NHERHAS, it appearing to the City Council of the City of Fort Worth; Teas,s, that the alley hereinafter de- scribed, although a duly dedicated and accepted alley for use by the public, has in fact never been used by the pub— lic and that it is to the beau interest to the public that said alley be closed, abandoned and vacated as a poblie thoroughfare and the fee to the land in said alley eonvey- ed to the abutting property oeners. NOW$ THffi FORE, BE IT ORDAINED BT THE CITY COMM OF THE CITY OF FORT NORTH: SECTION I. That an alley extending nortWly and southerly through. Block Semen (7) and the north fifty feet of Block One (1) to a point in said Block One (1) two hundred and fifty feet north of the north Line of Tenth Street, Hirsch- field Addition to the City of Fort North, Tarrant County Texas, be and the same is hereby vacated, closed and per- manently abandoned as an alley or public thoroughfare of any kind or character whatever. SIE T ION II. That the rights of all public utilities hereto- fore asquired by said utilities for the purpose -of con- straoting and maintaining service lines shall not be din- turbed, d4atroAd, revoked or abrogated by any of the pro- visions of this ordinance but said rights as above set out shall remain in fill force and effect. SECTION III. That the fee to the lead in said alley be hereby released and conveyed in equal parts to the abutting prop- erty owners on said alley. SECTION IQ. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION V. A. Wheeler, Am. Bryce, A. S. Newell, Fort Worth Welfare Association, Mrs, Ida L. Turner, Minnie Nash Parker, James Nash, L. P. Robertson, Mary P. Lamb ( widow of Robert J. Lamb), C. C. Gum and Congregation Ahavath Sholom, who are the only persons interested in property abutting upon that(certain alley�wey extending Northerly and Southerly throeg;h Blocks Seven (7) and One (1), of Hirshfielda Addition to the City of Fort Worth, Tarrant County, Texae)which said alley-way extends from the boundary South boundary line of West Seventh Street to the North/line of Tenth Street, said Tenth Street being formerly designated on the maps of the City of Fort Worth as Jackson Street, do hereby petition this Honorable Body to close and vacate (that portion of said ell #3ct81lt ng-tbyoa�t-sat$ al"kNo, Seven-47) and through the North 50 feet of said Block No. One (1) to a point in said Block No. One (1) 2 50 feet North of the North line of tenth Street for the following reasons, to-wit: -tilt, 0bov4 do soti btA. perti•n of Becauseysaid alley no lon@ar serves any useful pur- pose, and is one not used by the general public, but when used was used by the owners of the abutting property owners, who are the petitioners herein. Because, as petitioners are advised, it. is the purpose of the City, in the near future, to widen Throclanorton Street frm the South line of Seventh Street approximately One Hundred Seventy- five feet (175), in which event the space necessary to effect such widening will necessarily have to be taken from the East side of Block No. Seven (7) ;n Hirshfield's Addition as aforesaid, and therefore it would become necessary to utilize said alley for building purposes. Y •r � Petitioners further aver that no one has an interest in said alley but your petitioners and said alley-way has always been is a nature of a private alley so far as its use is concerned, not having been used by the Public generally for traffic. wherefore,the promises considered, your Petitioners pray that said above described portion of said alley be closed, vacated and abandoned, and that an Ordinance to that effect be duly drawn and be enacted by your Honorable Body as your, petitioners will ever pray.
