ORDINANCE NUMBER �.
An Ordinance ratifying the action of the Corporation
Counsel of the City of Fort Worth in filing condemnation
proceedingsq to condemn certain property in Tarrant County,
TexaeyAto Wm. Charbohneau and rife, and declaring the
necessity for the use of such land for the purpose of con-
structing and maintaining the West t-ork Weserviir.
BE IT ORDAINDED BY THE BOARD OF COMMISSIONERS OF
FORT WORTH, TEXAS:
SECTION ONE.
THAT WHEREAS, it is necessary for the purpose of
supplying water to the citizens of the City of Fdrt North
and for fire protection for said City, to construct a
reservoir near said City and to take and use certaih lands
which will be submerged by water by reason of the con-
struction of a dam to empound water in said reservoir, and
to take and use certain other lands contiguous to the line
of said reservoir, for the purpose of properly maintaining
same and of having access thereto and to prevent contamina-
tion of the waters in said reservoir, and -
WHEREAS, by proper order of this Body a Board of
Engineers has been appointed to locate said reservoir, and
the same has been located by said Engineers on the West
fork of the Trinity River, in Tarrant County, Texas, which
action has been ratifie-1 by this Body, and -
WHEREAS, for the purposes aforesaid, it is necessary
for said City of Fort Worth to take and use the fb llowing
tracts of land located in Tarrant County, Texas, and belonging
to Wm. CHARBOTINEAU and wife OCTAVIA CHARBONNEAU, towit:
1st. Tract:
40 acres of J. U. Basquiz survey,
beginning at the NW corner of said survey; thence
East with North line of said Survey 980 vrs; thence
S 232 vrs; thence West parallel,,�ith North line
of said Survey 722 vrs to West Mork of Trinity
River; thence Northwesterly with the meanderings
of said River to place of beginning.
2nd. Tract:
60 acres of Wm. Townsend Survey,
beginning at SW corner of said survey and NW corner
of Basquiz survey; thence East with South line
of Townsend Survey and North line or—Basquiz survey
980 vrs; thence N 327 vrs to West fork of Trinity
River; thence Southwardly with the meanderings of
said River to place of beginning.
Said two above mentioned tracts being
described in Volume 111, page 434, Deed Records of
Tarrant County, Texas.
3rd. Tract:
204 2/10 acres of Ym. Townsend survey,
beginning on S line of said survey 980 vrs E to its
SW corner; thence East with said South line 1985 ♦rs
to a point a mound of stone 75 vrs East of a dee�
spring branch; thence N 32 W 114 1 2 vrs; thence
N 66 W 235 vrs to a stone marked " ; thence N
21 1/2 W 470 vrs to a stone marked "Yr at turn of
road on top of hill; thence N 32 W 311 vrs to
middle of channel of West fork of Trinity River
under W side of Ututtg *Nine Mile* Bridge; thence
Southwesterly with the meanderings of said river to
NE corner of above described 60 acre tract; thence
S with the E line of said 60 acre tract 327 vrs to
place of beginning.
AND, WHEREAS, this Body has heretofore
authorized and directed the Corporation Counsel of said City
to file condemnation proceedings on behalf of said City of
Fort Worth, for the purpose of condemning said property for
the above named purposes and uses, 4w, and said Corporation
Counsel did on or about the day of January, 1912, file
such condemnation proceedings, which proceedings are now
#0.
pending in the County Court of Tarrant County, Texas, For
Civil Cases, and -
iTHEREAS, the records of said City do not disclose any
Ordinance of this Body authorizing and directing the filing
of such condemnation proceedings:
NOW THEREFORE, said Board of Commissioners does hereby
declare it necessary and properrf or the City of Fort Worth to
condemn and use said lands for the purposes aforesaid, and
said City having failed to agree with the owners thereof as
to its value, the action of said Corporation Counsel in
filing and prosecuting said condemnation proceedings, is
hereby in all things ratified and confirmed, and it is hereby
expressly declared that suc L proceedings were instituted at
the direction of the Board of Commissioners of said City; and
said Corporation Counsel is hereby instructed and directed to
prosecute said condemnation proceedings to a final Judgment.
SECTION TWO.
This Ordinance shall take effect and be in force from
and after its passage.
I hereby certify that the above and fore going ordinance
was duly presented and unanimously passed and adopted by the
Board of Commissioners of the City of Fort Worth at a session of
said. Board held Saturday March 30th,1913.
