COUNTY OF TEXAS § CITY SECRETARY CONTRACT NO. 9
WHEREAS, the City of Fort Worth ("City") and Jones & Boyd, Inc. ("Consultant") made
and entered into City of Fort Worth City Secretary Contract No. 35388, ("Contract"); and
WHEREAS, the Contract involves professional services for the following project:
Park Improvements at Oakmont Park and Clear Fork Park; and
WHEREAS, it has become necessary to amend the Contract to include an increased scope
of work and/or revised maximum fee.
NOW, THEREFORE, City and Consultant, acting herein by and through their
duly authorized representatives, enter into the following agreement which amends the contract:
1.
Article I, Section A of the Contract is amended to include the additional engineering
services specified in a letter dated February 18, 2008, a copy of which is attached hereto and
incorporated herein.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee in
the amount of $ 21,000.00, which is to be paid to Consultant for all work and services under the
Contract, as amended, so that the total fee to be paid by City for all work and services shall not
exceed the sum of $ 111,400.00.
3.
All other provisions of the Contract that are not expressly amended herein shall remain in
full force and effect.

RE: Additional Services Proposal for Floodplain Engineering Services

Dear Mr. McElhany:
Thank you for permitting us the opportunity to submit this proposal for floodplain engineering
services on the referenced property. This proposal is based on providing a CLOMR and follow-up
LOMR for three future trail crossings located within Oakmont Park west of Bellaire South Road.Two
of the trail crossings are located on Stream CF-6,which is designated as a Zone AE floodplain with a
floodway. The third trail crossing is located on an un-named tributary designated as a Zone A
floodplain.Based on our conversations and the information provided to us, we propose the following
scope of services:
1. Conditional Letter of Map Revision(CLOMR)—We will prepare a narrative drainage report
requesting a CLOMR based on the proposed hydraulic analysis above. The report will document
the procedures and findings of our analysis. Typical FEMA approval time for a CLOMR ranges
from six(6)to twelve(12)months after City acceptance and signature. Please note, all FEMA
review fees are required upon submittal and will be paid by the City.
2. Meetings/Coordination—We will attend meetings with you and public agencies to coordinate,
present and answer questions regarding the drainage study and other engineering issues as well as
coordinate the submittals with City staff and FEMA.
3. As-Built Survey—We will provide a one-time survey of the bridges to establish the constructed
condition. The elevation data will be used to reflect as-built condition in the hydraulic model.
4. As-Built Letter of Map Revision(LOMR)—We will update the hydraulic models based on the
as-built information. We will prepare and submit a narrative report requesting an As-Built LOMR
from FEMA. We will also coordinate with FEMA regarding comments, public notices and the
map revision process. Typical FEMA approval time for an As-Built LOMR ranges from six(6)to
twelve(12)months after City acceptance and signature.

SUMMARY OF FEES
For the scope of work described herein,we propose to be compensated as shown on attached Exhibit
"A".Next to each work item,we have noted whether the fee is either a lump sum or hourly. If the fee
is noted to be hourly,the amount shown is an estimate because the time necessary to complete the
task is unknown. Hourly based fees will be billed in accordance with the attached Hourly Fee
Schedule,Exhibit"B".For your budgeting purposes,an estimated fee has been shown for hourly-
based fees.
Non-labor expenses will be charged at cost plus ten(10%)percent.These expenses include all
necessary and related non-labor expenses incurred by Jones&Boyd, Inc.,which are directly
chargeable to the work.These generally include expenses for reproduction, deliveries and filing fees.
The terms and conditions of our current contract shall apply to the work described in this proposal.
Services which are not expressly written in this agreement will be considered additional services.
Jones&Boyd, Inc.will not proceed with any additional services without your prior authorization.
This proposal is valid for sixty(60)days from the date of its submittal; if not accepted by the end of
the 60-day period, it is subject to change, renegotiation or withdrawal at the option of Jones&Boyd,
Inc.
If this proposal is acceptable, please signify your acceptance below by initialing each page of the
attached exhibits. Please return one fully executed original to us.
