ORDINANCE ACCEPTING IMPROV NTS ON A PORTION OF WEISENBERGER STREET AND PORTIONS OF SUNDRY OTE M STR STS, AVENUES AND PUBLIC PLACES IN THE CITY OF FMT WORTH, TEXAS; ILCLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROV 1aNTS FULLY COMPLETED A-MD PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CMTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIM AFTER GIVING EFFECT TO SUIRMY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS OB=?ANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THV CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AMP MFPCTIVE DATE. WIMEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with TEXAS BITULITHIC COMPANY for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public plades in said City, to-wit: UNIT 1: WEISENBERGER STREET From Carroll Street to Vacek Street, known and designated as Unit 1, Pro- ject No. 104-24000-211. UNIT 2: FOCH STREET From Whitmore Street to White Settle- ment Road, known and designated as Unit 2, Project No. 104-24000-211. UNIT 3: LITTLEPAGE STREET From Blackmore Avenue to Libbey Avenue, known and designated as Unit 3, Project No. 104-24000-211. UNIT 4: SLOCUM AVENUE From Joyce Drive to Highway 183, known and designated as Unit 4, Project No. 104-24000-211. UNIT 5: BROADMOOR DRIVE From Highway 80 to West Elizabeth Lane, known and designated as Unit 5, Project No. 104-24000-211. r WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6402 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6402 a and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the-true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Name: Assessment Paving at Five Locations on the West Side Project No. 104-24000-211 Contractor: Texas Bitulithic Company Contract Awarded: November 9, 1970, (M&C C-1861) Work Order Issued: January 26, 1971 Work Order Effective: February 5, 1971 Work Began: February 2, 1971 Date of Final Inspection and Approval: July 9, 1971 Working Time Bid: 75 Working Days Working Time Used: 65 Working Days Project Cost and Financing Original Bid Price: $71,169.00 Change Order No 1: + 351.00 (A.R. 1-15, 2.3, 2/17/71) Change Order No. 2: - 557.40 (A.R. 1-15, 2.4, 8/17/71) Change Order No. 3: - 115.20 (A.R. 1-15, 2.3, 8/25/71) Revised Bid Price: $70,847.40 Final Contract Cost: $65,363.44 Less Penalty for Deficient Paving -412.96 $64,950.48 Partial Payments Previously Made: 5, Amount: $58,734.00 Final Payment Due: $6,216.48 Sufficient funds are available for the final payment to be made from Project Number 104-24000-211. Deviation from Bid Price: The final contract cost of this project is $5,483.96 under the revised bid price. A major portion of the savings, $3,750.00 resulted because 6" metal pipe sub drain was found to be unne- cessary, and a savings of $851.69 was realized because it was not necessary to adjust as riany utilities as anticipated. The remaining cost difference $882.27, is attributed to minor variations between quantities estimated in the contract documents and a a:t=t: vs Tactually r.e«�ured and used at the job site. DATE REFERENCE SUBJECT: Final Payment - Assessment Pavi g PAGE NUMBER at Five Locations on the West 2 or 2 10 18 71 FP-831 Side Compliance with Specifications Tests made during construction show that materials used and required thickness was in compliance with contract specifications except on one unit, and on this unit the contractor was penalized as provided in the contract specifications. Recommendations It is recommended that the project described be accepted by the adoption of an ordinance and that final payment of $6,216.48 be authorized to the Texas Bitulithic Company.
