Applicant, who has accepted and will comply with all City Plan
Commissions' recommended conditions of approval, as outlined above, in conjunc-
tion with the replat of abutting properties, which is also a recommended
condition of approval in V-77-2.
Recommendation
It is recommended that an ordinance be adopted vacating the subject right-of-way
as requested.
