TO CITY SECRETARY CONTRACT
the City of Fort Worth (CITY) and Hazen and Sawyer,
P.C . , (ENGINEER) made and entered into City Secretary Contract No. 46465,
(the CONTRACT) which was authorized by
M&C C-27183 on the 211 day of February, 2015 in the amount of $196, 485 . 00;
and
WHIIIII&EAS,the CONTRACT was subsequently revised by: Amendment No.
1 in the amount $38, 914 . 00 which was administratively authorized
September 28, 2015 and Amendment No. 2 in the amount of $22 , 384 . 00 which
was administratively authorized April 12 , 2017; and
NMERAS, the CONTRACT involves engineering services for the
following project:
Sanitary Sewer Rehabilitation, Contract 90 ; and
V MIEA M , it has become necessary to execute Amendment No.3 to
the CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal letter dated June 29, 2019,
a copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $145, 400 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an increase
in the fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City
for all work and services shall be an amount of $403 , 183 . 00

amended herein, shall remain in full force and effect.

Dear Walter:
As a requested,we have prepared a are revised scope of services for Amendment No. 3 for Sanitary
Sewer Rehabilitation Contract 90. This amendment is for revising the 100%design package and dividing
the current project into three separate bid packages:
1. CIP Package—Design drawings to be incorporated into another project for street
improvements
2. Package 1 —Standalone bid package requiring no easements for bidding in the near term
3. Package 2—Standalone bid package requiring 43 easements to be bid at later date once
easements are obtained
The amendment is for following services:
CIP Package and Package 1
1. Divide 5 design sheets for inclusion into a CIP Package by another consultant.These plans are
for L-3208 and L-7113. No other sheets (index,control points and key map, and erosion
control plans)will be required for this package. No bidding services will be provided for this
package.
2. Divide 21 design sheets and associated index, control points and key map and erosion control
plans into Package 1.
3. Estimate an additional 12 months of project management.
4. No easement documents are required for this package
5. Eliminate segments within Weiler Boulevard that require significant pavement replacement
and retain only segments that terminate and are perpendicular to Weiler Blvd,which require
limited paving replacement.
6. Change from open cut to pipe bursting for mains under streets per city comment from 100%
design submittal.

7. Redesign a portion Segment L2307 to relocate line into existing easement per city comment
from 100% design submittal.
8. Redesign segments in Tierney Road from pipe bursting to open cut since the street will be fully
replaced per city comment from 100%design submittal.
9. Add note to drawings indicating owner information is based on survey received on February
28,2017 and provide an excel spreadsheet with updated property owner information for use by
COFW.
10. Revise opinion of probable construction cost(OPCC)for design changes and separate into
specific OPCC for CIP and Package 1.
11, No additional bid services for CIP package. Any construction support required for the CIP
package will be handled out of the original contract scope budget.
12. Bid and construction services for Package 1 are included in the original contract scope.
13. Provide list of affected property owners in excel to be used by COFW for public meeting
notification.
14. Provide excel table with property owners to be used by COFW for temporary right of entry
notification letters.
Package 2
1. Divide 14 design sheets and associated index, control points map and erosion control plans
into Package 2.
2. Estimated an additional 24 months of project management.
3. Prepare 43 easements documents for all segments not currently within easements
4. Add note to drawings indicating owner information is based on survey received on February
28,2017 and provide an excel spreadsheet with updated property owner information for use
by COFW.
5. Revise opinion of probable construction cost(OPCC) for design changes and separate into
specific OPCC for Package 2.
6. Add additional bid and construction services to support for Package 2.
7. Provide list of affected property owners in excel to be used by COFW for public meeting
notification.
8. Provide excel table with property owners to be used by COFW for temporary right of entry
notification letters.

The original contract between Hazen and Sawyer and the City of Fort Worth(Contract 46465)was
authorized by M&C C-27183 on February 26,2015 in the amount of$196,485.00. The cost to the City
for additional design services to be performed by Hazen and Sawyer totals$38, 914.00 for Amendment
No. 1 and$22,384.00 for Amendment No, 2(M&C C-28153)and$145,400.00 for Amendment No. 3
resulting in a revised total of$403,183.00 as shown in the table below.

Within the Central Meadowbrook and Handley Neighborhoods and Adopt Appropriation Ordinance(COUNCIL DISTRICTS 5 and 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects
Fund in the amount of$405,400.00 from available funds;and
2. Authorize execution of Amendment No.3 to City Secretary Contract No.46465,an Engineering Agreement with Hazen and Sawyer, P.C.,in
the amount of$145,400.00 for a revised contract in the amount of$403,183.00 for the Sanitary Sewer Rehabilitation,Contract 90(City
Project No.CO2382).
DISCUSSION:
On February 10,2015 Mayor and Council Communication(M&C C-27183),the City Council authorized the execution of an Engineering
Agreement with Hazen and Sawyer,P.C., in the amount of$196,485.00 for the preparation of plans and specifications for the Sanitary Sewer
Rehabilitation, Contract 90 project.The agreement was subsequently revised by Amendment No.1 in the amount of$38,914.00 administratively
authorized September 28,2015 and Amendment No.2 in the amount of$22,384.00 administratively authorized on April 12,2017.
Amendment No.3 will provide for additional design services on the project and preparation of the easement documents that are now necessary for
the sanitary sewer mains located on private property.In addition to the amendment amount$260,000.00 is required for real property acquisition,
additional project management and utility coordination.
M/ BE Office—Hazen and Sawyer, P.C.agrees to maintain its initail SBE commitment of 33 percent that it made on the original agreement and
extend and maintain that same SBE commitment of 33 percent to all prior amendments up to and inclusive of this Amendment No.3. Therefore
Hazen and Sawyer remains in compliance with the City's BDE Ordinance and attest to its commiment by is signature on the Acceptance of
Previous SBE Commitment from executed by an authorized representative of its company.
The project is located in COUNCIL DISTRICTS 5 and 8.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds
will be available in the Fiscal Year 2019 capital budget,as appropriated,of the Water and Sewer Capital Projects Fund.The Fiscal Year 2019
Water and Sewer Operating Budget includes appropriations of$35,856,873.00 within the Wastewater Operating Budget for the purpose of
providing Pay-As-You-Go funding for Sewer Capital Projects.After this transfer for Fiscal Year 2019,the balance will be$13,765,527.00.
