AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
LUBBOCK AVENUE AND AN ALLEY, LOCATED IN THE M.J. AROCHA
SURVEY, ABSTRACT NO. 2, TARRANT COUNTY, TEXAS, AS SHOWN
ON LOT 1R1, BLOCK 4 AND BLOCK 6, TCU ADDTION AND BLOCK 20,
PROSPECT HEIGHTS ADDITION, ADDITIONS TO THE CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN THE
PLATS THEREOF RECORDED IN CABINET A, PAGE 4484 AND
VOLUME 63, PAGE 59 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS, CONTAINING APPROXIMATELY 339607 SQUARE
FEET OR 0.7715 ACRE AND 89797 SQUARE FEET OR 0.2020 ACRES
RESPECTIVELY OF LAND MORE OR LESS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Lubbock Avenue (a sixty foot public right-of-way) and an alley, located
in the M.J. Arocha Survey, Abstract No. 2, Tarrant County, Texas, as shown on Lot 1R1, Block
4 and Blocks 6, TCU Addition and Block 20, Prospect Heights Addition, additions to the City of
Fort Worth, Tarrant County, Texas, as shown in the plats thereof recorded in Volume 63, Page
59 and Cabinet A, Page 4484 of the Plat Records of Tarrant County, and containing
approximately 33,607 square feet or 0.7715 acre and 8,797 square feet or 0.2020 acres
respectively of land more or less, and as more specifically described in Exhibits "A" and `B"
attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby

released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Addition, an addition to the City of Fort Worth according to the plat recorded in Document Number
D218051013, Official Public Records of Tarrant County, Texas, as shown on Block 6, TCU Addition, an addition
to the City of Fort Worth according to the plat recorded in Cabinet A, Page 4484, Plat Records of Tarrant
County, Texas and as shown on Prospect Heights, an addition to the City of Fort Worth according to the plat

BEGINNING at a 'Y" cut in concrete In the south right—of—way line of West Lowden Street (60' wide) and the

Adopt Ordinance Vacating a Portion of an Alley in Block 20,Prospect Heights Addition and a Portion of Lubbock Avenue Between West Cantey
Street and West Bowie Street to be Replatted with the Adjoining Property for Improved Pedestrian and Bicycle Safety and Movement Through the
TCU Campus(COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of an alley in Block 20,Prospect Heights Addition and a portion of Lubbock Avenue
between West Cantey Street and West Bowie Street to be replatted with the adjoining property for improved pedestrian and bicycle safety and
movement through the TCU campus;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates,on behalf of TCU,has requested vacation of this portion of an alley and Lubbock Avenue to be replatted for improved
pedestrian and bicycle safety and ciruclation in and around the new Neely School of Business.The City Plan Commission recommended approval
of this request at its meeting on October 23,2019.An acceptable final plat(FS-19-141)has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street and alley.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
