AN ORDINANCE AMENDING ORDINANCE NO. 5170,
WHICH IS AN ORDINANCE REGULATING UNSAFE
AND HAZARDOUS COMMERCIAL BUILDINGS IN THE
CITY, BY INCREASING THE MEMBERSHIP OF THE
COMMERCIAL BUILDINGS STANDARDS BOARD FROM
THREE TO FIVE; BY PROVIDING QUALIFICATIONS
FOR THE TWO ADDITIONAL MEMBERS; FIXING
PENALTIES; MAKING THIS ORDINANCE CUMULATIVE
OF OTHER ORDINANCES REGULATING COMMERCIAL
BUILDINGS; PROVIDING A SEVERABILITY
CLAUSE; DECLARING THE ENFORCEMENT HEREOF
TO BE GOVERNMENTAL; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
Section 5 of Ordinance 5170 is hereby amended, and after having been so
amended shall hereafter read as follows:
"There is hereby created a Commercial Buildings Standards
Board, which shall consist of five members, all of whom shall
be appointed by the City Council. Each member of the Board
shall be a resident of the City of Fort Worth and shall serve
without pay for a term of two (2) years or until his successor
is appointed and qualified. Positions on the Commercial Build-
ings Standards Board shall be designated as Place 1, Place 2,
Place 3, Place 4 and Place 5. Members of the Board who occupy
each respective Place shall possess qualifications as follows:
"Place 1. A registered architect.
"Place 2. A registered professional engineer.
"Place 3. A contractor who has owned or managed a
commercial building contracting business
in the City of Fort Worth for at least
five (5) years prior to his appointment
to the Board.
"Place 4. A person having experience and qualifi-
cations to pass on matters involving,-
public health and welfare.
"Place 5. A person having experience in business or
public affairs."
SECTION 2.
Any person, firm, corporation or any agent or employees thereof who
violate any of: the provisions of this ordinance shall be deemed guilty of
a misdemeanor and, upon conviction thereof, shall be fined not to exceed
Two Hundred and Nof100 Dollars ($200.00) for each offense. Each day that
a violation is permitted to exist shall constitute a separate offense.

SECTION 3.
This ordinance shall be and is hereby declared to be cumulative of all
other ordinances of the City of Fort Worth regulating unsafe and hazardous
commercial buildings in the City, and this ordinance shall not operate to
repeal or affect any of such other ordinances except insofar as the pro-
visions thereof might be inconsistent or in conflict with the provisions
of this ordinance, in which event such conflicting provisions, if any, in
such other ordinance or ordinances are hereby repealed.
SECTION 4.
If any section, subsection, sentence, clause or phrase of this ordinance
is for any reason held to be unconstitutional, such holdings shall not affect
the validity of the remaining portions of this ordinance, and all of the
remainder of this ordinance not so held to be unconstitutional shall continue
to be in full force and effect.
SECTION 5.
All of the regulations provided in this ordinance and in Ordinance No.
5170 are hereby declared to be governmental and for the health, safety and
welfare of the general public. Any member of the City Council, any city
official or employee charged with the enforcement of this ordinance, acting
for the City of Fort Worth in the discharge of his duties, shall not there-
by render himself personally liable, and he is hereby relieved from all
personal liability, for any damage that might accrue to persons or property
as a result of any act required or permitted in the discharge of his said
duties.
SECTION 6.
This ordinance shall take effect and be in full force from and after
its passage and publication as required by law.
