HomeMy WebLinkAboutOrdinance 5569 ORDINANCE NO.AN ORDINANCE AMENDING ORDINANCE NO. 3011 , THE COM- PREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BY AUTHORIZING A USE APPLICABLE TO APPROXI- MATELY 158.6 ACRES OF LAND AND ZONING THE SAME FOR EDUCATIONAL PURPOSES; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN FIVE DOLLARS ($5.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200.00) FOR VIOLATION HEREOF AND THAT EACH DAY A VIOLATION EXISTS SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be amended so that the use permitted in the following described area be altered, changed and amended from "A" One-Family Residential to "Educational Purposes" and restricted to educational purposes: Z-66-31 Tract 2, S. Woody Survey, and portions of Tracts 1-A-1 , E. Rogers; Tract 1 , W.L. Crow; and Tract 1, N. Atterbury surveys, (City Tax Records)(Loop I-820 at Proposed South Industrial Boulevard), more fully described as follows: BEGINNING at a 1-1/4 inch iron in the northeasterly line of the right-of-way for Interstate Highway No. 820 conveyed to the State of Texas by Deed recorded in Volume 3308, Page 619 of said deed records, and said iron being the south- easterly corner of the 19-404/1000 acres defined as the Second Tract in the deed to E.E. Cloer General Contractor, Inc. recorded in Volume 4033, Page 139 of said deed records. THENCE along the easterly line of said Second Tract, being the easterly line of the proposed South Industrial Thoroughfare as same is marked on the ground; North 25°54' West, 525-2/10 feet to a 1-1/4 inch iron; North 61054' West, 145-1/10 feet to a 1-1/4 inch iron; North 17020' West 115-14/100 feet to a 1-1/4 inch iron; and then northerly along a curve to the left, with a radius of 1404-36/100 feet and whose long chord bears North 11°19' West 949-27/100 feet, a distance of 968-3/10 feet to a 1-1/4 inch iron; and then North 31005' West, 1195-9/10 feet to a 1-1/4 inch iron. THENCE South 87°42' East, 3026-6/10 feet to a 1 inch iron. THENCE South O°11 ' East 3453-2/10 feet to a 1 inch iron in said northeasterly line of the right-of-way of Interstate Highway No. 820. THENCE along said highway right-of-way line: Northwesterly along a curve to the right whose center bears North 25024' East, 2689-79/100 feet, at 44-2/10 feet a 1 inch iron, and in all 161-7/10 feet to a concrete highway right-of-way monument; and then North 62006' West, 1918 feet to the PLACE OF BEGINNING and containing 158-6/10 acres of which 14-67/100 acres are within said Rogers Survey, 29 acres are within said Woody Survey, 81-97/100 acres are within said Atterbury Survey and 32-96/100 acres are within said Crow Survey. SECTION 2. That the use hereby permitted for Educational Purposes by the owner of the above described real property shall be and is hereby conditioned upon the observance of the following restriction: That no building shall be constructed within twenty- five (25) feet of the present boundary line of the property hereinabove described and hereby zoned for Educational Purposes, and further that no building in excess of one-story or fifteen (15) feet in height shall be constructed within seventy-five (75) feet of such present boundary line. SECTION 3. That the use for Educational Purposes hereby expressly per- mitted on the above described tract has been created and is here- by specially permitted in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the gen- eral welfare of the community; that the use for Educational Purposes hereby specially permitted of the property hereinabove described and the conditions restricting the location and con- struction of buildings are designed to lessen congestion in the streets, to secure safety from fire, panic, flood and other dangers, to provide adequate light and air, to prevent over- crowding of land, to avoid undue concentration of population, and to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements; and that the use permitted of the hereinabove described property specially for Educational Purposes and the conditions imposed restricting the location and height of buildings have been made after full and complete public hearing, with reasonable consideration, among other things, of the character of the tract herein described anc� its peculiar suitability for the particular use for Educational Purposes, and with a view of conserving the value of property and encouraging the most appropriate use of land throughout the community. SECTION 4. That this ordinance shall be cumulative of all other ordi- nances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 5. Should any section, clause or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 6. That the use for Educational Purposes hereby specially per- mitted on the 158.6 acre tract of land hereinabove described shall be, and the same is hereby declared to be, more restric- tive than uses, classifications or districts currently existing under the provisions of Ordinance No. 3011 , as amended. SECTION 7. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with, or who resists the en- -2- forcement of any of the proylsi;ons of this ordinance shall be fined not less than Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00) for each offense; and that each day a violation is permitted to exist shall constitute a separate offense. SECTION 8. That this ordinance will take effect and be in full force and effect from and after its passage and publication as required by law.
