HomeMy WebLinkAboutOrdinance 23994-12-2019 Ordinance No. 23994-12-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRANSPORTATION IMPACT FEE FUND IN THE AMOUNT OF $3,000,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF THE NORTH RIVERSIDE DRIVE FROM NORTH TARRANT PARKWAY TO OLD DENTON ROAD PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Transportation Impact Fee Fund in the amount of$3,000,000.00, from available funds, for the purpose of The North Riverside Drive From North Tarrant Parkway To Old Denton Road Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The 2014 Bond Program provides funding for improvements to North Riverside Drive from a two-lane roadway to a four-lane divided arterial street between North Tarrant Parkway and Old Denton Road. Two new travel lanes will be constructed on the west side of the existing roadway and the existing east half is designated to be rehabilitated or replaced where new pavement is warranted.The project includes turn lanes,median openings,sidewalks,streetlights,roundabouts and shared use paths as necessary to improve overall connectivity. The majority of the construction contract will be funded through the 2014 Bond Program.Available resources within the General Fund will be used to provide interim financing for these expenses until debt is issued.Once debt associated with this project is sold,bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.21241-05-2014). In addition to bond funds,transportation impact fee revenues will be used to fund the construction of the western half of the roadway. Transportation impact fees will be used to complete the construction of N Riverside Dr,as well as acquire right-of-way,design and construct the northern lanes of Summerfields Blvd from N Riverside Dr east to Cannonwood Dr. This project is located in Transportation Impact Fee Service Area D and was included in the adopted 2017 Transportation Impact Fee Study as projects D-21,D- 29, D-30 and D-31. North Riverside Drive from North Tarrant Parkway to Old Denton Road was advertised August 15,2019 and August 22,2019 in the Fort Worth Star-Telegram. On September 19,2019 the following bids were received; Contractor Total Bid McMahon Contracting LP $8,907,940.57 Texas Bit $10,193,295.71 Pavecon Public Works $10,448,076.19 Texas Sterling Construction Company $11,050,756.55 Jackson Construction $11,893,486.75 The project will begin in Spring 2020 and is scheduled to be complete in Summer 2021. The Right-of-Way and traffic divider maintenance impact is expected to begin in June 2021. Beginning in Fiscal Year 2021,the Right-of-Way and traffic divider maintenance impact is anticipated to be$3,915.00 annually. This additional appropriation for this project was not included in the FY2020-2024 Capital Improvement Plan. Recently an opportunity was identified to leverage transportation impact fees and expand the project scope. The action in this M&C will amend the FY2020-2024 Capital Improvement Plan. MWBE OFFICE-McMahon Construction is in compliance with the City's BDE Ordinance by committing to 15.00%MBE participation on this project. The City's MBE goal on this project is 15%. The project is located in COUNCIL DISTRICT 4. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the Transportation Impact Fee Capital(Trans Impact Fee Cap)Fund,and the Stormwater Capital Projects Fund.Prior to an expenditure being incurred,the Transportation&Public Works Department has the responsibility of verifying the availability of funds.
