AN ORDINANCE RELEASING TERRITORY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF FORT WORTH, TEXAS; MAKING THIS ORDINANCE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That the City of Fort Worth hereby relinquishes all extraterritorial juris- dictional authority and rights over the following described territory under the provisions of the Municipal Annexation Act (Article 970a, Revised Civil Statutes of Texas), said territory being described by metes and bounds as follows: PARCEL NO. 1. BEING a tract of land situated about 12 miles northeasterly from the Courthouse of Tarrant County, Texas, lying in the Jose Chirino Survey, Abstract No. 265, William Huff Survey, Abstract No. 649, Jesse Billingsley Survey, Abstract No. 70, and John Edmonds Survey, Abstract No. 457, and being more particularly described as follows: Beginning at a point for corner in the west City Limit Line of the City of Keller, Texas, at its intersection with the south right of way line of Price Street (State Farm to Market Highway No. 1709). THENCE west along the south right of way line of State Farm to Market Highway No. 1709, and along said line produced west to a point for corner in the west right of way line of Keller-Katy Road (County Road No. 4098) produced south. THENCE north, to and along the west right of way line of Keller-Katy Road (County Road No. 4098) to a point for corner at its intersection with the north City Limit Line of Keller, Texas, as established by Keller Ordinance No. 15, October 15, 1959, produced west. THENCE east to a point for corner, the southerly northwest corner of Keller City Limits, being also the northwest corner of the tract annexed by Keller Ordinance No. 15. THENCE south, along the west line of the tract annexed by Keller Ordinance No. 15, and continuing south along the west City Limit Line of Keller, Texas to the place of beginning and containing approximately 16 acres. Peck Survey, Abstract No. 1210 and being more particularly described as follows: • f BEGINNING at the most southerly southeast corner of the City Limit Line of the City of Keller, Texas, said corner being the southeast corner of a tract of land annexed to the City of Keller by Ordinance No. 13 on May 21, 1959: THENCE North along the City Limit Line of the City of Keller, Texas as estab- lished by Ordinance No. 13 a distance of approximately 900 feet to its inter- section with the south right of way line of Keller Shady Grove Road (County Road No. 3001) produced West: THENCE East, to and along the South right of way line of Keller Shady Grove Road (County Road No. 3001), and continuing in an Easterly, Southerly and Easterly direction along said right of way line to its intersection with the westerly right of way line of State Farm to Market Highway No. FM 1938. THENCE Northeasterly and Northerly along the Northwesterly and Westerly line of State Farm to Market Highway No. 1938 and Caldwell Hughes Road (County Road No. 3035) to its intersection with the North right of way line of Florence Road (County Road No. 4088). THENCE Southerly and Westerly along the Westerly and Northerly right of way line of Ottinger Road (County Road No. 4057) to its intersection with the East line of the D. Barcroft Survey, Abstract No. 141. THENCE to, and along, the City of Keller City Limit Line as established by Ordinance Numbers 22, 21, 31 , 32 and 13; South, East, South, Southwest, South, West and South to the place of beginning, and containing approximately 5 square miles. SECTION 2 That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3 That if any section, subsection,clause, sentence, phrase or word of this ordinance is for any reason held void or unconstitutional by a court of competent juris- diction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases or words except as the same are in- separable from and indispensable to the remaining portions of the ordinance. SECTION 4 That this ordinance shall become effective and shall be in full force and effect from and after its passage and it is so ordained. City of Fort Worth, Texas UNE MORPHIS Mayor ayo U and Council Communication DATC' REFERENCE SUBJECT: Release of Extraterritorial PAGE SWAM NUMBER Jurisdiction Keller Area 1 /17/69 PZ-327 Iof 1 The City Plan Commission at its regular meeting on February 26, 1969, recom- mended that the City of Fort Worth release extraterritorial jurisdictional rights in an area east of Keller plus one block west of its business area, as shown on the attached exhibit. Representatives of Keller requested that Fort Worth consider the release of the subject territory, which was recommended by the City Plan Commission as well as territory north of Keller, which release was not recommended by the City Plan Commission. 1964 Apportionment In July, 1964, as a result of a boundary adjustment, the City of Keller released all of its extraterritorial jurisdiction to Fort Worth. For Keller to grow and expand in any direction, it must obtain the consent of the Fort Worth City Council. The area the City Plan Commission recommends for release to Keller drains to the east, in the Bear Creek Watershed and it would be economically unfeasible for Fort Worth to provide sanitary sewer service. Jurisdiction of Other Cities The description contained in the ordinance which is being presented for Council consideration embraces an area which lies partly within an area claimed by the City of Lakeside. This release of jurisdiction will not affect Lakeside but will permit identification of the eastern boundary of the area by public roads which can easily be identified on the ground. The area recommended for release lies within the overlapping extraterritorial jurisdiction of Fort Worth, Keller, Lakeside, North Richland Hills , Colley- ville and possibly Hurst. The boundaries of all these cities, and their extraterritorial jurisdiction, cannot be precisely determined without exten- sive research and is presently in dispute. The recommended area is so far removed from Fort Worth facilities and services that the need for annexation by Fort Worth is considered unlikely. Recommendation It is recommended that the area illustrated on the attached map and described in the proposed ordinance be relinquished from Fort Worth's extraterritorial jurisdiction in concurrence with the City Plan Commission's recommendation.
