The cost of this additional service is $35,692.00. SPECIAL SERVICES: SPECIAL SERVICES shall be any service provided by the ENGINEER which is not specifically included in BASIC SERVICES as defined above or delineated in Attachment 'A'. SPECIAL SERVICES shall include, but not be limited to: a.) Subcontract charges not described in BASIC SERVICES or Attachment 'A'; b.) Trips and meetings beyond a 50-mile radius of Fort Worth; c.) Thomas Rutledge Title: Title: Principal Date: Date: October 11, 2007 'nt9 2 ATTACHMENT A' SCOPE OF SERVICES Project Description The site is generally located on the south side of Cromwell Marine Creek Road on a vacant tract of land. Approximately 3-acres will be developed in the northwest corner out of a 21.5-acre tract that will also include a future park facility to be developed later under a separate contract. The scope of this contract is for the design of public street improvements along the north and west frontage of the proposed tract. Currently Cromwell Marine Creek Road is a two-lane asphalt road with no curbs. The current roadway is located on the north half of the ROW; the ultimate section is a 110-foot right-of-way, 4-lane, median divided roadway. Crystal Lake Drive, the west roadway, is a proposed 100-foot right-of-way along the west property line; the ultimate section will be a four lane roadway. Public Street Improvement Plans: The scope of the contract is for preparation of plans and contract documents for improvements to and widening of Cromwell Marine Creek Blvd. and new improvements to the proposed 100-foot wide roadway along the west property line (street name pending). The improvements for both roadways will consist of 27-feet wide pavement along the south side of Cromwell Marine Creek Road and the east side of the 100-foot roadway; the limits of the improvements will be the length of the property frontage with pavements transitions as necessary. The plans and associated contract documents will be prepared in accordance with the City of Fort Worth guidelines and submitted for approval. The Consultant will meet with the City staff as necessary and make all necessary plan revisions to gain approval of the plans to allow for bidding and construction of the improvements. Once the plans are approved, the Consultant will assist the Client in bidding the im prvements, selection and award of the contract. Itemized Scope 1. Paving plan and profiles 2. Adopt the attached ordinance finding that a material change has occurred such that Proposition Three of the 2004 Capital Improvement Program for the Northwest Branch Library will include the addition of new road, Crystal Lake Drive, to gain access to the library and improvements to the Frontage Road, Cromwell Marine Creek Parkway, as required by the City's Subdivision Ordinance; and 2. Authorize the City Manager to execute Amendment No.1 to City Secretary Contract No. 35385 with Komatsu/Rangel, Inc., in the amount of$35,692, for additional design services to include roadway improvements to the north and road extension to the west of the library site, thereby increasing the total contract amount to $404,032.57. DISCUSSION: The 2004 CIP Proposition Three for library improvements included funding for land acquisition needed to build the Northwest Branch Library. Land was subsequently donated to the City via Mayor and Council Communication L-14469, approved on February 5, 2008. The land acquisition funds will be used to offset the cost to construct the new road and will not increase the cost of the Northwest Branch Library. On May 29, 2007, via Mayor and Council Communication C-22141, the City Council authorized the City Manager to execute a design and construction administration services agreement with Komatsu/Rangel, Inc., for the Northwest Branch Library, City Secretary Contract No. 35385. The proposed Amendment No.1 will include an increased scope to cover design of the additional road improvement (Cromwell Marine Creek Road) on the north side of the library site and new access road (Crystal Lake Drive) on the west side on the library. AN ORDINANCE FINDING THAT CONDITIONS HAVE MATERIALLY CHANGED SO THAT THE PROJECT SCOPE FOR THE CONSTRUCTION OF NORTHWEST BRANCH LIBRARY AS INCLUDED IN THE 2004 CAPITAL IMPROVEMENT PROGRAM MUST INCLUDE THE DESIGN AND CONSTRUCTION OF ROAD IMPROVEMENTS NEEDED TO ACCESS THE LIBRARY; AUTHORIZING THE 2004 CAPITAL IMPROVMENT PROGRAM FUNDS DESIGNATED FOR NORTHWEST BRANCH LIBRARY BE USED TO INCLUDE SUCH ACCESS; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on February 7, 2004, the citizens of the City of Fort Worth approved the 2004 Capital Improvement Program; and WHEREAS, the 2004 Capital Improvement Program included the construction of Northwest Branch Library in the Library Proposition; and WHEREAS, in order to accomplish the voted purpose of the Bonds, the construction project pertaining to the Northwest Branch Library must include provision for the access to such Librarv; and WHEREAS, staff recommends the 2004 Capital Improvement Program funds designated for the construction of Northwest Branch Library in the Library Proposition include the funds required to provide access to the site. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That the Citv Council finds that conditions have materially changed so that the construction of the Northwest Branch Library in the Library Proposition as included in _ the 2004 Capital Improvement Program must include the design and construction of road improvements required to access the library. SECTION 2. The City Council hereby authorizes the use of 2004 Capital Improvement Program funds designated for Northwest Branch Library in the Library Proposition, to include the design and construction of road improvements needed to access the library. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECITON 4. I It is hereby declared to be the intention of the City Council that the sections, I paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the as City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,paragraph or section. SECTION 5. This ordinance shall be in full force and effect upon adoption.
