Schultz, Inc. dba Circle C Construction Company, authorized to do business in Texas, ("Contractor"), entered into that certain ORIGINAL AGREEMENT (City Secretary #47793, M&C C-27702) for the PROJECT generally described as: Sanitary Sewer Pipe Enlargement Contract 2015A, City Project No. 2737; and WHEREAS, the ORIGINAL AGREEMENT may be renewed up to three times as provided by M&C C-27702; and WHEREAS, The City and Contractor, anticipating the need to do so, renewed the ORIGINAL AGREEMENT on January 9,2018,- and WHEREAS, The City has not had the need to engage Contractor under the First Renewal as demand for the services to be provided have slowed and funding under the ORIGINAL AGREEMENT remains; and WHEREAS, The City and Contractor desire to amend this First Renewal to provide for an extended term, thus allowing an immediate transition from the ORIGINAL AGREEMENT to this First Renewal. NOW, THEREFORE, it is agreed by the City and Contractor as follows: Article I The Term of the First Renewal shall be effective as of the effective date as stated thereon and be for a duration commensurate with the expenditure of the funding, but in no event shall the agreement last Ionger than five years from the effective date. DISCUSSION: The work to be performed under this contract consists of replacing sewer mains, services and other pertinent construction by tnanch|ase methods to provide sewer service to individual uuatunneno or developers. The bid documents included a stipulation that the total quantities listed may not reflect actual quantities and that the amount budgeted for the project in$1.O0O.00O.DD. Final payments will bo made based nnthe unit prices established by the bid and actual measured quantities installed. The bid documents also included o stipulation giving the City the option to renew (subject to appropriated funding) this contract two times under the same terms, conditions and unit prices. Schultz, Inc. d/b/a Circle C Construction Company, is in compliance with the City's BDE Ordinance by committing to zero percent MBE participation and documenting good faith effort. William J. Shultz, Inc. d/b/a Circle C Construction Company, identified several subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did not submit the lowest bids. The City's MBE goal on this project is 11 percent. This project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund. The Fiscal Year 2016 Sewer Operating Budget includes appropriations of$26,300,046.00 for the purpose of providing pay-as-you-go funding for Sewer Capital Projects. After this transfer for Fiscal Year 2016, the balance will be $16,561,660.00.
